That prompted <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2021\/12\/20\/hearing-starts-in-hawaiis-order-to-de-fuel-navy-tanks-amid-contaminated-water-crisis\/\" target=\"_blank\">two days of hearings<\/a> presided over by David D. Day, a deputy attorney general. After <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2021\/12\/21\/hawaii-hearing-over-tainted-navy-water-ends-without-a-ruling\/\" target=\"_blank\">those hearings<\/a>, Day on Monday recommended that the governor\u2019s order be followed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The governor issued his order after the Navy disclosed that fuel from a World War II-era <a href=\"https:\/\/www.navytimes.com\/news\/your-military\/2021\/12\/12\/navy-blames-hawaii-water-contamination-on-jet-fuel-spill\/\" target=\"_blank\">fuel storage facility at Red Hill<\/a> had contaminated one of its drinking water wells and sickened hundreds in military housing. Honolulu officials are concerned leaks from the facility may permanently damage an aquifer that sits underneath the tanks, jeopardizing Oahu\u2019s broader water supply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy has a legal right to its filing, said David Henkin, a lawyer for Earthjustice, which represented the Sierra Club of Hawaii in the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBut it also has a moral obligation to acknowledge the reality that every day it fights this emergency order, is another day that Oahu\u2019s principle source of drinking water remains at risk for catastrophic and irreversible contamination,\u201d Henkin said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy\u2019s filing Wednesday said Day used an \u201coverbroad\u201d interpretation of the Department of Health\u2019s emergency authority to regulate underground fuel storage tanks. The filing said 30 of those releases were attributed to an early leak detection system with a flawed design that generated false positives. Another 26 leaks were from tanks 1 and 19, which have been permanently decommissioned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy\u2019s filing also objected to Day\u2019s description of the Red Hill tanks as being too old, poorly designed, difficult to inspect and too large to prevent future releases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy responded that the November fuel leak that contaminated the Navy\u2019s drinking water well came from \u201can accidental pipe release caused by human error\u201d and not from a tank leak.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThat release, in other words, does not support the Hearing Officer\u2019s theory of system risk,\u201d the Navy said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>At issue is whether the Navy should be required, as ordered by Gov.
