{"id":49746,"date":"2023-05-10T17:19:38","date_gmt":"2023-05-10T17:19:38","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2023\/05\/10\/army-sergeant-who-killed-blm-protester-in-texas-sentenced-to-25-years\/"},"modified":"2026-08-08T04:13:32","modified_gmt":"2026-08-08T04:13:32","slug":"army-sergeant-who-killed-blm-protester-in-texas-sentenced-to-25-years","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2023\/05\/10\/army-sergeant-who-killed-blm-protester-in-texas-sentenced-to-25-years\/","title":{"rendered":"Army sergeant who killed BLM protester in Texas sentenced to 25 years"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">AUSTIN, Texas (AP) \u2014 A U.S. Army sergeant was sentenced to 25 years in prison Wednesday for <a href=\"https:\/\/apnews.com\/article\/texas-army-sergeant-shooting-protest-george-floyd-304fe24ca6fd5f0399e5157a9294744d\">fatally shooting an armed man<\/a> during a Black Lives Matter protest in Texas, even after the state\u2019s Republican governor said he wanted to pardon the man.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Daniel Perry, 36, was convicted of murder in April for killing 28-year-old Garrett Foster during the downtown Austin protest in July 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAfter three long years we\u2019re finally getting justice for Garrett,\u201d his mother, Sheila Foster, told the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMr. Perry, I pray to God that one day, he will get rid of all this hate that is in your heart,\u201d she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry\u2019s attorney Clinton Broden said in a statement after sentencing that his client would appeal. Greg Abbott has said he would sign a pardon<\/a> once a recommendation from the Texas Board of Pardons and Paroles \u2014 stacked with Abbott appointees \u2014 hits his desk<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The board is reviewing Perry\u2019s case on the governor\u2019s orders, but it is unclear when it will reach a decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">District Judge Clifford Brown delivered a statement during sentencing that didn\u2019t address the potential pardon directly. But he insisted that Perry had a \u201cfair and impartial trial\u201d and that the jury\u2019s decision \u201cdeserves our honor and it deserves to be respected.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The pardon process is a valuable check on the court system, Broden said Wednesday. \u201cThose who claim that Governor Abbott\u2019s expressed intent is based on politics simply choose to ignore the fact that it was only the political machinations of a rogue district attorney which led to Sgt. Perry\u2019s prosecution in the first instance.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry was stationed at Fort Hood, about 70 miles (110 kilometers) north of Austin, when the shooting happened. He had just dropped off a ride-share customer and turned onto a street filled with protesters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry said he was trying to get past the crowd and fired his pistol when Foster pointed a rifle at him. His lawyers asked the judge to consider his more than a decade-long military career and hand down a sentence of no more than 10 years. He has been classified as in \u201ccivilian confinement\u201d and is pending separation from the military, Army spokesman Bryce Dubee said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutor Guillermo Gonzalez had urged Brown to issue a sentence of at least 25 years. The sentencing range for the murder conviction is five years to life in prison.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis man is a loaded gun, ready to go off at any perceived threat,\u201d Gonzalez said. \u201cHe\u2019s going to do it again.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Tuesday, <a href=\"https:\/\/apnews.com\/article\/black-lives-matter-protest-shooting-texas-sentence-04abb51c52d41fa259b2f2ed8ee72f37\">prosecutors submitted into evidence<\/a> dozens of texts and social media posts Perry wrote, shared or liked, including some shockingly racist images. They had been excluded from Perry\u2019s trial, but were publicly released after his conviction and allowed into the sentencing phase by Brown.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry, who is white, was working as a ride-share driver in downtown Austin on July 25, 2020, when he shot and killed Foster, an Air Force veteran. Foster, who was also white, was legally carrying an AK-47 rifle as he participated in the demonstration against police killings and racial injustice, following <a href=\"https:\/\/apnews.com\/article\/george-floyd-profile-66163bbd94239afa16d706bd6479c613\">the killing of George Floyd<\/a>, a Black man, by a white Minneapolis police officer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among Perry\u2019s statements introduced Tuesday, he wrote on Facebook a month before the shooting: \u201cIt is official I am a racist because I do not agree with people acting like animals at the zoo.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Floyd was killed on May 25, 2020. A few days later as protests erupted, Perry sent a text message to an acquaintance: \u201cI might go to Dallas to shoot looters.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry attorney Douglas O\u2019Connell argued that the texts and posts were presented by prosecutors out of context, and that Perry has a right to free speech.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSome of those social media posts are frankly repugnant,\u201d O\u2019Connell said, while classifying others as \u201cdark humor.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Foster was with his girlfriend, Whitney Mitchell, who is Black and uses a wheelchair, when Perry gunned him down.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBlack lives mattered to Garrett,\u201d his mother told the courtroom Wednesday. \u201cThe love of his life was a Black woman.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Army Sgt.
