{"id":13870,"date":"2017-09-11T20:00:49","date_gmt":"2017-09-11T20:00:49","guid":{"rendered":"https:\/\/one.sightlinemg.com\/airforcetimes\/uncategorized\/2017\/09\/11\/navy-seal-who-wrote-controversial-bin-laden-book-is-advising-on-new-cbs-showbr\/"},"modified":"2026-08-08T01:40:07","modified_gmt":"2026-08-08T01:40:07","slug":"navy-seal-who-wrote-controversial-bin-laden-book-is-advising-on-new-cbs-showbr","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/airforcetimes\/veterans\/2017\/09\/11\/navy-seal-who-wrote-controversial-bin-laden-book-is-advising-on-new-cbs-showbr\/","title":{"rendered":"Navy SEAL who wrote controversial bin Laden book is advising on new CBS show<br>"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The former Navy SEAL whose 2012 book included an account of the Osama bin Laden raid \u2014 and is at the center of a lawsuit over millions in lost royalties \u2014 now serves as an adviser on a CBS-TV drama about a SEAL unit that\u2019s set to debut this fall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Matt Bissonnette wrote \u201cNo Easy Day\u201d under the pen name Mark Owen and<a href=\"http:\/\/www.navytimes.com\/news\/your-navy\/2016\/08\/20\/navy-seal-vet-to-pay-6-6-million-to-settle-case-over-book\/\"> forfeited nearly $7 million in royalties<\/a> as part of a settlement that ended federal investigations into the book, which was not cleared by the Defense Department prior to publication. He\u2019s \u201cone of several special ops people\u201d involved in \u201c<a href=\"http:\/\/www.cbs.com\/shows\/seal-team\/\">SEAL Team<\/a>,\u201d CBS Entertainment Communications vice president Beth Haiken said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bissonnette sued his former legal team in 2014, alleging he\u2019d been advised not to provide \u201cNo Easy Day\u201d to Pentagon officials for review prior to publication. The suit, filed in New York, was thrown out in 2015 but was refiled <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2016\/01\/20\/lawyers-navy-seal-alleged-bin-laden-shooter-ignored-advice-on-no-easy-day\/\">shortly thereafter<\/a>&nbsp;in Indiana. Both defendants \u2014 the Carson Boxberger law firm and one of its former lawyers, retired Army judge advocate Kevin Podlaski \u2014 are based in that state.<br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A request by the defense for another dismissal was rejected Aug. 21 by a District Court judge in Fort Wayne. (Photo by Spencer Platt\/Getty Images)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Members of the defendants\u2019 legal team did not respond to multiple phone and email requests for comment. <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2016\/01\/20\/lawyers-navy-seal-alleged-bin-laden-shooter-ignored-advice-on-no-easy-day\/\">Previous legal filings<\/a> by the defense stated that Bissonnette lied to his then-lawyers about his service status and other details and was advised to submit the book for review, but ignored that advice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the request for dismissal, defense lawyers argued that the case hinges on what the DoD\u2019s pre-publication review would\u2019ve found, and that the court lacked the authority to predict those findings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Per a 2012 DoD memo, the book \u201ccontains classified and sensitive unclassified information.\u201d The memo included instructions to service members about the book: They were allowed to purchase it and not required to store it in the same way other classified materials are handled, but they were \u201cprohibited from using unclassified government computer systems to discuss potentially classified or sensitive contents.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Indiana judge ruled that a portion of Bissonnette\u2019s damage claim \u2014 about $3 million, on top of lost royalties \u2014 did not depend on DoD\u2019s findings, and instead stems from what Johnston described as \u201clost speaking opportunities, money spent on legal fees during the fight with the government, and damages to his reputation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Johnston called Bissonnette\u2019s job with \u201cSEAL Team\u201d a \u201ctestament to his character and his ability to, with time, overcome the negative comments of the past.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neither his lawyer nor CBS made Bissonnette available for comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the plot lines discussed in the show\u2019s pilot episode, which is set to air Sept. 27, involves a prospective SEAL whose father wrote a controversial memoir about his special operations service. The idea didn\u2019t come from Bissonnette, said \u201cSEAL Team\u201d executive producer and director Christopher Chulack.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe didn\u2019t ask him if we could use it,\u201d Chulack said. \u201cI think it just kind of got laid in there as an interesting story. \u2026 That wasn\u2019t calculated, the specificity to Mark Owen.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Matt Bissonnette, under the pen name Mark Owen, wrote a firsthand account of the bin Laden raid.
