How did Trump react?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Trump has been charged with seven counts related to the mishandling of classified documents, according to two people familiar with the indictment but not authorized to speak publicly about it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump\u2019s lawyer James Trusty said Thursday on CNN that the indictment includes charges of willful retention of national defense information, obstruction of justice, false statements and conspiracy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump, on his Truth Social app, called it \u201ca DARK DAY for the United States of America.\u201d In a video post, he said, \u201cI\u2019m innocent and we will prove that very, very soundly and hopefully very quickly.\u201d Within 20 minutes of breaking the news, his 2024 presidential campaign sent out a fundraising missive telling his followers he\u2019d been indicted and asking for financial support.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What happens next for Trump?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Justice Department did not immediately publicly confirm the indictment, and any charges were not publicly filed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump said he\u2019d been summoned to appear in court Tuesday afternoon in Miami. It wasn\u2019t immediately clear if Trump planned to make the appearance and what the procedure would look like.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When he was charged by the Manhattan district attorney in the New York case, Trump surrendered to authorities, where he was booked behind closed doors and appeared in the courtroom, sitting with his lawyers at the defense table.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How did the Trump case come about?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Officials with the National Archives and Records Administration reached out to representatives for Trump in spring 2021 when they realized that important material from his time in office was missing from their collection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Presidential Records Act, White House documents are considered property of the U.S. government and must be preserved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Trump representative told the National Archives in December 2021 that presidential records had been found at Mar-a-Lago. In January 2022, the National Archives <a href=\"https:\/\/apnews.com\/article\/donald-trump-mar-a-lago-criminal-investigations-government-and-politics-4ee554f467252929f96c70d42a93a05d\">retrieved 15 boxes<\/a> of documents from Trump\u2019s Florida home, later telling Justice Department officials that they contained \u201ca lot\u201d of classified material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That May, the FBI and Justice Department issued a subpoena for remaining classified documents in Trump\u2019s possession. Investigators who went to visit the property weeks later to collect the records were given roughly three dozen documents and a sworn statement from Trump\u2019s lawyers attesting that the requested information had been returned.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/leadership\/2023\/03\/31\/among-160-years-of-presidential-scandals-trump-stands-alone\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"202\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP23089804404498.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Among 160 years of presidential scandals, Trump stands alone<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Richard Nixon resigned in disgrace over his role in the infamous Watergate break-in.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">But that assertion turned out to be false. With a search warrant, federal officials returned to Mar-a-Lago in August 2022 and seized more than <a href=\"https:\/\/apnews.com\/article\/donald-trump-mar-a-lago-government-and-politics-6bd103a8e418166b17a34d77e8d9102d\">33 boxes and containers<\/a> totaling 11,000 documents from a storage room and an office, including 100 classified documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In all, roughly 300 documents with classification markings \u2014 including some at the top-secret level \u2014 have been recovered from Trump since he left office in January 2021.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How did a special counsel get involved?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Last year, U.S. Attorney General Merrick Garland picked Jack Smith, a veteran war crimes prosecutor with a background in public corruption probes, to lead investigations into the presence of <a href=\"https:\/\/apnews.com\/article\/new-york-donald-trump-mar-a-lago-classified-information-8dd6297eaebc358ffc15c153dc1b000e\">classified documents<\/a> at Trump\u2019s Florida estate, as well as key aspects of a separate probe involving the Jan. 6, 2021, insurrection and efforts to undo the 2020 election.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Smith\u2019s appointment was a recognition by Garland of the politics involved in an investigation into a former president and current White House candidate. Garland himself was selected by Democratic President Joe Biden, whom Trump is seeking to challenge for the White House in 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Special counsels are appointed in cases in which the Justice Department perceives itself as having a conflict or where it\u2019s deemed to be in the public interest to have someone outside the government come in and take responsibility for a matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Code of Federal Regulations, a special counsel must have \u201ca reputation for integrity and impartial decisionmaking,\u201d as well as \u201can informed understanding of the criminal law and Department of Justice policies.\u201d<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Didn\u2019t Biden and Pence have classified documents too?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Yes, but the circumstances of their cases are vastly different from the situation involving Trump.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After classified documents were found at Biden\u2019s think tank and Pence\u2019s Indiana home, their lawyers notified authorities and quickly arranged for them to be handed over. They also authorized other searches by federal authorities to search for additional documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no indication either was aware of the existence of the records before they were found, and no evidence has so far emerged that Biden or Pence sought to conceal the discoveries. That\u2019s important because the Justice Department historically looks for willfulness in deciding whether to bring criminal charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/apnews.com\/article\/who-is-robert-hur-special-counsel-biden-d715ffd26adc75f2ba740d1960936a09\">A special counsel<\/a> was appointed earlier this year to probe how <a href=\"https:\/\/apnews.com\/article\/biden-politics-united-states-government-812ef44a5333f6d93423a67a683fa024\">classified materials<\/a> ended up at Biden\u2019s <a href=\"https:\/\/apnews.com\/article\/classified-documents-biden-home-wilmington-33479d12c7cf0a822adb2f44c32b88fd?utm_source=homepage&#038;utm_medium=TopNews&#038;utm_campaign=position_01\">Delaware home<\/a> and former office. But even if the Justice Department were to find Biden\u2019s case prosecutable on the evidence, its Office of Legal Counsel has concluded that a president is immune from prosecution during his time in office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As for Pence, the Justice Department informed his legal team earlier this month that it would not be pursuing criminal charges against him over his handling of the documents.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Does indictment stop Trump from running for president?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No. Neither the indictment itself nor a conviction would prevent Trump from running for or winning the presidency in 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And as the New York case showed, criminal charges have historically been a boon to his fundraising. The campaign announced that it had raised over $4 million in the 24 hours after that indictment became public, far smashing its previous record after the FBI search of Trump\u2019s Mar-a-Lago club.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are Republicans saying about Trump indictment?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Many of Trump\u2019s challengers for the GOP nomination jumped to his defense Thursday night after news of the indictment broke.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Florida Gov. Ron DeSantis, Trump\u2019s top rival for the 2024 nomination, accused the Justice Department of political bias in charging the former president.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe weaponization of federal law enforcement represents a mortal threat to a free society,\u201d DeSantis tweeted. \u201cWe have for years witnessed an uneven application of the law depending upon political affiliation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He questioned why the Justice Department had been \u201cso zealous\u201d in bringing charges against Trump and \u201cso passive\u201d about going after former Democratic presidential nominee Hillary Clinton or Biden\u2019s son Hunter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sen. Tim Scott of South Carolina said he felt the justice system\u2019s \u201cscales are weighted\u201d based on politics. \u201cIn America, every single person is presumed innocent, not guilty,\u201d Scott said on Fox News, decrying \u201cthe weaponization of the Department of Justice against the former president.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Biotech entrepreneur and \u201canti-woke\u201d activist Vivek Ramaswamy said the federal case was part of \u201can affront to every citizen.\u201d Reiterating his comments that he would pardon Trump, Ramaswamy called it \u201chypocritical for the DOJ to selectively prosecute Trump but not\u201d Biden over his own classified documents case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Former Arkansas Gov. Asa Hutchinson, who called for Trump to drop out of the race after the New York charges were filed, said the federal indictment marked \u201ca sad day for our country\u201d and \u201creaffirms the need for Donald Trump to respect the office and end his campaign.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Former Vice President Mike Pence said earlier Thursday that if Trump were to be indicted, he would hope the Justice Department had strong evidence \u2014 a shift in tone from the night before, when he said he hoped Trump wouldn\u2019t be charged even if evidence is clear he
