{"id":16013,"date":"2021-04-13T23:48:22","date_gmt":"2021-04-13T23:48:22","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2021\/04\/13\/no-release-for-former-army-captain-guilty-in-fatal-vision-murders\/"},"modified":"2026-08-08T01:49:38","modified_gmt":"2026-08-08T01:49:38","slug":"no-release-for-former-army-captain-guilty-in-fatal-vision-murders","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2021\/04\/13\/no-release-for-former-army-captain-guilty-in-fatal-vision-murders\/","title":{"rendered":"No release for former Army captain guilty in \u2018Fatal Vision\u2019 murders"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">RALEIGH, N.C. \u2014 A federal judge on Friday refused to release an ex-Army captain imprisoned for decades for the murders of his wife and two young daughters, deciding he lacked authority to consider Jeffrey MacDonald\u2019s request. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. District Judge Terrence Boyle issued the denial four weeks after MacDonald\u2019s attorneys came to court  to <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/03\/11\/former-army-officer-guilty-in-fatal-vision-case-seeks-release\/\" target=_blank>ask the judge to let him go home<\/a> because of his deteriorating health.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MacDonald was convicted in 1979 for the 1970 slayings of his pregnant wife, Colette; 5-year-old daughter Kimberley; and 2-year-old daughter Kristen at their family home at North Carolina\u2019s Fort Bragg. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MacDonald has declared his innocence and spent years on appeals in the \u201cFatal Vision\u201d case, named for a book about the investigation. <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2018\/12\/21\/fatal-vision-doctor-denied-new-trial-in-family-triple-murder\/\" target=_blank>A federal appeals court refused<\/a> in December 2018 to grant MacDonald a new trial, ruling new evidence did not warrant one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now age 77 and serving his sentences at a Maryland prison, MacDonald has chronic kidney disease, skin cancer and high blood pressure. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His lawyers said in the hearing that resentencing was warranted because his life was near its end, especially should he need regular dialysis treatments, and because he had been a model prisoner. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Boyle sided with U.S. government attorneys, who argued federal law prevented Boyle from adjusting the prison time because MacDonald\u2019s crimes occurred years before new laws allowed judges to step in. MacDonald can seek parole, but he waived that opportunity twice in 2020, according to the U.S. attorney\u2019s office in Raleigh. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Boyle wrote in the ruling Friday that \u201cthis Court\u2019s authority to consider a request for compassionate release filed by a defendant &#8230; does not extend to old-law defendants like MacDonald who were sentenced for crimes committed prior to\u201d the 1987 cutoff date put in place by current sentencing laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Attorneys for MacDonald said in a statement that the ruling hinged on a technical issue that they hope Congress will consider changing. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe understand the Court\u2019s ruling that, due to the technical legislative history of the compassionate release statute, courts lack authority to grant compassionate release requests from \u2018Old Law\u2019 defendants like MacDonald,\u201d the statement emailed by lawyer Elliot S. Abrams said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors at the 1979 trial said MacDonald, a physician, used a knife and an ice pick to kill his wife and children at their house before stabbing himself with a scalpel. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MacDonald maintains he was wrongly convicted, pointing to \u201cdrug-crazed hippies\u201d as the killers. But prosecutors said he donned surgical gloves and used his wife\u2019s blood to write the word \u201cPIG\u201d over their bed to imitate the Charles Manson murders that occurred the previous year. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MacDonald\u2019s second wife, Kathryn, lives in Maryland and would take care of him should he be released, according to his attorneys. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MacDonald\u2019s legal brief cited the threat of COVID-19 to his already fragile health as a reason that he should be released. MacDonald tested positive for the coronavirus in January through a rapid test. U.S. attorneys contend MacDonald\u2019s recent refusal to take a COVID-19 vaccination means he can\u2019t rely on the potential risks of the illness to justify his release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A federal grand jury indicted MacDonald in 1975.
