Col. Stuart Scheller<\/a> walked into a <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/10\/14\/day-one-of-scheller-trial-brings-a-guilty-plea-and-a-political-sideshow-sentencing-tomorrow\/\" target=\"_blank\">Camp Lejeune, North Carolina, courtroom <\/a>Friday morning, he looked relaxed and was smiling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The infantry Marine had been fired from his job, and <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/10\/14\/marine-who-took-to-social-media-to-demand-accountability-pleads-guilty-to-all-charges\/\" target=\"_blank\">later charged with six violations<\/a> of the Uniform Code of Military Justice, for a series of viral social media posts that <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/09\/02\/fired-marines-question-about-leader-accountability-should-not-be-dismissed\/\" target=\"_blank\">criticized senior leaders <\/a>over their handling of the withdrawal of troops from Afghanistan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI feel good,\u201d Scheller said as he walked in to learn his sentence. He came back outside to add, \u201cwe\u2019ll see what they do.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Less than an hour later, he walked out without a word after Col. Glen Hines, the Marine Corps judge who decided his sentence, rejected the prosecution\u2019s requested punishment and sharply criticized the Corps\u2019 handling of the case.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/marinecorpstimes\/news\/your-marine-corps\/2021\/10\/15\/day-one-of-scheller-trial-brings-a-guilty-plea-and-a-political-sideshow-sentencing-tomorrow\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"225\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/FBqPwtPXMAcONfN.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Day 1 of outspoken Marine\u2019s trial brings guilty plea and political sideshow<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">\u201cI am being held accountable for my actions,&quot; Scheller said. &quot;The general officers should be held accountable for their failures.&quot;<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Hines said Scheller\u2019s videos in their full context showed a man who appeared \u201cto be in pain,\u201d \u201cconfused\u201d and \u201csignificantly frustrated,\u201d rather than a rogue and potentially-violent Marine, that his lawyers argued was depicted in the charge sheets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge described alleged leaks to the press and the command\u2019s pretrial confinement order as raising the \u201cspecter of unlawful command influence.\u201d It was not officially argued or determined in court, however, whether senior Marine Corps leaders were responsible for the media obtaining these documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The previous day, <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/10\/14\/marine-who-took-to-social-media-to-demand-accountability-pleads-guilty-to-all-charges\/\">Scheller had pleaded guilty<\/a> to all charges against him as part of a plea agreement with the Corps, concluding a saga that began when he took to social media Aug. 26 to demand accountability from senior leaders for their perceived failures in Afghanistan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He continued to make social media posts and videos against the wishes \u2014 and later orders \u2014 of his chain of command, ultimately finding himself locked in the brig.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scheller was convicted of violating Article 88 (contempt toward officials), Article 89 (disrespect toward superior commissioned officers), Article 90 (willfully disobeying a superior commissioned officer), Article 92 (dereliction in the performance of duties), Article 92 (failure to obey an order or regulation) and 27 specifications of Article 133 (conduct unbecoming an officer and a gentleman).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hines directed a forfeiture of $5,000 pay for one month, noting the mitigating circumstances. He would have taken two months of pay, but the judge awarded Scheller credit for his nine days in the brig.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The forfeiture of the pay was the only aspect the judge had power over, due to the pretrial agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors had requested that Scheller forfeit $5,000 of pay a month for six months, in addition to a letter of reprimand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scheller will also resign his commission under the agreement and receive an honorable discharge or general under honorable conditions as part of the agreement, so long as Navy Secretary Carlos del Toro signs off on the character of the discharge, prosecutors said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tim Parlatore, Scheller\u2019s attorney, said that the judge\u2019s decision sends a message to senior leaders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhen senior leaders [or] certain people decide to take certain actions like leaking medical records, like putting somebody in pretrial confinement [when there is] no risk of flight, there should be consequences,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Marine Corps confirmed the letter of reprimand and forfeiture of pay. Training and Education Command Spokesman Capt. Sam Stephenson declined to comment on the outcome of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The money is unlikely to be an issue for Scheller despite him losing his retirement benefits through the resignation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He has raised more than $2.5 million through controversial <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/06\/01\/retired-seal-chief-eddie-gallagher-sues-navy-secretary-and-new-york-times\/\">former Navy SEAL Eddie Gallagher<\/a>\u2019s Pipe Hitter Foundation. That money, according to the foundation\u2019s website, is to be used not only for his legal defense, but also emergency relief funds, relocation expenses and transition out of the military, possible loss of military benefits and retirement, and family support for his wife and three children.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><b>\u2018Contemptuous words\u2019<\/b><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The judge, who said he had not seen Scheller\u2019s viral videos before the trial, did not completely absolve the Marine of culpability for his actions, though.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hines singled out Scheller\u2019s violation of Article 88 for contempt of Defense Secretary Lloyd Austin in his Aug. 26 video.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 88 \u2014 which criminalizes \u201ccontemptuous words\u201d against certain civilian leaders \u2014 is extremely \u201cserious\u201d and \u201ccorrosive,\u201d Hines said, and can \u201cdegrade public trust\u201d in the military and its civilian authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scheller\u2019s historic conviction appears to be only the second known court-martial for Article 88 since the Uniform Code of Military Justice was adopted in 1950, based on a review of legal literature by Marine Corps Times. Most officers who toed the line of Article 88 receive corrective action other than punitive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the Vietnam War, an <a href=\"https:\/\/cite.case.law\/cma\/17\/165\/6635917\/\" target=\"_blank\">Army lieutenant was convicted<\/a> of violating Article 88 after carrying a sign calling then-President Lyndon B. Johnson a fascist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Marine also deserves blame for the saga playing out in the public sphere, resulting in a media circus that doesn\u2019t occur for \u201c99 percent\u201d of other courts-martial, the judge said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the Corps\u2019 proposed punishment for Scheller\u2019s transgressions, for which everyone in the courtroom agreed he should be held accountable, paled in comparison to the mitigating factors, Hines explained.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a trial where post-sentencing time in the brig was not even an option, the command\u2019s decision to lock Scheller up while awaiting trial was \u201ca very rare thing,\u201d Hines said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He also revealed that the Marine signed his plea agreement while in the brig.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hines blasted apparent leaks of documents that included Scheller\u2019s medical records, as attorney Parlatore claimed at trial, as \u201cvery disturbing,\u201d \u201cunfair\u201d and \u201cillegal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scheller didn\u2019t comment as he left the courtroom, but Parlatore was pleased, as were his co-counsel, Brian Ferguson and Jeremiah Sullivan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI think that the judge\u2019s decision was very fair \u2014 he definitely considered all of the facts,\u201d Parlatore told gathered reporters after Hines pronounced the sentence. \u201cI think that this is a good adjustment [to the prosecution\u2019s recommended sentence], and so we\u2019re very pleased with the result here.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Scheller walks in.
