{"id":65486,"date":"2021-12-01T01:21:46","date_gmt":"2021-12-01T01:21:46","guid":{"rendered":"https:\/\/one.sightlinemg.com\/airforcetimes\/uncategorized\/2021\/12\/01\/judge-deciding-what-us-should-pay-for-texas-church-shooting\/"},"modified":"2026-08-08T12:57:33","modified_gmt":"2026-08-08T12:57:33","slug":"judge-deciding-what-us-should-pay-for-texas-church-shooting","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2021\/12\/01\/judge-deciding-what-us-should-pay-for-texas-church-shooting\/","title":{"rendered":"Judge deciding what US should pay for Texas church shooting"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">SAN ANTONIO \u2014 The U.S. Justice Department and survivors of a 2017 Texas church massacre are at odds over how much the Air Force should pay in compensation&nbsp;<a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2017\/11\/07\/air-force-investigates-mistakes-that-allowed-texas-church-shooter-to-get-guns\/\">for failing to flag a conviction<\/a>&nbsp;that might have prevented the gunman from legally buying the weapon used in the shooting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During closing arguments Monday in a civil trial in federal court in San Antonio, the Justice Department said its proposal of $31.8 million was based on evidence presented during a monthlong trial on damages and on previous court cases, federal and Texas state law, and disbursements from a fund for victims of the 9\/11 terrorist attacks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawyers for the survivors and for relatives of those killed at First Baptist Church of Sutherland Springs are asking for $418 million, the&nbsp;<a href=\"https:\/\/www.expressnews.com\/news\/local\/article\/Sutherland-Springs-massacre-closing-arguments-16660530.php\">San Antonio Express-News<\/a>&nbsp;reported. Some of the plaintiffs\u2019 lawyers called the government\u2019s proposed payment for pain, suffering and mental anguish \u201cridiculous,\u201d unjust and unfair.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Devin Patrick Kelley&nbsp;<a href=\"https:\/\/apnews.com\/article\/north-america-shootings-tx-state-wire-us-news-ap-top-news-eb4edefae08b4bde8efa6782e686bc33\">opened fire during a Sunday service there in November 2017,&nbsp;<\/a>killing more than two dozen people. Kelley died of an apparent self-inflicted gunshot wound after he was shot and chased by two men who heard the gunfire at the church.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The civil trial to assess damages began in October. U.S. District Judge Xavier Rodriguez in July&nbsp;<a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2021\/07\/08\/judge-air-force-mostly-at-fault-in-deadly-2017-texas-church-attack\/\">ruled that the Air Force was \u201c60 percent liable\u201d&nbsp;<\/a>for the attack because it failed to submit Kelley\u2019s assault conviction during his time in the Air Force to a national database.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2018\/04\/27\/5-years-before-massacre-gunman-promised-military-judge-not-to-hurt-anyone\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"225\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP18116743143638.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">5 years before massacre, gunman promised military judge not to hurt anyone<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The gunman in a mass shooting at a Texas church last year told a military judge in 2012 he \u201cwould never allow myself to hurt someone\u201d again while admitting to abusing his stepson and a long struggle with anger, according to Air Force records obtained by The Associated Press on Thursday.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Rodriguez said Monday that he could not take unrelated settlements into account in determining a verdict in the Sutherland Springs case. He promised careful consideration of the evidence and said he would deliver a verdict \u201cas soon as I can.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The approximately 80 claimants include relatives of those killed as well as 21 survivors and their families. Authorities put the official death toll at 26 because one of the 25 people killed was pregnant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In seeking compensation, many of the plaintiffs cited loss of companionship: the absence of parents who cannot attend weddings or graduations or be a presence in their lives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019ve used the words shocking, horrific, inhumane to describe what\u2019s happened to these families,\u201d Jamal Alsaffar, an attorney for several of the plaintiffs, said in court. \u201cBut the same words can be used to
