Mark Bashaw\u2019s arraignment is \u201cpending\u201d on three specifications of \u201cfailure to obey lawful orders,\u201d said Becca Nappi, a spokesperson for the installation. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although other troops <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/07\/19\/gomors-galore-punishments-issued-for-unvaccinated-troops-caught-unmasked-at-ft-knox\/\" target=\"_blank\">have faced discipline<\/a> for failing to follow COVID-19 protocols, Bashaw is the first case in the Army referred to a court-martial for such incidents, Army spokeswoman Col. Cathy Wilkinson confirmed in a statement to Army Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bashaw is the <a href=\"https:\/\/www.dvidshub.net\/image\/6745132\/change-command-ceremony-1st-lt-alexander-mccarthy\" target=\"_blank\">former headquarters company commander<\/a> for the Army Public Health Center, which oversees occupational and environmental health initiatives for the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He\u2019s charged with refusing an order to telework and showing up to Aberdeen Proving Ground \u201cafter failing to submit a negative COVID-19 test or [submit]\u201d to a test, Nappi said. The <a href=\"https:\/\/home.army.mil\/apg\/index.php\/my-fort\/all-services\/apg-public-health-information\" target=\"_blank\">installation requires<\/a> that unvaccinated personnel submit a negative test result before entering their worksites, according to its website.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2022\/02\/02\/army-begins-discharges-for-covid-vaccine-refusing-soldiers\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/1000w_q75-4-6.jpg-6.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Army begins discharges for COVID vaccine-refusing soldiers<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The order also applies to cadets, Guard and Reserve troops who are on Title 10 active duty tours of more than 30 days.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Bashaw also is charged with allegedly refusing to leave and \u201cwrongfully remaining at his place of duty\u201d after his failure to get tested, according to Nappi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The officer is also charged with refusing to wear a mask while indoors, Nappi added. All Aberdeen Proving Ground troops are required to wear masks indoors regardless of their vaccination status.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Army Times could not immediately locate Bashaw\u2019s attorney.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The spokesperson stressed that Bashaw is \u201cpresumed innocent until proven guilty\u201d and clarified that he isn\u2019t facing court-martial \u201cfor refusing the order to receive the COVID-19 vaccine but&#8230;[rather for violating] COVID-19 infection mitigation measures designed to protect the force.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Troops who refuse the vaccine will soon face <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/02\/02\/army-begins-discharges-for-covid-vaccine-refusing-soldiers\/\" target=\"_blank\">other repercussions<\/a>, though.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Army announced Wednesday that it is beginning involuntary discharge procedures for the approximately 3,500 active duty troops who have declined the vaccine. Another 3,600 currently have pending requests for medical or religious exemptions for the shot.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>1st Lt.
