Huntington Ingalls chief executive Mike Petters said in a message to his 44,000 employees this week the contractor\u2019s major business segments are exempt because the government customer says the mandate was not a condition of its shipbuilding contracts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cImportantly, with respect to Ingalls Shipbuilding and Newport News Shipbuilding, our customer has confirmed that our contracts do not include a requirement to implement the mandate,\u201d Petters said in the Nov. 16 memo, adding the exemption applies only in part to its technology-focused business segment. \u201cIn light of this development, we are hereby suspending the deadline for vaccination, except where specific Technical Solutions contracts require it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company said workers who opted to submit for retirement or to resign as a result of the federal mandate can now request reversal.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2021\/10\/19\/covid-vaccine-mandate-endangers-military-readiness-top-republican-lawmaker-claims\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"212\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1212095530.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">COVID vaccine mandate endangers military readiness, top Republican lawmaker claims<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Senate Armed Services ranking member Jim Inhofe is demanding the military immediately drop the requirement to ensure troops aren&#039;t booted from the ranks because of vaccine concerns.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Since the Biden administration has announced sweeping vaccination mandates for government contractors, large employers and military and defense civilians, it\u2019s hit a wave of resistance, particularly in southern states. This week, the Occupational Safety and Health Administration said it would suspend enforcement of the vaccine mandate for large private businesses after a federal appeals court upheld a stay on it last week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the vaccine mandate\u2019s deadline being softened and <a href=\"https:\/\/www.defensenews.com\/management\/2021\/11\/04\/white-house-extends-vaccine-deadline-for-contractors\/\" target=\"_blank\">delayed<\/a> from Dec. 8 to Jan. 18, <a href=\"https:\/\/www.defensenews.com\/opinion\/commentary\/2021\/11\/19\/vaccine-mandate-is-last-straw-for-us-shipyards-already-facing-labor-shortages\/\" target=\"_blank\">shipbuilders in particular have felt the effects<\/a> because of their specialized construction process and preexisting labor shortages. In October, the largest union at Bath Iron Works reported the mandate might force out a third of its membership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">About 20% of workers have resisted the vaccine mandate at HII, which makes naval destroyers and amphibious ships in Pascagoula, Miss., and the Virginia-class nuclear submarine in Newport News, Va. It\u2019s a situation that could potentially have sparked cost overruns for multibillion programs and delays to carefully calibrated schedules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s a huge disruptor to the yards because you have to move people around and figure out what the priorities are,\u201d said HII spokesman Daniel Hernandez. \u201cIt messes with the schedules, and if you\u2019re late, it starts to cost money. The Navy has no idea how many of its civilian employees got the full dosage.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">When Biden issued the mandate for large employers and contractors in September, the company first urged employees to get vaccinated and later said vaccination would be a condition of their employment. When Petters informed workers he is suspending the mandate, he left open the possibility the situation could change again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are monitoring the fluid situation closely with our shipyard customers, and if the mandate becomes a contractual requirement, we will proceed accordingly,\u201d Petters said, adding the company continues to encourage all employees to get vaccinated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HII\u2019s apparent exemption raises questions about whether other defense contractors have similar arrangements. But the situation might only last until the shipbuilder gets a new contract, or one of its contracts is amended and the clause is included, according to Dan Kelly, a government contracts lawyer with the National Defense Industrial Association\u2019s New England chapter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHII may have worked out with its contracting officer(s) on existing contracts an agreement where the [contracting officer] did not exercise discretion to modify the contracts to include the clause,\u201d Kelly said in an email. \u201cIt is hard to believe that this \u2018suspension\u2019 can last very long.
