{"id":72771,"date":"2022-11-23T17:30:06","date_gmt":"2022-11-23T17:30:06","guid":{"rendered":"https:\/\/one.sightlinemg.com\/airforcetimes\/uncategorized\/2022\/11\/23\/army-veteran-suing-timeshare-company-over-predatory-lending-practices\/"},"modified":"2026-08-08T14:33:06","modified_gmt":"2026-08-08T14:33:06","slug":"army-veteran-suing-timeshare-company-over-predatory-lending-practices","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2022\/11\/23\/army-veteran-suing-timeshare-company-over-predatory-lending-practices\/","title":{"rendered":"Army veteran suing timeshare company over predatory lending practices"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Federal Trade Commission has joined <a href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/bluegreen_vacations_amicus_brief_as_filed.pdf?utm_source=cision&#038;utm_medium=email&#038;utm_campaign=Bluegreen_amicus_brief\" target=\"_blank\">a lawsuit<\/a> filed last year by a former soldier and his wife, alleging that the timeshare company they bought into did not follow <a href=\"https:\/\/www.militarytimes.com\/pay-benefits\/mil-money\/2022\/09\/29\/feds-allege-online-lender-overcharged-and-deceived-troops-families\/\" target=\"_blank\">specific federal regulations<\/a> that govern lending to members of the military, according to a Tuesday release from the FTC.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.militarytimes.com\/pay-benefits\/2018\/08\/23\/advocates-to-mattis-dont-waver-in-protecting-troops-against-predatory-lenders\/\" target=\"_blank\">Consumer Financial Protection Bureau <\/a>has also signed onto the appeal brief, filed Monday, urging the court to overturn a judge\u2019s decision to dismiss the case based on lack of \u201cconcrete injury\u201d to the couple, Emmanuel and Tamarah Louis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe brief argues that Mr. and Mrs. Louis have a legal right to challenge the contract in court because they suffer harm from their ongoing obligations under the contract, which they have claimed was illegal under the Military Lending Act,\u201d according to the FTC release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Louises bought into the Florida-based Bluegreen Vacations in late 2020, when Emmanuel Louis was still serving in the Army. They later learned their contract violated the Military Lending Act, a 2006 federal law that protects active duty service members from certain lending practices considered predatory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The MLA requires lenders to disclose a loan agreement\u2019s Military Annual Percentage Rate, which must include costs like fees and finance charges, and cannot exceed 36%. But a judge who ruled on their September 2021 filing found that they couldn\u2019t prove they had been injured by the contract, and that it wasn\u2019t clear that the MLA violations would have made a difference in their decision to purchase the timeshare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe district court\u2019s holding, if affirmed, would substantially curtail enforcement of the MLA. It would, in effect, bar service members from bringing suit unless they can show that the alleged violation of the MLA was material to their decision to take out the loan at issue,\u201d according to the brief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Louises are seeking to have their contract voided and the payments they\u2019ve made refunded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEmmanuel and Tamarah Louis allege that they were sold an illegal financial product \u2014 a product that Congress determined poses such an acute risk to American service members, to their financial wellbeing, to their morale, to the military\u2019s operational readiness, and to the country\u2019s national defense that it should be illegal to sell the product
