Here\u2018s why.<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Lockheed Martin&#039;s Sikorsky made the rare move of filing a protest with the U.S. Government Accountability Office before the Air Force chose a winner for the UH-1N replacement program.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The GAO\u2019s decision will allow the Air Force to stay on track with a contract award, which is planned to occur this June. Sikorsky is competing against a Boeing-Leonardo team, which is proposing a militarized version of <a href=\"https:\/\/www.defensenews.com\/digital-show-dailies\/air-warfare-symposium\/2017\/03\/02\/boeing-and-leonardo-debut-the-mh-139-their-bid-for-the-huey-replacement\/\" title=\"\" class=\"\" target=\"_blank\">Leonardo\u2019s AW139 commercial helicopter<\/a>, and Sierra Nevada Corp., which is offering to upgrade old Army UH-60Ls.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement, Kenneth Patton, GAO\u2019s managing associate general counsel for procurement law, said that the organization had denied some parts of the protest and dismissed the rest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAs explained in our decision, the protest challenged the Air Force\u2019s stated interpretation of the RFP in the area of technical data rights, as well as the conduct of discussions. GAO concluded that the protest grounds were either without merit, untimely, or in some cases, premature,\u201d he wrote. <br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the decision was not make public on May 22, as it contained proprietary and source selection sensitive information, a redacted version will be made available in the coming weeks, Patton continued. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sikorsky confirmed that the company had received the decision and is now reviewing its options to determine whether to take further legal action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe remain confident the Sikorsky HH-60U offering is the strongest, most capable and only technically compliant solution for the UH-1N Huey replacement program,\u201d the statement reads. \u201cWe remain committed to supporting the Air Force and providing them with a proven, in-production military aircraft for the critical no-fail mission of protecting our nation\u2019s nuclear missile silos and supporting the continuity-of-government mission.\u201d<\/p>\n\n\n<figure class=\"wp-block-smg-jwplayer-video\"><atype-video-jwplayer nostick=\"true\" playlisturl=\"https:\/\/cdn.jwplayer.com\/v2\/playlists\/fCzRqMW8?tags=bb628601-e352-4c33-992f-b4c931a2ffc0\" aspectratio=\"16 \/ 9\" mute autostart=\"false\"><\/atype-video-jwplayer><figcaption class=\"wp-element-caption\">Defense News TV talks to two companies vying to replace the U.S. Air Force\u2019s aging UH-1N Huey helicopters. One offering is the MH-139, built by Boeing and Leonardo; and the other is the HH-60U version of the Sikorsky Blackhawk.<\/figcaption><\/figure>\n\n\n<p class=\"wp-block-paragraph\">The HH-60U \u2014 a variant of the UH-60 Black Hawk \u2014 is widely seen as the favorite to win the competition due to the helicopter\u2019s use throughout the U.S. services and the Air Force\u2019s stated preference in the past to sole source the aircraft.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the core of Sikorsky\u2019s protest was a disagreement with the government over what type of information constitutes operations, maintenance, installation and training data \u2014 informally called OMIT data \u2014 which automatically would transfer to the government for its unlimited use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe issue there is they can use that however they see fit. Give it to other services, other vendors,\u201d David Morgan, Sikorsky\u2019s business development director, told Defense News in February.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But according to the Defense Federal Acquisition Regulation Supplement, \u201csoftware source code is not considered as sustainment or OMIT data.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sikorsky officials said then that the company had previously filed an agency-level protest to try to address its issues with the Air Force before protesting with the GAO. However, the outcome, they said, did not address their concerns.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the GAO decided to sustain Sikorsky\u2019s protest, the Air Force would likely have been forced to rework its requirements, adding at least months to the process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>Updated on 5\/23\/2018 at 2:47am EST to add a statement from the
