{"id":15535,"date":"2019-03-27T02:27:37","date_gmt":"2019-03-27T02:27:37","guid":{"rendered":"https:\/\/one.sightlinemg.com\/airforcetimes\/uncategorized\/2019\/03\/27\/air-force-jag-says-commanders-may-invoke-god-at-change-of-command-ceremonies-sparking-protest\/"},"modified":"2026-08-07T20:21:33","modified_gmt":"2026-08-07T20:21:33","slug":"air-force-jag-says-commanders-may-invoke-god-at-change-of-command-ceremonies-sparking-protest","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2019\/03\/27\/air-force-jag-says-commanders-may-invoke-god-at-change-of-command-ceremonies-sparking-protest\/","title":{"rendered":"Air Force JAG says commanders may invoke God at change of command ceremonies, sparking protest"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A little publicized legal opinion that addresses commanders\u2019 rights to mention <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2016\/06\/22\/air-force-talking-about-god-at-retirement-ceremonies-does-not-violate-policy\/\" target=\"_blank\">God at change of command and promotion ceremonies<\/a>, issued by the Air Force judge advocate general in December, is now drawing protests and praise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The opinion, dated Dec. 19, addresses whether <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2015\/05\/21\/air-force-won-t-punish-general-for-speech-about-god\/\" target=_blank>commanders who invoke a deity<\/a> at their official change of command ceremony, and also at the promotion ceremony that often follows a change of command, violate the 1st Amendment\u2019s Establishment Clause and Air Force Instruction 1-1.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe conclude a commander may: briefly thank a Supreme Being (either generally, such as Providence, that Almighty Being, our Lord, or the Supreme Author of All Good; or specifically, such as Allah, Brahman, Christ, Ganesh, God, Yahweh, or even Beelzebub); have an invocation, and choose whomever he or she would like to provide the invocation,\u201d the opinion states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf the commander holds a personal promotion ceremony on the same day, a significant break must occur between the change of command and promotion ceremony in order for the commander to be freer in expressing his or her <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2018\/04\/03\/air-force-veteran-sues-after-being-thrown-out-of-flag-folding-ceremony\/\" target=\"_blank\">personal religious beliefs<\/a>,\u201d the opinion continues. \u201cIf a break does not occur, the commander must limit his or her religious comments to comments that are appropriate at the official change of command.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The opinion was provided to Air Force Times by Mikey Weinstein, founder and president of the <a href=\"https:\/\/www.militaryreligiousfreedom.org\/\" target=_blank>Military Religious Freedom Foundation<\/a>. A spokesman for the Air Force confirmed that it is authentic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/partner-mco-archive.s3.amazonaws.com\/client_files\/1553627454.pdf\" target=_blank><b>Read the Air Force JAG opinion<\/b><\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The foundation is objecting to the Air Force JAG\u2019s interpretation of the law and Air Force regulations and has asked the U.S. Commission on Civil Rights to hold a hearing on the foundation\u2019s concerns and overrule the opinion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.militaryreligiousfreedom.org\/wp-content\/uploads\/2019\/03\/Letter_to_US_Civil_Rights_Commission_Final_PDF.pdf\" target=_blank><b>Read MRFF\u2019s letter to the U.S. Commission on Civil Rights<\/b><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a March 21 letter to the commission, Weinstein notes that in the 1974 Supreme Court case Parker v. Levy, the court \u201cconcluded that First Amendment freedoms (such as the religious Free Exercise Clause) are restricted when such speech begins to <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2015\/05\/15\/group-wants-two-star-court-martialed-for-speech\/\" target=_blank>degrade morale<\/a>, good order and discipline in the Armed Forces.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHeretofore, the USAF has always concluded that speeches given at change of command and promotion ceremonies are, as a matter of law, official \u201cstate speech\u201d which may not endorse particular religious affiliations or lack thereof,\u201d Weinstein writes to the commission. \u201cSuch state speech would predictably have a deleteriously corrosive effect on the morale, good order, discipline, and unit cohesion of airmen in attendance who are not affiliated with the commanders\u2019 personally expressed religious beliefs and affiliation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Weinstein also points to Air Force Instruction 1-1, paragraph 2.12 \u2014 Balance of Free Exercise of Religion and Establishment Clause: \u201cLeaders at all levels must balance constitutional protections, for their own free exercise of religion, including individual expressions of religious beliefs, and the constitutional prohibition against governmental establishment of religion,&#8221; it states. &#8220;They must ensure their words and actions cannot reasonably be construed to be officially endorsing or disapproving of, or extending preferential treatment for any faith, belief, or absence of belief.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The JAG\u2019s legal opinion contradicts the Supreme Court ruling, Air Force precedent and the Air Force instruction, Weinstein argues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mike Berry, director of military affairs for <a href=\"https:\/\/firstliberty.org\/\" target=_blank>First Liberty Institute<\/a>, a national religious liberty organization that has represented numerous service members and veterans, disagrees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis looks like a desperate attempt by Mikey Weinstein to reverse good religious liberty law and policy,\u201d Berry said. &#8220;The [U.S. Commission on Civil Rights] should not grant Weinstein\u2019s inappropriate demands to harass the Air Force because of an internal policy memo that simply applies the Constitution and Supreme Court precedent to the Air Force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAt a time when our military needs more religious freedom, we can count on Mikey Weinstein to be the first to complain when the Air Force does something right,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Weinstein believes the weight of evidence suggests that airmen \u201cwho do not share the incoming commander\u2019s religious affiliation will question the impartiality of a commander who went out of his way at his change of command ceremony to state his loyalty and affection for a deity not shared by those airmen who hold affiliation with another deity or with no deity.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Weinstein also takes issue with the idea that by waiting at least 10 minutes between a change of command and a promotion ceremony, the latter becomes a personal, rather than official, event.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTo suggest that the promotion ceremony, which symbolizes an officer\u2019s promotion in grade to the Air Force community, is somehow \u201cunofficial\u201d ignores the obvious fact that his or her promotion is the result of state action on multiple levels,\u201d he wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the Air Force, promotion ceremonies typically occur on federal property, in aircraft hangars and officers\u2019 clubs,&#8221; he wrote. \u201cThe airmen who attend are in uniform, on \u201cofficial duty\u201d and accordingly paid by the U.S. taxpayers. They are not on personal or administrative leave. The honor guard, narrator, presiding official and the officer to be promoted are likewise each on active duty.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is unclear whether the U.S.
