Greg Abbott said Saturday that he is seeking to pardon a U.S. Army sergeant who was convicted of murder in the 2020 fatal shooting of an armed protester during nationwide protests against police violence and racial injustice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Abbott&nbsp;<a href=\"https:\/\/twitter.com\/GregAbbott_TX\/status\/1644778789493243907\" target=\"_blank\">tweeted<\/a>&nbsp;that because the state constitution limits him to a pardon only on a recommendation by the state Board of Pardons and Paroles he is asking the board to recommend a pardon and to expedite his request in order to pardon Sgt. Daniel Perry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI look forward to approving the board\u2019s pardon recommendation as soon as it hits my desk,\u201d Abbott wrote.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">I am working as swiftly as Texas law allows regarding the pardon of Sgt. Perry. <a href=\"https:\/\/t.co\/HydwdzneMU\">pic.twitter.com\/HydwdzneMU<\/a><\/p>&mdash; Greg Abbott (@GregAbbott_TX) <a href=\"https:\/\/x.com\/GregAbbott_TX\/status\/1644778789493243907?ref_src=twsrc%5Etfw\">April 8, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Perry&nbsp;<a href=\"https:\/\/apnews.com\/304fe24ca6fd5f0399e5157a9294744d\" target=\"_blank\">was convicted Friday<\/a>&nbsp;by a Travis County jury of&nbsp;fatally shooting 28-year-old Garrett Foster&nbsp;during a protest in Austin. He faces up to life in prison when sentenced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTexas has one of the strongest \u2018Stand Your Ground\u2019 laws of self-defense that cannot be nullified by a jury or a progressive District Attorney,\u201d Abbott said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A phone call to District Attorney Jos\u00e9 Garza\u2019s office on Saturday was not answered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry\u2019s attorneys argued that the shooting was self-defense as Foster approached Perry\u2019s car with an AK-47 rifle. Prosecutors said Perry could have driven away before firing his revolver and witnesses testified that Foster never raised his rifle at Perry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry, who&nbsp;<a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/07\/01\/texas-soldier-who-shot-protester-indicted-on-murder-charge\/\" target=\"_blank\">was charged in 2021,<\/a>&nbsp;was stationed at Ft. Hood about 70 miles (112 kilometers) north of Austin in July 2020 when he was working for a ride-sharing company and turned onto a street and into a large crowd of demonstrators in downtown Austin.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In video streamed live on Facebook, a car can be heard honking before several shots ring out and protesters begin screaming and scattering.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When Foster was killed, demonstrators in Austin and beyond had been marching in the streets for weeks following the&nbsp;<a href=\"https:\/\/apnews.com\/article\/death-of-george-floyd-minneapolis-police-reform-d109eb0d3094119ddbcb560676467f19\" target=\"_blank\">police killing of George Floyd<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Floyd died May 25, 2020, after a Minneapolis police officer pressed his knee against the Black man\u2019s neck for more than nine minutes. Floyd, who was handcuffed, repeatedly said he couldn\u2019t breathe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Floyd\u2019s killing was recorded on video by a bystander and sparked worldwide protests as part of a broader reckoning over racial injustice.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sgt.
