Electricity and phone connections are largely down, and homes and shops are facing food and water shortages.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Without phone connections, medics didn\u2019t know where to take the wounded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <a href=\"https:\/\/apnews.com\/article\/russia-ukraine-kyiv-coronavirus-pandemic-business-sports-cbd6eed3e1b8f4946f5f490afd06b4be\">just seven days of fighting<\/a>, more than 2% of Ukraine\u2019s population has been forced out of the country, according to the tally the U.N. refugee agency released to The Associated Press. The mass evacuation could be seen in Kharkiv, a city of about 1.4 million people and Ukraine\u2019s second-largest. Residents desperate to escape falling shells and bombs crowded the city\u2019s train station and pressed onto trains, not always knowing where they were headed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At least 227 civilians have been killed and another 525 wounded in that time, according to the latest figures from the office of the U.N. High Commissioner for Human Rights. It acknowledges that is a vast undercount, and Ukraine earlier said more than 2,000 civilians have died. That figure could not be independently verified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the toll of war mounted, a second round of talks between Ukrainian and Russian delegations was expected later Thursday in neighboring Belarus \u2014 though the two sides appeared to have little common ground.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are ready to conduct talks, but we will continue the operation because we won\u2019t allow Ukraine to preserve a military infrastructure that threatens Russia,\u201d Russian Foreign Minister Sergey Lavrov said, repeating an accusation Moscow has repeatedly used to justify its invasion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lavrov said that the West has continuously armed Ukraine, trained its troops and built up bases there to turn Ukraine into a bulwark against Russia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The U.S. and its allies have insisted that NATO is a defensive alliance that doesn\u2019t pose a threat to Russia. And the West fears Russia\u2019s invasion is meant to overthrow Ukraine\u2019s government and install a friendly government \u2014 though Lavrov said Moscow would let the Ukrainians choose what government they should have.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Russian President Vladimir Putin earlier raised the specter of nuclear war, putting his country\u2019s nuclear forces on high alert, but his foreign minister shrugged off questions of whether Russia could escalate the conflict with nuclear weapons, saying such talk comes from the West.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Kherson, the Russians took over the regional administration headquarters, Hennady Lahuta, the governor of the region, said Thursday \u2014 while adding that he and other officials were continuing to perform their duties and provide assistance to the population.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kherson\u2019s mayor, Igor Kolykhaev, previously said that the national flag was still flying, but that there were no Ukrainian troops in the city. Britain\u2019s defense secretary said it was possible the Russians had taken over, though not yet verified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mayor said the city would maintain a strict curfew and require pedestrians to walk in groups no larger than two, obey commands to stop and not to \u201cprovoke the troops.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe flag flying over us is Ukrainian,\u201d he wrote on Facebook. \u201cAnd for it to stay that way, these demands must be observed.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier Thursday, Ukrainian President Volodymyr Zelenskyy said that Russian land forces have stalled and Moscow is now unleashing air attacks, but that they are being parried by Ukrainian defense systems, including in Kherson.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cKyiv withstood the night and another missile and bomb attack. Our air defenses worked,\u201d he said. \u201cKherson, Izyum \u2014 all the other cities that the occupiers hit from the air did not give up anything.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kyiv Mayor Vitali Klitschko said explosions heard overnight in the Ukrainian capital were Russian missiles being shot down by air defense systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From Kherson, Russian troops appeared to roll toward Mykolaiv, another major Black Sea port and shipbuilding center to the west along the coast. The prosecutor for the International Criminal Court opened an <a href=\"https:\/\/apnews.com\/article\/russia-ukraine-genocides-crime-war-crimes-europe-499d7b6a9e955f659284b2edc6f1c508\">investigation<\/a> into possible war crimes. And in a stunning reversal, the International Paralympic Committee <a href=\"https:\/\/apnews.com\/article\/russia-ukraine-sports-europe-beijing-paralympic-games-a711e5f037440e71468901ac35d1de31\">banned Russian and Belarusian athletes<\/a> from the Winter Paralympic Games.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While Moscow wreaked devastation on Ukrainian cities, global sanctions plunged Russia\u2019s economy deeper into crisis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruble, which has tanked since the invasion, lost a further 15% against the dollar while the economy took another hit when two ratings agencies cut Russia\u2019s credit rating, saying the invasion and Western sanctions have hurt Moscow\u2019s ability to repay debts and raised risks for the economy and stability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Russia reported its military casualties Wednesday for the first time in the war, saying nearly 500 of its troops have been killed and almost 1,600 wounded. Ukraine did not disclose its own military losses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ukraine\u2019s military general staff said in a Facebook post that Russia\u2019s forces had suffered some 9,000 casualties in the fighting. It did not clarify if that figure included both killed and wounded soldiers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a video address to the nation early Thursday, Zelenskyy praised his country\u2019s resistance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are a people who in a week have destroyed the plans of the enemy,\u201d he said. \u201cThey will have no peace here. They will have no food. They will have here not one quiet moment.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said the fighting is taking a toll on the morale of Russian soldiers, who \u201cgo into grocery stores and try to find something to eat.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese are not warriors of a superpower,\u201d he said. \u201cThese are confused children who have been used.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, the senior U.S. defense official said an immense Russian column of hundreds of tanks and other vehicles appeared to be stalled roughly 25 kilometers (16 miles) from Kyiv and had made no real progress in the last couple of days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The convoy, which earlier in the week had seemed poised to launch an assault on the capital, has been plagued with fuel and food shortages, the official said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the far edges of Kyiv, volunteers well into their 60s manned a checkpoint to try to block the Russian advance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn my old age, I had to take up arms,\u201d said Andrey Goncharuk, 68. He said the fighters needed more weapons, but \u201cwe\u2019ll kill the enemy and take their weapons.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Around Ukraine, others crowded into train stations, carrying children wrapped in blankets and dragging wheeled suitcases into new lives as refugees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the million-plus refugees who have fled Ukraine in recent days were some <a href=\"https:\/\/apnews.com\/article\/russia-ukraine-kyiv-health-migration-hungary-58f1e1da27ce76f413bef5ebc6bfe0e4\">200 orphans<\/a> with severe physical and mental disabilities who arrived from Kyiv by train in Hungary on Wednesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some of them spent more than an hour in underground shelters during a bombing, said Larissa Leonidovna, the director of the Svyatoshinksy orphanage for boys.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>&#8211; Jim Heintz. (AP Photo\/Peter Dejong, File)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Rights groups on Thursday welcomed the nations\u2019 request for an investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe request for an ICC investigation reflects the growing alarm among countries about the escalating atrocities and human rights crisis that has gripped Ukraine,\u201d said Balkees Jarrah, interim international justice director at Human Rights Watch. \u201cThese governments are making clear that serious crimes will not be tolerated and that the court has an essential role to play in ensuring justice.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court already has conducted a preliminary probe into crimes linked to the violent suppression of pro-European protests in Kyiv in 2013-2014 by a pro-Russia Ukrainian administration and allegations of crimes in the Crimean Peninsula, which Russia annexed in 2014, and eastern Ukraine, where Moscow has backed rebels since 2014. It found \u201ca broad range of conduct constituting war crimes and crimes against humanity within the jurisdiction of the court have been committed\u201d in Ukraine, Khan\u2019s predecessor, Fatou Bensouda, said at the time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those findings also will be included in Khan\u2019s investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Putin and his military top brass could potentially face charges for ordering attacks that breach the laws of war, said Marieke de Hoon, assistant professor of international criminal law at the University of Amsterdam.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe ICC is created to circumvent Putin\u2019s head of state immunity in foreign courts,\u201d De Hoon said. \u201cThe ICC can now continue its investigation, open cases and issue arrest warrants.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But she also noted the ICC can only put a suspect on trial in The Hague if they are arrested. The court doesn\u2019t have a police force to detain suspects and relies on international cooperation to enforce its arrest warrants. Under ICC rules, suspects can\u2019t by tried in their absence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">How armies are allowed to act during military conflicts is governed by what is known as international humanitarian law, the aim of which is to protect civilians and rein in the use of force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThat means that a certain category of people \u2014 so-called combatants, who distinguish themselves from civilians and are engaged in the armed conflict \u2014 can use force but only against military targets and then only when those are necessary, and only with proportional means,\u201d said De Hoon<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To be classed as crimes against humanity, attacks have to be part of what the ICC\u2019s founding treaty, the Rome Statute, calls \u201ca widespread or systematic attack directed against any civilian population.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The use of munitions such as cluster bombs also likely will, if confirmed, qualify as war crimes because of their indiscriminate nature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s impossible with those types of weapons to distinguish between military targets and civilians,\u201d De Hoon said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While Khan has now opened an investigation, he most likely won\u2019t be able to send investigators into Ukraine to collect evidence and speak to witnesses while war is still raging.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is hard to investigate on the ground now,\u201d De Hoon said. \u201cBut there are a lot of open source investigations possible, using for instance satellite images and social media posts. Other states can also share the evidence they collect with the ICC.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ICC was set up in 2002 to prosecute war crimes, crimes against humanity and genocide. The crime of aggression, which can\u2019t be investigated in Ukraine because neither Russia nor Ukraine is a member of the court, was added later. The ICC is a court of last resort, taking on cases when national authorities are unwilling or unable to prosecute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Over the past 20 years, its prosecutors have filed charges against military and government leaders in several countries, but it hasn\u2019t managed to bring many to justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the first suspects charged by the court was Joseph Kony, a Ugandan warlord who leads the cult-like Lord\u2019s Resistance Army rebel group. An international arrest warrant for Kony was issued in 2005 but he remains at large.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another high profile fugitive is ousted Sudanese leader Omar al-Bashir, who still hasn\u2019t been handed to the ICC despite arrest warrants dating back to 2009 and 2010 for allegedly ordering atrocities in the Darfur region.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As Khan launched the court\u2019s latest investigation, he put combatants and their leaders on notice that he is watching them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWith an active investigation now underway, I repeat my call to all those engaged in hostilities in Ukraine to adhere strictly to the applicable rules of international humanitarian law,\u201d he said. \u201cNo
