{"id":36456,"date":"2020-11-20T15:59:34","date_gmt":"2020-11-20T15:59:34","guid":{"rendered":"https:\/\/one.sightlinemg.com\/airforcetimes\/uncategorized\/2020\/11\/20\/labor-authority-overturns-vas-new-employee-discipline-process\/"},"modified":"2026-08-08T04:55:22","modified_gmt":"2026-08-08T04:55:22","slug":"labor-authority-overturns-vas-new-employee-discipline-process","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/airforcetimes\/veterans\/2020\/11\/20\/labor-authority-overturns-vas-new-employee-discipline-process\/","title":{"rendered":"Labor authority overturns VA\u2019s new employee discipline process, affecting thousands"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Thousands of Department of Veterans Affairs employees who were fired, suspended or demoted over the past three years under provisions of the VA Accountability and Whistleblower Protection Act must be reinstated with full back pay, the Federal Labor Relations Authority recently determined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The VA Accountability and Whistleblower Protection Act, which became law in June 2017, enables VA managers to more quickly institute disciplinary action for underperforming employees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Veterans Benefits Administration notified employees in September 2017 of the change in disciplinary processes, at which point the American Federation of Government Employees National VA Council filed a national grievance.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2019\/11\/15\/va-to-cut-union-time-and-office-space-use\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/IMG_8039.JPG_5f7989.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">VA to cut union time and office space use<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The Department of Veterans Affairs is returning to union-restricting policies it first imposed in 2018 after a series of executive orders called for such limitations.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The changes to VA disciplinary procedure violated the union\u2019s contract with the agency, which states that employees must be given the opportunity to improve their performance before receiving disciplinary action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And though the VA argued that the law superseded a collective bargaining agreement, an arbiter determined in 2018 that the law itself does not dictate what an agency does prior to the decision to remove an employee, such as granting that employee an opportunity to improve first.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FLRA upheld that arbiter\u2019s interpretation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are extremely pleased with the FLRA\u2019s decision to uphold the arbitrator\u2019s initial award. The VA Accountability Act has been used disproportionately to fire low-level employees, not to fix issues caused by failed leadership, such as chronic understaffing amidst a global pandemic. We are glad that these employees will deservedly be made whole, and that new leadership is coming to the VA who will work together with VA workers to deliver the highest standard of care to our veterans,\u201d AFGE National President Everett Kelley said in a news release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agency will be required to reinstate all fired and demoted employees under the Act with full payment of lost wages and benefits, which, according to the union, amounts to thousands of low-level agency employees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPresident Trump has repeatedly boasted about firing low-level employees using provisions of the VA Accountability Act, falsely labeling front-line VA caregivers \u2018sadists\u2019 and \u2018thieves\u2019 while completely failing to bring accountability to anyone in VA leadership. This decision is a complete victory for our members and VA employees across the country who have dedicated their lives to caring for our nation\u2019s veterans, even through a pandemic,\u201d said Alma Lee, AFGE NVAC president, in a news release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The relationship between organized labor and the VA has been <a href=\"https:\/\/www.federaltimes.com\/management\/2020\/06\/04\/crisis-negotiations-how-coronavirus-brought-collective-bargaining-at-the-va-to-a-head\/\" target=_blank>strained throughout the Trump
