{"id":47933,"date":"2022-07-07T20:15:48","date_gmt":"2022-07-07T20:15:48","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2022\/07\/07\/arms-room-theft-conspiracy-ends-in-army-captain-nco-convictions\/"},"modified":"2026-08-08T03:49:22","modified_gmt":"2026-08-08T03:49:22","slug":"arms-room-theft-conspiracy-ends-in-army-captain-nco-convictions","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2022\/07\/07\/arms-room-theft-conspiracy-ends-in-army-captain-nco-convictions\/","title":{"rendered":"Arms room theft conspiracy ends in Army captain, NCO convictions"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A former Patriot battery first sergeant will go to court-martial at <a href=\"https:\/\/www.armytimes.com\/news\/pentagon-congress\/2022\/05\/24\/panel-to-push-for-fort-bragg-to-be-renamed-fort-liberty\/\" target=\"_blank\">Fort Hood<\/a>, Texas, in August as the final defendant in an alleged three-man arms room theft conspiracy. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The battery\u2019s former commander and another senior NCO already pleaded guilty to the conspiracy in May, according to III Corps officials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officials provided charge sheets detailing the alleged conspiracy between three senior members of B Battery, <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/04\/18\/patriot-battalion-csm-faces-court-martial-on-fraternization-charges\/\" target=\"_blank\">4th Battalion, 5th Air Defense Artillery<\/a>, to steal 25 red dot sights known officially as M68 Close Combat Optics. The CCOs were stolen in December 2019, shortly before the unit deployed to Saudi Arabia.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2022\/04\/18\/patriot-battalion-csm-faces-court-martial-on-fraternization-charges\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"214\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/6296613.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Patriot battalion CSM faces court-martial on fraternization charges<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Sgt. Maj. Tomas Barrios goes to trial in June and has pleaded not guilty.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The battery commander, Capt. Robin Morales, pleaded guilty to conspiracy, larceny of government property, and making a false official statement. After the plea deal, Morales was confined for 75 days and dismissed from the Army, in addition to a reprimand and pay forfeitures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Co-conspirator Sgt. 1st Class Jeremiah Pierce also took a plea deal and was convicted of conspiracy to steal military property, as well as larceny of government property. The 17-year veteran received seven days in jail and a bad-conduct discharge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Master Sgt. Rusty Groat, who was the battery\u2019s first sergeant, will go to trial in August, according to court records. He has entered a not guilty plea. Groat is accused of conspiracy, theft, two specifications of obstructing justice, and making a false official statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement accompanying the charge sheet, III Corps officials cautioned that \u201ccharges are merely accusations and that the accused is presumed innocent unless proven guilty in accordance with the law.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">None of the three soldiers immediately responded to comment requests sent via social media, and Groat\u2019s docket entry did not list an attorney.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How the alleged conspiracy unfolded<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">According to the charge sheets, the three leaders allegedly decided to steal the CCOs in December 2019.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A soldier familiar with the events told Army Times that the three conspirators believed the optics had \u201cfallen off the books\u201d and were no longer being officially tracked. But the CCOs hadn\u2019t fallen off the books \u2014 and investigators came looking for them a few months later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Morales, Pierce and Groat distributed the optics to junior members of the unit and kept some for themselves, the charge sheets said. <\/p>\n\n\n\n\n\n<p class=\"wp-block-paragraph\">In February 2020, while deployed, Pierce allegedly told a specialist to lie about what had happened to the sights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A few months later, in May 2020, a colonel was investigating the equipment discrepancies, which led the alleged conspirators to try and cover their tracks, the charge sheets alleged.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Morales reportedly told Groat to delete all of his text messages about the CCOs and instructed Pierce to lie. The two NCOs then told their subordinates to delete their messages about the optics, as well, the charge sheet alleged, with Pierce assuring one sergeant that he should \u201c\u2018not say anything if anyone asked him about the CCOs because the command team would \u2018take care of him.\u2019\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the charges, the alleged conspirators took steps to make sure everyone was on the same page \u2014 they would tell investigators that the sights had turned up in the unit\u2019s communications closet, and they didn\u2019t know where any missing ones were.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The battery commander, Morales, told this version of the story to the colonel on May 27, according to a false official statement charge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pierce reportedly relayed the story he was planning to use to another NCO, telling him that he wanted to \u201cbe on the same page\u201d in case he was interviewed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s not clear from the documents how, why or when the cover story failed, but the battalion\u2019s monthly <a href=\"https:\/\/www.facebook.com\/45ADA\/photos\/pcb.10157946845948692\/10157946842003692\" target=\"_blank\">deployment newsletter<\/a> marked the arrival of a new battery commander in June 2020 \u2014 shortly after the alleged conspirators came under investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By fall 2021, at least, the Army\u2019s Criminal Investigation Division was looking into the reported theft.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Groat is charged with lying to a CID agent during an Oct. 21, 2021, interrogation when he said, \u201cI didn\u2019t want anything to do with this&#8230;I got pulled into this against my will and knew nothing about it&#8230;I did not know who all had [the CCOs].\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The former first sergeant\u2019s trial is tentatively scheduled for Aug. 8.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A former battery command team and a senior NCO were accused of the theft&#8230;and
