{"id":41150,"date":"2021-09-15T17:40:28","date_gmt":"2021-09-15T17:40:28","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2021\/09\/15\/new-army-office-to-take-sexual-assault-cases-from-commanders\/"},"modified":"2026-08-08T03:24:40","modified_gmt":"2026-08-08T03:24:40","slug":"new-army-office-to-take-sexual-assault-cases-from-commanders","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2021\/09\/15\/new-army-office-to-take-sexual-assault-cases-from-commanders\/","title":{"rendered":"New Army office to take sexual assault cases from commanders"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Army Secretary Christine Wormuth announced the service\u2019s plan to establish an independent office for handling sex crimes in public comments last week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wormuth\u2019s remarks were part of a Sept. 7 discussion hosted at the Air Force Academy in Colorado Springs, Colorado.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s not clear from Wormuth\u2019s comments when the office will stand up, or how exactly it will be structured. But one thing is clear from <a href=\"https:\/\/www.army.mil\/article\/250044\/army_to_create_independent_entity_to_oversee_sexual_assault_cases\" target=\"_blank\">an Army release<\/a>: the new organization will take sexual assault and harassment prosecutions from commanders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wormuth committed to setting up the office and other initiatives \u201cswiftly and fully,\u201d according to prepared remarks shared by her office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s critical that we respond effectively and sensitively when sexual harassment or assault does happen,\u201d Wormuth said, according to the release. \u201cIt\u2019s our responsibility to make sure our leaders have the resources they need to take care of our Soldiers and their families when something happens.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The move comes after Defense Secretary Lloyd Austin directed the armed services to remove sexual assault charging decisions from the chain of command. Austin <a href=\"https:\/\/www.defense.gov\/Newsroom\/Releases\/Release\/Article\/2681145\/independent-review-commission-recommendations-on-countering-sexual-assault-in-t\/\" target=\"_blank\">directed the change in July<\/a> after accepting the recommendations of the Independent Review Commission on Sexual Assault in the Military.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In comments made to <a href=\"https:\/\/www.cbsnews.com\/news\/militarys-domestic-violence-crisis-investigation-norah-odonnell-cbs-news\/\" target=\"_blank\">CBS News<\/a> last week, Austin reiterated his support for ongoing Congressional efforts to codify the removal, such as the effort of Sen. Kristen Gillibrand, D-N.Y., who has been working to <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2021\/07\/22\/dod-would-see-a-big-budget-boost-military-justice-overhaul-under-senate-proposal\/\" target=\"_blank\">reform the military justice system<\/a> for years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are working closely with Congress on legislative proposals to remove decisions about whether to prosecute sexual assaults and related crimes-including domestic violence-from the military chain of command,\u201d Austin said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Army Times has previously reported cases where <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/04\/12\/army-didnt-prosecute-nco-accused-of-rape-so-he-did-it-again-and-again\/\" target=\"_blank\">commanders failed to prosecute sexual assault cases<\/a> where the perpetrator went on to commit multiple additional assaults. Taking charging decisions out of the chain of command would reduce such incidents, reform advocates have argued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Army\u2019s handling of such cases also came under scrutiny after the Fort Hood Independent Review Committee found that the service\u2019s existing program for preventing and combating sexual harassment and assault \u2014 SHARP \u2014 is \u201cstructurally flawed.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The committee also found defects in the structure and practices of the Army\u2019s Criminal Investigation Division, which has led the service to<a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/08\/11\/first-civilian-cid-director-appointed-by-army\/\" target=\"_blank\"> implement sweeping CID
