{"id":27601,"date":"2019-04-24T23:02:31","date_gmt":"2019-04-24T23:02:31","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2019\/04\/24\/prosecutors-ncis-investigator-accused-of-misconduct-in-war-crimes-case\/"},"modified":"2026-08-08T19:26:04","modified_gmt":"2026-08-08T19:26:04","slug":"prosecutors-ncis-investigator-accused-of-misconduct-in-war-crimes-case","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2019\/04\/24\/prosecutors-ncis-investigator-accused-of-misconduct-in-war-crimes-case\/","title":{"rendered":"Prosecutors, NCIS investigator accused of \u2018misconduct\u2019 in war crimes case"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A motion filed Tuesday in California threatens to derail the entire war crimes case against Special Warfare Operator Chief Edward \u201cEddie\u201d Gallagher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Drafted by Gallagher\u2019s civilian defense attorney <a href=\"https:\/\/parlatorelawgroup.com\/\" target=_blank>Timothy Parlatore<\/a>, it paints a portrait of \u201cstonewalling\u201d prosecutors refusing to turn over evidence that could clear the embattled chief and a federal cop who allegedly went rogue by cherry-picking witness statements to salvage a rickety case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRather than conduct a proper investigation in search of the truth, (the agent) began with a pre-determined conclusion and went about finding evidence to support that conclusion, while ignoring or suppressing anything that conflicted with that narrative,\u201d Parlatore wrote in his filing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher, 39, is accused of stabbing to death an unarmed and seriously wounded Islamic State prisoner of war during a 2017 deployment to Iraq, plus shooting an old man and a young girl in a violent spree that prosecutors contend might have claimed hundreds of lives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although the motion accuses prosecutors of withholding evidence benefiting Gallagher \u2014 records independently uncovered by Navy Times \u2014 the motion expends much of its ink on the <a href=\"https:\/\/www.ncis.navy.mil\/Pages\/default.aspx\" target=_blank>Naval Criminal Investigative Service<\/a>, an agency Parlatore accuses of botching the entire probe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the lead investigator on the case, NCIS Special Agent Joe Warpinski, is in Parlatore\u2019s legal cross hairs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Warpinski is accused of working \u201cto ensure that witness interviews were documented in a manner that would minimize anything that did not support his pre-determined conclusions,&#8221; according to the motion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mid-2018 interviews with alleged witnesses against Gallagher were videotaped by NCIS agents and turned over to defense attorneys months ago. But no one apparently recorded a round of re-interview sessions in January of 2019.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, NCIS reports about what the witnesses allegedly said appear to have been reconstructed from Warpinski\u2019s notes, which no one on the defense team has seen, according to Parlatore\u2019s motion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore\u2019s motion accuses Warpinski of acting like a gatekeeper of exculpatory evidence, excluding witness statements that hurt the case against Gallagher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To Parlatore, it\u2019s all part of a pattern of conduct he believes calls into question every non-videotaped interrogation NCIS has conducted in the probe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A list of questions about those bombshell allegations sent to NCIS officials by Navy Times went, for the most part, unanswered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After citing the NCIS policy of never commenting on ongoing investigations, however, spokesman Adam Stump said all agents \u201care expected to uphold the highest standards of professional conduct when conducting investigations.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy Times sent a similar request for comment about Parlatore\u2019s motion to the Office of the Judge Advocate General of the Navy, which oversees the service\u2019s prosecutors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a written statement emailed to Navy Times, OJAG spokeswoman Patty Babb said her department\u2019s \u201cpolicy is to not comment on the specifics of ongoing litigation that may prejudice the due administration of military justice.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/04\/22\/what-motivated-fellow-seals-to-dime-out-eddie-gallagher\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"164\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Gallagher-Iraq-3.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">What motivated fellow SEALs to dime out Eddie Gallagher?<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The fog of war swirls through the reams of internal files provided to Navy Times.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Theoretically, Navy Times shouldn\u2019t even have Parlatore\u2019s motion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a Friday hearing at Naval Base San Diego, <a href=\"https:\/\/www.stripes.com\/news\/navy-clears-appellate-judge-accused-of-lying-while-prosecutor-1.448384\">Capt. Aaron Rugh<\/a> \u2014 the military judge hearing the Gallagher case \u2014 issued a<a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/04\/20\/prosecutors-celebrate-victory-after-ruling-in-gallagher-war-crimes-case\/\" target=\"_blank\"> blanket gag order<\/a> on all filings in the matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Rugh\u2019s ruling not only sped up the stream of secret records and internal military messages flowing to Navy Times, it indirectly triggered Parlatore\u2019s filing to dismiss the entire case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It all began last week, when the Navy Times began trying to make sense of a string of email messages exchanged in early April between military prosecutors and Brian Ferguson.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ferguson is an attorney and Air Force reservist who represents a group of SEAL eyewitnesses who have expressed reluctance in participating in the NCIS investigation and Gallagher\u2019s court-martial trial, which is slated to begin on May 28.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the email messages uncovered by Navy Times, a SEAL sniper was forced to conduct a second round of interviews with Warpinski and prosecutors on Jan. 10.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his message about the interrogation, Ferguson raised red flags about how prosecutors and Warpinski later ended up describing the petty officer\u2019s statements to Gallagher\u2019s defense attorneys.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Ferguson\u2019s message, the sniper said he never saw Gallagher shoot an elderly Iraqi man on Father\u2019s Day in 2017, and couldn\u2019t remember other details tied to the alleged war crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The petty officer also indicated that his memories about meetings regarding an alleged command cover up of the war crimes were \u201cfoggy\u201d and \u201cnot very clear\u201d and \u201ca blur,&#8221; especially discussions about the purported murder of the Islamic State fighter, which he insisted he didn\u2019t witness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That was interesting to Navy Times because a Jan. 15 write up of the re-interview session by Warpinski stated that the SEAL sniper \u201cknew that\u201d Gallagher had shot him by process of elimination \u2014 the elderly victim was in the chief\u2019s \u201cfield of fire and nobody else in their tower could have taken that shot.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When Navy Times tried to talk to Ferguson about the leaked emails and the SEAL sniper\u2019s recollection of events, he gave a firm \u201cno comment.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ferguson also refused to talk about a warning typed at the top of that and other messages that referenced <a href=\"https:\/\/www.oyez.org\/cases\/1971\/70-117\" target=_blank>Kastigar v. United States.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s a landmark 1972 U.S. Supreme Court ruling that found the government can use immunity deals to compel a witness to testify, a powerful tool by federal prosecutors to hurdle the Fifth Amendment right to avoid self-incriminating testimony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors previously had tried \u2014 and failed \u2014 to prod Rugh to remove Ferguson as the SEAL sniper\u2019s attorney, arguing that he was using him and more than a dozen other holdout witnesses to secure broad immunity deals for the entire group, an allegation the Texas attorney strongly denied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a Kastigar assertion also indicated that Ferguson was trying to protect his client from prosecutors in case they tried to use evidence against him derived from a re-interrogation meeting or, potentially, a proffer session.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In proffer sessions, potential witnesses discuss their knowledge about a crime with prosecutors with the assurance that their words won\u2019t be used against them. The rules dictating the meetings often are guided by \u201cqueen for a day\u201d letters hashed out between prosecutors and defense attorneys ahead of the sessions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy Times already had <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/02\/10\/legal-bombshells-explode-on-two-seal-war-crimes-cases\/\" target=_blank>a stack of similar documents<\/a> but a proffer request from Ferguson on behalf of his client wasn\u2019t in it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If one existed, however, it would have to be supplied to the defense team, so Navy Times contacted Parlatore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore not only didn\u2019t know anything about a proffer session, he didn\u2019t realize that Ferguson had raised pointed questions about how NCIS and the prosecution described testimony by that SEAL sniper and other witnesses in reports shipped to the defense team.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore hung up. But according to another string of emails provided to Navy Times, he apparently got off the phone to immediately contact Gallagher\u2019s prosecutors \u2014 Cmdr. Christopher Czaplak and Lt. Brian John from the Navy, and Marine Capt. Conor McMahon.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That sparked another series of email messages from McMahon and Czaplak that didn\u2019t seem to answer Parlatore\u2019s questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So the defense attorney reached out to Ferguson, who supplied the emails to him, according to the motion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Monday, Czaplak finally sent the same evidence to Parlatore, too.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/02\/10\/legal-bombshells-explode-on-two-seal-war-crimes-cases\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"193\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/EddieIraq.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">New legal bombshells explode on two Navy SEAL war crimes cases<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Two SEALs offer up damaging testimony against a chief special warfare operator accused of war crimes &#8212; and suggest the command did not initially investigate the sprawling allegations of misconduct, new legal documents show.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">According to his motion, Parlatore found the messages \u201cilluminating\u201d because they allegedly helped to prove that \u201cstonewalling\u201d prosecutors had made it a habit of turning over \u201csanitized reports\u201d typed by Warpinski.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And according to Parlatore\u2019s motion, that wasn\u2019t the only problem with Warpinski\u2019s handling of the investigation, which he described as \u201cextraordinarily poor and deeply flawed.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore\u2019s motion accused Warpinski of fudging the timeline of the shooting, with Ferguson\u2019s client saying the man might have been shot up to 20 minutes before he saw his body.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of an old man, the alleged victim might\u2019ve been as young as 31 years of age \u2014 but more likely in his 40s \u2014 and in the field of fire of other snipers, the motion revealed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And although another SEAL sniper claimed Ferguson\u2019s client told him that Gallagher fired the shot that struck a girl walking along the Tigris River in July of 2017, other evidence seemed to indicate that he never said that at all, and it remains a mystery how the other sniper came to believe the chief gunned her down.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Based on the new evidence, Parlatore\u2019s motion called the two attempted murder charges tied to the old man and the girl \u201cabsolutely unsustainable\u201d and urged that they be immediately dismissed or, at least, broken off from the main murder trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reached in Manhattan on Wednesday, Parlatore told Navy Times that Rugh\u2019s gag order prevented him from specifically discussing his allegations, but he urged NCIS and the Pentagon to begin probing the investigators and the prosecution team.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis investigator is unusually incompetent in this case. Someone should look into his credentials,&#8221; Parlatore said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf they really had good evidence against Gallagher they wouldn\u2019t need to engage in this kind of gamesmanship. There\u2019s no place for this in the criminal justice system, especially when they\u2019re trying to put an innocent man in prison for the rest of his life.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rugh has yet to issue a ruling on Parlatore\u2019s motion.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The SEAL is accused of stabbing to death an unarmed and
