{"id":41333,"date":"2018-03-22T20:54:22","date_gmt":"2018-03-22T20:54:22","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2018\/03\/22\/navy-wife-alleges-malpractice-after-doctors-find-broken-needle-from-2003-in-her-spine\/"},"modified":"2026-08-08T03:24:49","modified_gmt":"2026-08-08T03:24:49","slug":"navy-wife-alleges-malpractice-after-doctors-find-broken-needle-from-2003-in-her-spine","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/management\/pay-benefits\/military-benefits\/health-care-benefits\/2018\/03\/22\/navy-wife-alleges-malpractice-after-doctors-find-broken-needle-from-2003-in-her-spine\/","title":{"rendered":"Navy wife alleges malpractice after doctors find broken needle \u2015 from 2003 \u2015 in her spine"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The wife of a retired Navy chief hospital corpsman has filed a claim against the government alleging her severe, constant pain is caused by a needle that has been lodged in her spine since it broke off during anesthesia at <a href=\"https:\/\/www.militarytimes.com\/news\/your-navy\/2017\/09\/19\/navy-removes-workers-who-called-babies-mini-satans\/\" title=\"\" class=\"\" target=\"_blank\">Naval Hospital Jacksonville<\/a>, Florida, 14 years ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She wasn\u2019t told about the needle when it happened, she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After 14 years of misdiagnoses for her pain, Amy Bright found out in November 2017 as a result of a CT scan at San Antonio\u2019s <a href=\"https:\/\/www.militarytimes.com\/news\/your-army\/2017\/04\/30\/shortage-of-properly-sterilized-instruments-leads-brooke-army-medical-center-to-curtail-surgeries\/\" title=\"\" class=\"\" target=\"_blank\">Brooke Army Medical Center<\/a> that she has a 3-centimeter needle sticking out of her spine, three-fourths of the way through a bone, and causing permanent nerve damage. She has had chronic left-sided sciatica, hip and lower back pain for nearly a decade and a half.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And because the needle has been there for so long, doctors have told her, it\u2019s too risky to remove it, Bright said during a Thursday news conference in Jacksonville.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The spinal anesthesia was administered to Bright before a planned Cesarean section when her youngest son, Jacob, was born at the Navy hospital on Sept. 5, 2003. At the time of the alleged incident, Bright was 27 and her husband, Charles, was stationed at Naval Air Station Jacksonville. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bright\u2019s claim accuses the hospital staff of failing to provide proper anesthesia care and treatment and failing to properly insert a spinal anesthesia needle, resulting in breaking off the needle in her spine; failing to inform Bright what had happened; and failing to remove the needle.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"679\" height=\"251\" src=\"\/wp-content\/uploads\/2026\/08\/spine01.jpg.jpg\" alt=\"\" class=\"wp-image-78688\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/spine01.jpg.jpg 679w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/spine01.jpg.jpg?resize=300,111 300w\" sizes=\"auto, (max-width: 679px) 100vw, 679px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis represents a cowardly, unethical cover-up by personnel at Naval Hospital Jacksonville,\u201d said Bright\u2019s attorney, Sean Cronin, of Jacksonville.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy officials referred questions to the Justice Department because the matter is in litigation; Justice officials declined to comment. A response to the allegations was not immediately available from officials at Naval Hospital Jacksonville.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2015\/07\/26\/lawsuit-procedure-left-retired-sailor-in-coma-at-naval-hospital\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"237\" height=\"300\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/635732626559297483-tns-shon-hollisjpg.jpg?w=237\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Lawsuit: Procedure left retired sailor in coma at naval hospital<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Retired Navy EMC Shon Hollis entered Naval Hospital Jacksonville a year ago for a colonoscopy and endoscopy. He&#039;s now in a vegetative state.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">During the procedure, a needle is normally placed halfway into the spinal canal, where the numbing medication is injected. In Bright\u2019s case, however, \u201cthe medical provider jammed the needle \u2026 across the spinal canal and into her spine,\u201d Cronin said. He said personnel would have known the needle had broken because it\u2019s marked on the end, and anesthesia providers look at the tip when they pull out the needle to make sure it\u2019s there. The needles are 9 centimeters long, and a third of it broke off, Cronin said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey\u2019re supposed to tell her, record it in the medical records, and have [the needle] surgically removed. They chose to look the other way and left her in this condition,\u201d Cronin said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When Bright awoke from the anesthesia, she had pain in her left leg.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bright, now 41, said she was devastated when she found out in November that there was broken-off needle in her back that had caused her the pain for 14 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI was super livid,\u201d she said. \u201cI was so mad that they hid this from me and covered it up for all these years &#8230; and said, \u2018You just have a bad back.\u2019\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She said doesn\u2019t know why a scan wasn\u2019t ordered earlier. The family has lived in several places since her husband retired from the Navy in 2005, and has settled in San Antonio.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"617\" height=\"282\" src=\"\/wp-content\/uploads\/2026\/08\/spine04.jpg.jpg\" alt=\"\" class=\"wp-image-78690\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/spine04.jpg.jpg 617w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/spine04.jpg.jpg?resize=300,137 300w\" sizes=\"auto, (max-width: 617px) 100vw, 617px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">\u201dFor years they were saying, here, take this Motrin, have this back patch,\u201d she said. \u201cAnd every year it gets worse and worse, the burning.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bright said her constant leg pain makes it difficult to sleep and sit. Trying to watch her 14-year-old son\u2019s football game from the bleachers \u201cis terrible,\u201d she said: \u201cIt burns my whole bottom of my back. My sciatica is on fire. &#8230; On occasion it shoots down the side of my leg and down into my foot.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therapy twice a week hasn\u2019t helped relieve the pain, she said, and her thrice-daily medication slows her down. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m speechless that this was not disclosed to this woman. This is complete gross malpractice, and frankly, a crime,\u201d Cronin said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The claim alleges medical malpractice, fraud and negligent concealment. The government will have six months to respond; if a settlement isn\u2019t reached, Cronin will file suit against the federal government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Families, including those of active-duty members, can sue the government for negligence under the Federal Torts Claims Act. Bright\u2019s claim was submitted to the Tort Claims Unit in Norfolk, Virginia. Active-duty members <a href=\"https:\/\/www.militarytimes.com\/pay-benefits\/military-benefits\/health-care\/2016\/07\/10\/tragedy-and-injustice-the-heartbreaking-truth-about-military-medical-malpractice\/\" title=\"\" class=\"selected-link\" target=\"_blank\">can\u2019t sue the government<\/a> for personal injuries caused by the negligence of military members because of what\u2019s known as the Feres doctrine, the result of a 1950 Supreme Court decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the last 14 years, Bright has been misdiagnosed and told she has an underlying back condition, that it was \u201cin her head,\u201d Cronin said. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cShe\u2019s been sentenced to a lifetime of pain and worry, and now she finds out she doesn\u2019t have a bad back, that this was a medical mistake \u2026 and she\u2019s left to deal with it,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe cowards that did this didn\u2019t tell her, and allowed this to continue. &#8230; The entire situation is just completely outrageous, and unacceptable that this would happen her.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bright said she never thought that her back pain could have been caused by something that happened at the Navy hospital.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is not one of the situations where you go, \u2018Oh, maybe they left a needle in my back,\u2019\u201d Cronin said. \u201cThis so outside the pale of normal malpractice. I do this all the time. &#8230; I\u2019ve never seen a piece of needle that\u2019s broken off and left in someone\u2019s spine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s outrageous.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Doctors at an Army hospital in 2017 found a broken-off needle in Amy Bright&#8217;s spine.
