{"id":78184,"date":"2024-05-02T19:39:15","date_gmt":"2024-05-02T19:39:15","guid":{"rendered":"https:\/\/one.sightlinemg.com\/airforcetimes\/uncategorized\/2024\/05\/02\/judge-declares-mistrial-after-jury-deadlocks-in-abu-ghraib-trial\/"},"modified":"2026-08-08T16:13:56","modified_gmt":"2026-08-08T16:13:56","slug":"judge-declares-mistrial-after-jury-deadlocks-in-abu-ghraib-trial","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2024\/05\/02\/judge-declares-mistrial-after-jury-deadlocks-in-abu-ghraib-trial\/","title":{"rendered":"Judge declares mistrial after jury deadlocks in Abu Ghraib trial"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A judge declared a mistrial Thursday after a jury said it was deadlocked and could not reach a verdict in the trial of a military contractor accused of contributing to the abuse of detainees at the Abu Ghraib Prison in Iraq two decades ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mistrial came in the jury\u2019s <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2024\/04\/22\/jury-deliberating-in-abu-ghraib-case-contractor-casts-blame-on-army\/\" target=\"_blank\">eighth day of deliberations<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The eight-member civil jury in Alexandria deadlocked on accusations the civilian interrogators who were supplied to the U.S. Army at Abu Ghraib in 2003 and 2004 had conspired with soldiers there to abuse detainees as a means of \u201csoftening them up\u201d for questioning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial was the first time a U.S. jury heard claims brought by Abu Ghraib survivors in the 20 years since photos of detainee mistreatment \u2014 accompanied by smiling U.S. soldiers inflicting the abuse \u2014 shocked the world during the U.S. occupation of Iraq.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reston, Virginia-based CACI had argued that it wasn\u2019t complicit in the detainees\u2019 abuse. It said that its employees had little to any interaction with the three plaintiffs in the case and that any liability for their mistreatment belonged to the government, not CACI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They jury sent out a note Wednesday afternoon <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2024\/04\/29\/jury-deadlocked-in-abu-ghraib-trial\/\" target=\"_blank\">saying it was deadlocked<\/a>, and indicating in particular that it was hung up on a legal principle known as the \u201cborrowed Servants\u201d doctrine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiffs can seek a retrial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Asked if they would do so, Baher Azmy with the Center for Constitutional Rights, one of their lawyers, said, \u201cThe work we put in to this case is a fraction of what they endured as survivors of the horrors of Abu Ghraib, and we want to honor their courage.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2024\/04\/12\/20-years-later-abu-ghraib-detainees-get-their-day-in-us-court\/\" target=\"_blank\">During the&nbsp;trial that began April 15<\/a>, lawyers for the three plaintiffs argued that CACI was liable for their mistreatment even if they couldn\u2019t prove that CACI\u2019s interrogators were the ones who directly inflicted the abuse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They argued that the interrogators had entered into a conspiracy with the military police who inflicted the abuse by instructing soldiers to \u201csoften up\u201d detainees for questioning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The evidence included <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2024\/04\/16\/retired-generals-testimony-links-contractor-to-abu-ghraib-abuses\/\" target=\"_blank\">reports from two retired Army generals<\/a>, who documented the abuse and concluded that multiple CACI interrogators were complicit in the abuse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those reports concluded that one of the interrogators, Steven Stefanowicz, lied to investigators about his conduct, and that he likely instructed soldiers to mistreat detainees and used dogs to intimidate detainees during interrogations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Stefanowicz testified for CACI at trial through a recorded video deposition and denied mistreating detainees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CACI officials initially had serious doubts about his ability to work as an interrogator, according to evidence introduced at trial. An email sent by CACI official Tom Howard before the company sent interrogators to Iraq described Stefanowicz as a \u201cNO-GO for filling an interrogator position.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CACI initially sent Stefanowicz over to Iraq not as an interrogator but as a screener, but he testified that the Army \u2014 desperately short of interrogators at a prison with a rapidly expanding population \u2014 promoted him to interrogator within a day of his arrival.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trial evidence showed that CACI defended the work of another of its interrogators, Dan Johnson, even after the Army sought his dismissal when photos of the Abu Ghraib abuse became public, and one of the photos showed Johnson questioning a detainee in a crouched position that Army investigators determined to be an unauthorized stress position.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The jury deadlocked on accusations that civilian
