Jay Ellis last Wednesday that <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2019\/11\/21\/national-guard-chief-wont-oust-wisconsin-whistleblower-until-probe-ends\/\" target=_blank>investigators <\/a>deemed his allegations unsubstantiated. It concluded that the actions were taken months after Ellis raised the sexual assault complaints, some of his commanders weren\u2019t aware of the complaints and that the ones who were followed protocol. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ellis said in an email to The Associated Press on Saturday that he plans to retire in December, but that he was \u201cshocked and deeply disappointed\u201d with the report\u2019s conclusions. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI didn\u2019t see anywhere in the report where the intent behind these actions was questioned or explained and that\u2019s really what reprisal is about, intent, right?\u201d Ellis said. \u201cIt\u2019s like cops investigating themselves.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2019\/11\/21\/national-guard-chief-wont-oust-wisconsin-whistleblower-until-probe-ends\/\" target=_blank>Wisconsin National Guard<\/a> spokesman Joe Trovato said the Guard takes reprisal complaints seriously. Ellis\u2019 allegations were investigated and the Guard considers his case closed, he said. <\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2020\/03\/06\/governor-swears-in-new-wisconsin-national-guard-leader\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP20065829836859.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Governor swears in new Wisconsin National Guard leader<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The Wisconsin National Guard\u2019s new leader took the oath of office Thursday, officially inheriting a command that was rocked by a scathing sexual assault scandal.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Ellis wrote to <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2019\/01\/10\/air-force-confirms-wisconsin-national-guard-sexual-misconduct-investigation\/\" target=_blank>U.S. Sen. Tammy Baldwin<\/a> in November 2018 saying he knew of at least six instances of sexual harassment or sexual assault against female members of the 115th Fighter Wing\u2019s Security Forces Squadron. The complaint sparked a federal investigation that determined Guard commanders were improperly launching in-house sexual assault investigations rather than referring complaints to military criminal investigators as required by federal law and Department of Defense policy. The findings drove the Guard\u2019s top commander, <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2020\/01\/08\/military-launched-probe-of-wisconsin-guards-top-leader\/\" target=_blank>Maj. Gen. Donald Dunbar<\/a>, to resign in December. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ellis began filing complaints in May 2019 alleging that Guard officials were retaliating against him for blowing the whistle. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He alleged that his commanders began a review of his medical history in November 2018 and exaggerated a chronic foot problem in hopes of getting him discharged and denying him retirement benefits. A medical review board ruled him fit for duty in December 2019. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He also alleged that he was placed on administrative duty, stripped of his authority to carry a weapon and forced to use a locker room for lower-ranking officers. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Air Force Inspector General\u2019s office assigned the Kansas National Guard\u2019s 190th Air Refueling Wing to investigate Ellis\u2019 allegations. That unit produced a 37-page report that takes his allegations apart, one by one. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report said Guard officials had been considering a review of Ellis\u2019 medical history as early as September 2018. At least one commander testified that she had no knowledge of the sexual assault complaints until November 2018. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As for the transfer to administrative duty, commanders decided to transfer him to protect him from a \u201chostile climate\u201d in the security squadron. The report notes that Ellis testified the re-assignment was a mutual decision. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report also concluded that Ellis was placed on a \u201cno-arm\u201d list because he was taking an anti-depressant that required a 90-to 120 day \u201cstabilization period\u201d to make sure the medicine didn\u2019t cause any adverse effects. He was placed on the no-arm list two months after he raised the sexual assault complaints, the report added. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As for moving him into a new locker room, the report found that when Ellis was transferred to administrative duty they had to give Ellis\u2019 locker to his replacement in the security squadron. His new locker was in a locker room for all male non-commissioned officers and the move was made five months after Ellis made the sexual assault complaints, the report concluded. <\/p>\n\n\n\n<p
