(AP) \u2014 The prosecutor considering criminal charges in a traffic stop where two officers allegedly mistreated a <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/04\/10\/army-lieutenant-sues-police-for-pepper-spraying-threatening-him-during-stop\/\" target=\"_blank\">Black Army lieutenant<\/a> said he has received the results of the Virginia State Police\u2019s investigation into the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Daily Press&nbsp;<a href=\"https:\/\/www.dailypress.com\/news\/crime\/dp-nw-prosecutor-windsor-20210528-srf2boeq7jbiheyvxdzl3vtgxe-story.html\" target=\"_blank\">reports<\/a>&nbsp;that Hampton Commonwealth\u2019s Attorney Anton Bell says he got the file from police in a large binder a couple weeks ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Body camera footage that went viral last month captured two Windsor police officers, Joe Gutierrez and Daniel Crocker, pointing guns at<a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/04\/12\/town-fires-police-officer-involved-in-traffic-stop-of-black-army-lieutenant\/\" target=\"_blank\"> Army Lt. Caron Nazario<\/a> as they ordered him out of his SUV during the Dec. 5 traffic stop in Isle of Wight County.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nazario is suing the department over the December traffic stop in which he was pepper-sprayed, struck and handcuffed. Caron Nazario in rural Virginia was a grim reminder to many Black Americans that even being in military uniform doesn&#039;t necessarily protect them from mistreatment by police.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Bell, who was appointed special prosecutor after Isle of Wight\u2019s top prosecutor recused herself, said his decision on charges against the officers and whether their actions were justified would come from comparing Virginia law with the facts of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI make my decisions based on the facts and the law,\u201d Bell said Friday. \u201cThat\u2019s it. I don\u2019t care about public opinion &#8230; My focus will be on what the officers can do and cannot do \u2014 what is legal and what is not legal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Several prosecutors from his office are involved in the review, he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gutierrez was fired in April, but Crocker is still on the force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aside from the State Police criminal investigation into the officers, Virginia Attorney General Mark Herring has launched a civil rights \u201cpattern and practice\u201d probe into the Windsor Police Department.
