It is currently known in the United States as \u201cNVX-CoV2373.\u2033<\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A federal appellate judge has dealt another blow to the military\u2019s coronavirus vaccine mandate by allowing a high-profile class-action lawsuit against the Air Force to move forward.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The U.S. Court of Appeals for the Sixth Circuit in Cincinnati opted to keep the case\u2019s class-action status in an order issued Sept. 9. The three-judge panel also said it plans to fast-track the government\u2019s appeal of an earlier district court ruling that favored the unvetoed plaintiffs who are suing on religious freedom grounds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Judge Raymond Kethledge\u2019s court order pushed back on the military\u2019s argument that stopping the mandate would cause \u201cirreparable harm\u201d by requiring the Department of the Air Force to retain nearly 10,000 troops who can\u2019t \u2014 or aren\u2019t allowed to \u2014 fully carry out their duties because they aren\u2019t vaccinated against COVID-19.<\/p>\n\n\n<aside class=\"smg-interstitial-link smg-interstitial-link--fallback wp-block-smg-interstitial-link\"><a href=\"https:\/\/s3.amazonaws.com\/static.militarytimes.com\/assets\/pdfs\/1663177870.pdf\" class=\"smg-interstitial-link__fallback-link\">Read the Sept. 9 court order in Doster v. Kendall<\/a><\/aside>\n\n\n<p class=\"wp-block-paragraph\">\u201cThose are all the very same harms that the department imposed on itself when, to its credit, it chose to grant temporary exemptions to service members\u201d awaiting a final decision on their religious accommodation requests, the order said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Oral arguments in the appellate case are scheduled for Oct. 19. The court plans to decide the outcome in November.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court suggested that instead of enforcing a service-wide vaccine mandate and granting individual exemptions, the Air Force may be better off allowing troops to opt into the mandate instead.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Doster v. Kendall in U.S. District Court in the Southern District of Ohio brings together about 10,000 airmen and Space Force guardians under a class-action suit that argues the military is unfairly forcing people to receive a vaccine, which they object to on religious grounds, or lose their job.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The group includes anyone in the active duty Air Force and Space Force, Air Force Reserve, Air National Guard, U.S. Air Force Academy and Air Force Reserve Officer Training Corps who have asked for a religious exemption to the vaccine since Sept. 1, 2021, showed a sincere religious belief opposing the jab, and whose requests were denied or are not yet settled.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2022\/08\/01\/court-blocks-air-force-from-punishing-unvaccinated-troops-seeking-religious-waivers\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"158\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/COVID-19-booster-shot.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Court blocks Air Force from punishing unvaccinated troops seeking religious waivers<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The class-action complaint temporarily protects thousands of airmen and guardians who remain unvaccinated against COVID-19.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Most of them say they oppose any connection to fetal cell lines or tissues that were derived from aborted fetuses years ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pfizer and Moderna\u2019s mRNA products used cells replicated from a fetus aborted in the 1970s to make sure the vaccines worked in human cells. The fetal cells were not used to produce either vaccine, National Geographic reported last fall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Johnson &amp; Johnson uses cells replicated from a fetus aborted in 1985 to produce its vaccine, but those cells are filtered out from the final product.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other vaccines that claim not to have remote ties to abortion practices, like India-made Covaxin and another made by the American company Novavax, are available now as well.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In allowing the class-action status to remain, the court said the plaintiffs don\u2019t have to prove that the Air Force has created a literal policy opposing religious exemptions to the COVID-19 vaccines or that it is denying every single one.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2022\/08\/11\/the-national-guard-has-a-new-weapon-in-the-fight-for-covid-vaccination\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Guard.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">The National Guard has a new weapon in the fight for COVID vaccination<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The National Guard is shipping doses of Novavax\u2019s newly approved COVID-19 vaccine out to units in hopes it will help shrink the number of unvaccinated Guardsmen who face expulsion.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">But plaintiffs do have to show a trend in how the Air Force is handling cases that it claims are subject to individual scrutiny, the court order said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAll those exemptions were granted to service members who were separately eligible for an administrative exemption\u201d because they could soon separate or retire from the Air Force, the order said. \u201cThus the record suggests that, at present, the number of exemptions that the department has granted on religious grounds stands at zero.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More than 97% of the 497,000 or so uniformed members in the Air Force and Space Force were fully vaccinated as of Sept. 7, the service said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Centers for Disease Control and Prevention, more than 95 million COVID-19 cases have been recorded in the U.S. since the pandemic began in late 2019.
