The lawsuit filed in New York\u2019s Southern District claims West Point is violating the Fifth Amendment of the U.S. Constitution, which contains an equal-protection principle that binds the federal government.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/pentagon-congress\/2023\/06\/30\/lawmakers-eye-ending-affirmative-action-at-military-academies\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP23147539431516.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Lawmakers eye ending affirmative action at military academies<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Proposals to the annual defense authorization bill would extend the Supreme Court&#039;s ban on the practice to military schools.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">\u201cInstead of admitting future cadets based on objective metrics and leadership potential, West Point focuses on race,\u201d according to the complaint. \u201cIn fact, it openly publishes its racial composition \u2018goals,\u2019 and its director of admissions brags that race is wholly determinative for hundreds if not thousands of applicants.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The academy said in a prepared statement that it \u201cdoes not comment on ongoing investigations to protect the integrity of its outcome for all parties involved.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The filing comes after the&nbsp;<a href=\"https:\/\/apnews.com\/hub\/us-supreme-court\" target=\"_blank\">Supreme Court<\/a>&nbsp;in June struck down affirmative action in college admissions, forcing institutions of higher education to look for new ways to achieve diverse student bodies. The court\u2019s conservative majority invalidated admissions plans at&nbsp;Harvard University, and the&nbsp;University of North Carolina, the nation\u2019s oldest private and public colleges, respectively.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That ruling did not cover West Point and the nation\u2019s other military academies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Edward Blum, president of SFFA, said in a prepared statement that with the recent high court decision, \u201cit must follow that the U.S. military\u2019s higher education institutions must end their race-based policies as well.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOver the years, courts have been mindful of the military\u2019s unique role in our nation\u2019s life and the distinctive considerations that come with it,\u201d Blum said. \u201cHowever, no level of deference justifies these polarizing and disliked racial classifications and preferences in admissions to West Point or any of our service academies.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">West Point produces about 17% of newly commissioned Army officers each year, according to the lawsuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/apnews.com\/hub\/us-military-academy\" target=\"_blank\">West Point<\/a>&nbsp;in recent years has made concerted efforts to diversify its ranks, with officials increasing outreach to metropolitan areas like New York City, Atlanta and Detroit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Minority enrollment was about 38% for the class of more than 1,240 that entered the academy north of New York City this summer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The academy also recently complied with&nbsp;<a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/12\/22\/west-point-is-removing-confederate-symbols-from-campus\/\" target=\"_blank\">recommendations from a commission<\/a>&nbsp;created by Congress to remove honors to Robert E. Lee and other Confederate officers as a way to address racial injustice. Still, some graduates of color from West Point and the nation\u2019s other military schools&nbsp;<a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2021\/12\/03\/we-just-feel-it-racism-plagues-us-military-academies\/\" target=\"_blank\">have described hostile environments<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit filed Tuesday also names the Department of Defense, Secretary of Defense Lloyd Austin and other
