{"id":78322,"date":"2025-09-05T00:01:01","date_gmt":"2025-09-05T00:01:01","guid":{"rendered":"https:\/\/one.sightlinemg.com\/airforcetimes\/uncategorized\/2025\/09\/05\/dc-sues-trump-administration-over-national-guard-deployment\/"},"modified":"2026-08-08T16:38:53","modified_gmt":"2026-08-08T16:38:53","slug":"dc-sues-trump-administration-over-national-guard-deployment","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/pentagon-congress\/2025\/09\/05\/dc-sues-trump-administration-over-national-guard-deployment\/","title":{"rendered":"DC sues Trump administration over National Guard deployment"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The attorney general for the District of Columbia says the nation\u2019s capital is suing the Trump administration for deploying the National Guard within the city\u2019s boundaries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The attorney general\u2019s office alleges the administration\u2019s efforts are an \u201cinvoluntary military occupation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNo American city should have the US military \u2013 particularly out-of-state military who are not accountable to the residents and untrained in local law enforcement \u2013 policing its streets,\u201d Attorney General Brian Schwalb said. \u201cIt\u2019s DC today but could be any other city tomorrow.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">White House spokeswoman Abigail Jackson downplayed the lawsuit Thursday, telling Military Times in a statement that the president\u2019s actions fell \u201cwell within\u201d his authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis lawsuit is nothing more than another attempt \u2014 at the detriment of DC residents and visitors \u2014 to undermine the President\u2019s highly successful operations to stop violent crime in DC,\u201d she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More than 2,200 National Guard troops are deployed in Washington, D.C., where crimes were already on the decline prior to their deployment, <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2025\/08\/29\/trumps-push-for-more-troops-in-us-cities-at-odds-with-crime-stats\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/news\/your-military\/2025\/08\/29\/trumps-push-for-more-troops-in-us-cities-at-odds-with-crime-stats\/\">according to FBI crime data<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since the deployment, crime has continued to decrease with the administration\u2019s surge of federal resources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cGuard members \u2026 remain committed to the President\u2019s directive to address the epidemic of crime in the Nation\u2019s capital,\u201d said a spokesman for the Guard\u2019s joint task force in the capital.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/mpdc.dc.gov\/dailycrime\" target=\"_blank\" rel=\"\" title=\"https:\/\/mpdc.dc.gov\/dailycrime\">Washington, D.C., Metropolitan Police Department<\/a> data showed that 20-year homicide trends last year were at their lowest point since the 2020 pandemic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Homicide rates in 2024 were 68% lower than the record highs of the 1990s, from about 80 homicides per 100,000 residents to about 25 homicides per 100,000 residents, FBI crime data shows. But those rates last year were almost twice as high as in 2012, when the nation\u2019s capital experienced a 50-year low in the number of homicides per capita.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">President Donald Trump has vowed to deploy the National Guard to other cities in the United States. He initially told reporters Tuesday that the Guard would be \u201cgoing in\u201d Chicago, which he described as a \u201chellhole\u201d and \u201cthe murder capital of the world.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Wednesday, he shifted to say that the White House was making a determination on whether to go into Chicago or <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/09\/03\/trump-suggests-national-guard-could-go-into-new-orleans\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/09\/03\/trump-suggests-national-guard-could-go-into-new-orleans\/\">New Orleans<\/a>, which he described as \u201ca very nice section of the country that\u2019s become quite tough.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neither city ranks among the top 10 for total crime rates of cities with more than 250,000 residents, and neither city ranks in the top 10 for violent crimes per 100,000 residents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Memphis, Cleveland and St. Louis are plagued with the highest total crime rates, according to FBI crime data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Critics of deploying the Guard say the president\u2019s description of the two cities, one in a Blue state and the other in a Red state, emphasizes that politics, rather than a public safety emergency, are leading the White House\u2019s deployments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is absolutely the case where he is attacking and occupying Blue cities. There is no doubt about it, and the military members, these young men and women, they know they are political pawns, and it bothers them greatly,\u201d retired Maj. Gen. Randy Manner, who served as vice chief of the National Guard Bureau, told Military Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Manner said the United States is in an \u201cextremely dangerous situation\u201d that is beginning to \u201cdrive a wedge, quite frankly, between our military and our citizens in these various cities where [Trump is] deploying them.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said that he feared further deployments could give rise to a divide reminiscent of when soldiers like his dad returned from Vietnam, a period when those protesting the war often took frustrations out on the military.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt will no longer be that our military is part of us. It\u2019ll be it\u2019s those guys in uniform, those armed thugs,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even as Chicago\u2019s crime rates are down across the board this year, dozens of people were shot and at least seven people were killed in the city in a surge of violence over the Labor Day weekend.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chicago and Illinois leaders have said they do not want U.S. troops to assist in the city. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNational Guard troops are not trained to do local law enforcement, but FBI agents, DEA agents, ATF agents are trained to fight crime, and they have collaborated with local law enforcement. So I would prefer more resources on that, [rather] than sending the military illegally into the streets of American cities against American citizens,\u201d Illinois Attorney General Kwame Raoul told CNN on Tuesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. Sen. Marsha Blackburn, a Republican running for governor in Tennessee, praised Trump\u2019s efforts to fight crime by deploying troops to American cities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf your local leaders are going to fail and not accept that responsibility to keep their community safe, then it is going to be up to the president to bring that attention to that city,\u201d Blackburn said Wednesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier this week, a federal judge in California determined that the president illegally violated the <a href=\"https:\/\/www.militarytimes.com\/veterans\/military-history\/2025\/06\/18\/the-history-of-presidents-activating-us-troops-on-american-soil\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/veterans\/military-history\/2025\/06\/18\/the-history-of-presidents-activating-us-troops-on-american-soil\/\">Posse Comitatus Act<\/a>, which limits the power of the federal government to use military force for domestic matters, when he deployed 4,000 National Guard troops and 700 Marines to Los Angeles in June.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe judge ruled that the president failed to show there was a rebellion or inability of civil authorities to respond to the demonstrations, which is the requirement in federal law to use troops over the objections of the governor. Accordingly, he will have the same issue should he try to do this in Chicago, and likely the same result,\u201d retired Maj. Gen. William Enyart, a former congressman who also served as the 37th Adjutant General for the Illinois National Guard, told Military Times on Tuesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">White House spokeswoman Anna Kelly called Breyer \u201ca rogue judge\u201d trying to \u201cusurp the authority of the Commander-in-Chief\u201d and vowed to fight the
