Orange decision delay draws criticism"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Veteran advocates and Democratic lawmakers are ramping up pressure on the Donald Trump administration to decide whether to add new illnesses to the list of diseases presumed linked to herbicide exposure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More than 40 senators, including Senate Majority Leader Chuck Schumer of New York, and seven veterans\u2019 and military groups sent letters to President Donald Trump this week imploring him to designate four diseases as related to Agent Orange and other defoliants used during the Vietnam War.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The senators said the administration\u2019s delay in announcing a decision on how to designate the four ailments \u2014 bladder cancer, hypothyroidism, Parkinson\u2019s-like symptoms and hypertension \u2014 \u201ccontinues to deny 190,000 sick and aging veterans the health care and compensation they have earned and desperately need.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMore than 50 years after their service and sacrifice, these veterans continue to suffer the detrimental effects of their exposure each day,\u201d <a href=\"https:\/\/www.veterans.senate.gov\/imo\/media\/doc\/2020-02-12%20Letter%20to%20President%20Trump%20re%20AO%20Presumptives%20w%20Congress%20Report%20FINAL.pdf\" target=_blank>lawmakers wrote in a letter to Trump Wednesday<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Monday, veterans groups, including Disabled American Veterans, Veterans of Foreign Wars, the Military Officers Association of America, Paralyzed Veterans of America, AMVETS and the Fleet Reserve Association wrote the president to protest a Department of Veterans Affairs decision to delay the announcement on the health conditions until two VA studies are complete and ready for publication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA Secretary Robert Wilkie told <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2020\/01\/28\/va-disputes-science-panels-findings-on-proposed-agent-orange-diseases-decision-not-expected-until-late-2020\/\" target=_blank>Congress Jan. 28 that VA experts found \u201csignificant concerns and limitations\u201d with two National Academies of Sciences, Engineering and Medicine reports<\/a> that concluded there is suggestive or sufficient evidence to link the four conditions to Agent Orange exposure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Wilkie, the National Academies\u2019 scientific panels producing the reports did not identify any \u201cdefinitive causal links\u201d between Agent Orange and the diseases, and at least two \u2014 hypertension and bladder cancer \u2014 have other risk factors besides herbicide exposure, like age, diet and tobacco use, that can contribute to their development.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/2019\/10\/23\/white-house-responsible-for-delayed-decision-on-new-agent-orange-diseases-documents-show\/\" decision on new Agent Orange diseases, documents show<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Internal documents reveal the disagreements within the Trump administration over adding new Agent Orange-connected diseases.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The veterans organizations say VA is applying a higher standard for qualification than those that were applied to diseases already on the list.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe misleading statements made by VA in its recent report to Congress cannot overcome the strength of the assembled scientific data and the statutory framework for adding presumptive diseases associated with Agent Orange exposure,\u201d the groups wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In reports published in 2016 and 2018, <a href=\"https:\/\/www.militarytimes.com\/news\/2018\/11\/19\/new-research-could-lead-to-disability-benefits-for-vietnam-veterans-with-high-blood-pressure\/\" target=_blank>National Academies researchers said evidence suggests that bladder cancer, Parkinsonism and hypothyroidism are associated with exposure<\/a> to defoliants and sufficient evidence exists to demonstrate a link between hypertension and Agent Orange.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But because several of these illnesses are also linked to age and lifestyle, VA has decided to wait until the results of the Vietnam Era Health Retrospective Observational Study, or VE-HEROES, and the Vietnam Era Mortality Study are complete and analyzed. That is expected later this year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe soonest the secretary would be able to consider adding any new presumptive conditions is in late 2020,\u201d Wilkie told Congress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to VA, the cost of providing health care and benefits to affected Vietnam vets or their survivors could run between $11.2 billion and $15.2 billion, depending on interpretations of a court ruling relevant to the issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA already is treating some Vietnam-era veterans for the listed conditions, including 1,404 for Parkinsonism, 5,836 for bladder cancer, 15,657 for hypothyroidism and 308,329 for hypertension.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But according to VA data, the decision to add the conditions could add nearly 191,000 veterans to the disability benefits rolls in the first year and as many as 2.1 million veterans or survivors over five years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Agent Orange Act of 1991 required the VA secretary to grant presumptions for diseases prevalent among Vietnam veterans if scientific evidence showed an association between herbicide spraying and an illness. The statute did not require there to be definitive proof that the defoliants caused the diseases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the law expired in 2015. Now, the VA secretary has the authority to make presumption decisions under a separate law but he no longer has to adhere to certain standards, including following NASEM recommendations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the law expired, then-Veterans Affairs Secretary Robert McDonald sought an extension as well as funding from Congress to cover the cost of adding the new diseases to the presumptions list. At the time, veterans advocates voiced concern that without the law, future secretaries would have no deadline for making a decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s been three years since former VA Secretary David Shulkin said he made a decision on the proposal but never announced it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to documents obtained by Military Times last year, White House advisers and the Office of Management and Budget cited the law\u2019s expiration as well as concerns about the cost and the evidence, to ask VA to provide additional scientific proof supporting any connection.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/pentagon-congress\/2019\/06\/05\/90000-blue-water-vietnam-veterans-in-line-for-disability-benefits-after-justice-officials-drop-appeal\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"201\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP_6509120108-1.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">90,000 \u2018blue water\u2019 Vietnam veterans in line for disability benefits after Justice officials drop appeal<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The move all but ends a years long legal fight over presumptive benefits for up to 90,000 Vietnam veterans.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The veterans\u2019 organizations argue cost should not be a decision-breaker.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhen taking all of this into consideration, it appears VA is not waiting on additional science, but continuing to stonewall and delay adding these four diseases based in part on monetary concerns. This is troubling,\u201d they said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The arguments against adding the conditions are the same as those used by VA leadership to thwart extension of Agent Orange benefits to ill service members who served on U.S. Navy and Coast Guard ships stationed off the coast during the war.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wilkie told lawmakers VA planned to wait for results of the pending studies, which at the time he said were expected to be released in 2019, before deciding whether to accept claims from these \u201cblue water\u201d Navy Vietnam veterans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A court decision and subsequent legislation passed last year paved the way for those service members to begin filing Agent Orange related claims in January.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In their letter, Schumer, Sen. Jon Tester, D-Mont., and 41 other Democrats said it is time for the administration to stop \u201cstonewalling\u201d these benefits for veterans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is well past time for your Administration to acknowledge the considerable effects service has on one\u2019s health and accept that Agent Orange exposure is most certainly a cost of war,\u201d they
