{"id":27307,"date":"2020-09-11T23:14:15","date_gmt":"2020-09-11T23:14:15","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2020\/09\/11\/navy-veteran-for-2-decades-va-never-told-him-he-had-hiv\/"},"modified":"2026-08-08T19:17:27","modified_gmt":"2026-08-08T19:17:27","slug":"navy-veteran-for-2-decades-va-never-told-him-he-had-hiv","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/news\/2020\/09\/11\/navy-veteran-for-2-decades-va-never-told-him-he-had-hiv\/","title":{"rendered":"Navy veteran: For 2 decades, VA never told him he had HIV"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A U.S. Navy veteran says that, for more than two decades, he had no idea he was living with the virus that causes AIDS because <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2020\/01\/23\/va-looks-to-improve-care-planning-for-hiv-patients\/\" target=_blank>government health care workers<\/a> never informed him of his positive test result in the mid-1990s.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a federal lawsuit filed this week, the South Carolina man says he ended up with \u201cfull-blown AIDS\u201d because he <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2020\/01\/14\/appeals-court-supports-airmen-fighting-their-discharges-for-hiv\/\" target=_blank>never received treatment<\/a> after being kept in the dark.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe treatment he\u2019s getting now is effective, but he\u2019s had essentially 25 years of wear and tear for having no treatment,\u201d said his lawyer, Chad McGowan. Conditions related to his unknown HIV status included an infection of his brain tissue, McGowan said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe feels extremely guilty about the girlfriends he\u2019s had over the last 25 years because he didn\u2019t know,\u201d McGowan said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The HIV test was done in November 1995 as part of standard lab testing at a U.S. Department of Veterans Affairs medical center in Columbia, South Carolina, the lawsuit states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The VA \u201cdoes not typically comment on pending litigation,\u201d said agency spokeswoman Marlous Black in an email.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The veteran, identified in the lawsuit as John Doe to protect his privacy, was hurt in a 1976 ship wreck while serving in the Navy, the lawsuit states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy veteran said was aboard the destroyer Bordelon when it collided with the aircraft carrier John F. Kennedy during an underway replenishment Sept. 14, 1976, in the North Sea off the coast of Scotland, according to his lawyer. The destroyer was badly damaged and six crewmembers were injured. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">McGowan said the ordeal led to his client developing post-traumatic stress disorder. He was classified as disabled due to his physical and mental injuries, and began being treated by the Veterans Affairs Department.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A doctor at the VA\u2019s Columbia medical center ordered the lab work that included the HIV test in November 1995. Guidelines require that patients be informed of any positive test result, and that treatments begin. \u201cIn clear <a href=\"https:\/\/www.militarytimes.com\/veterans\/2016\/06\/27\/veteran-therapy-wrongly-denied-because-she-is-hiv-positive\/\" target=_blank>contravention of the standard of care<\/a>, Mr. Doe was not informed of the positive HIV test until decades later,\u201d the lawsuit states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2014, a nurse practitioner at the Columbia facility wrote a memo noting the 1995 lab tests, according to medical records included in the complaint. But the information still wasn\u2019t conveyed to the veteran, the complaint states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2015, the veteran saw another doctor through the VA who wrote in a medical record that he came across the 1995 lab results showing the positive HIV test. The doctor asked him who his infectious disease doctor was, and the veteran said he didn\u2019t have one. That doctor also asked the veteran if he knew he was HIV positive, and he responded that he was never told about any positive test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That doctor \u201cdoes not diagnose Mr. Doe with HIV, nor does he even add the positive HIV test to Mr. Doe\u2019s problem list or medical history in his medical chart to flag the positive HIV test for subsequent providers,\u201d the complaint states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It wasn\u2019t until September 2018 when the veteran had an emergency visit to a non-VA hospital \u2014 Maimonides Medical Center in New York City \u2014 that he received a definitive diagnosis and began treatment for HIV\/AIDS. At that point, he responded well to antiretroviral therapy, but \u201cthe virus had already progressed to full-blown AIDS,\u201d the complaint states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He \u201cneedlessly suffered for decades with co-existing conditions common in HIV infected persons, including lymphadenopathy, neurotoxoplasmosis, muscle aches and joint pain,\u201d the complaint states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHad Defendants acted within the standard of care, Mr. Doe would not have suffered the losses he has suffered, and will continue to suffer in the future, and more likely than not, he would not have developed AIDS.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some people who are HIV-positive can live for years without developing symptoms, but others develop symptoms much more quickly, experts say.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSome people progress really fast and some don\u2019t progress at all,\u201d said Dr. Carlos del Rio, director of the Center for AIDS Research at Emory University in Atlanta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.militarytimes.com\/veterans\/2018\/01\/03\/va-firings-spiked-after-trump-signed-the-new-accountability-law-last-year\/\" target=_blank>negligence alleged<\/a> in this lawsuit appears to be highly unusual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI can\u2019t think of any specific situation where someone\u2019s test result was delayed in that way,\u201d said lawyer Scott Schoettes, the HIV project director at Lambda Legal, which is involved in HIV-related court cases around the nation. Schoettes is not involved in the South Carolina case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">McGowan said he\u2019s advocated for other VA patients who weren\u2019t informed in a timely manner after biopsies found evidence of disease, \u201cbut nothing where there\u2019s a 25-year delay.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn my experience working with patients like Mr. Doe, the VA has so many providers that come and go, that they try to have some continuity of care, but stuff falls through the cracks all time,\u201d he said. \u201cCommunication issues, I believe.
