Mark Milley<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The order raises the possibility of fines or possible jail time for the former commander-in-chief if he continues to use political rallies to attack potential witnesses in the upcoming federal trial. That list includes <a href=\"https:\/\/www.militarytimes.com\/news\/2022\/08\/08\/milley-almost-quit-over-trump-wrote-biting-resignation-letter-new-book-reveals\/\" target=\"_blank\">Milley<\/a>, a frequent target of Trump over the last few years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/apnews.com\/article\/trump-capitol-riot-gag-order-judge-chutkan-b5f59c6688504c952df5f70029228f9e\" target=\"_blank\">The Associated Press<\/a> reported that U.S. District Judge Tanya Chutkan did not specify exactly what repercussions any single action might incur, but said the move was necessary to preserve the integrity of the criminal proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019re not talking about censorship here,\u201d she said during court deliberations on Monday. \u201cWe\u2019re talking about restrictions to ensure there is a fair administration of justice in this case.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2023\/09\/28\/milley-says-hell-ensure-family-safety-after-trumps-execution-remark\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP23262331330324.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Milley says he\u2019ll ensure family safety after Trump\u2019s execution remark<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Gen. Mark Milley said he&#039;ll take steps to protect himself and his family after comments by former President Donald Trump.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The move came after special counsel Jack Smith\u2019s team raised concerns about Trump disparaging prosecutors, Chutkan, the court system and prospective witnesses in the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump\u2019s defense team told the Associated Press that the gag order amounted to a \u201cdesperate effort at censorship\u201d against the leading Republican Party candidate for president in 2024. Trump himself took to social media ahead of the hearing to call Smith \u201cderanged\u201d and Chutkan \u201chighly partisan.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump is charged with spreading \u201cpervasive and destabilizing lies about election fraud\u201d following his loss in the 2020 election. The case is separate from other criminal charges he faces in Georgia, New York and Florida.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During campaign rallies, Trump has attacked the cases against him as politically motivated and baseless. He has also sharply criticized numerous former members of his own administration, calling them liars and frauds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of Milley \u2014 Trump\u2019s own choice to serve as Joint Chiefs Chairman \u2014 the former president on Sept. 22 posted on social media that the Army general may have committed treason by talking to Chinese military officials about the election process in the wake of Trump\u2019s election defeat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is an act so egregious that, in times gone by, the punishment would have been DEATH! A war between China and the United States could have been the result of this treasonous act,\u201d Trump wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Milley has maintained the communication was designed to calm overseas fears about a chaotic transition of power in America. He also said in the weeks following the tweet that he was forced to <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2023\/09\/28\/milley-says-hell-ensure-family-safety-after-trumps-execution-remark\/\" target=\"_blank\">employ new personal security<\/a> to ensure the safety of his family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his departure speech from the chairman post on Sept. 30, Milley referenced Trump by reminding assembled troops that \u201cwe don\u2019t take an oath to a wannabe dictator\u201d and to continue to defend America\u2019s democratic institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The social media post about Milley played a focal role in Monday\u2019s deliberations, as did similar disparaging public comments made by Trump against Georgia Secretary of State Brad Raffensperger, former Attorney General William Barr, and former Vice President Mike Pence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The limits of the new gag order will be tested soon.
