Angel Gallegos chased migrants into an abandoned home alongside another soldier and a Border Patrol agent while assigned to Texas\u2019 state-run border mission, Operation Lone Star, according to an internal Texas Military Department document previously obtained by Military Times and The Texas Tribune, and a law enforcement <a href=\"https:\/\/www.stripes.com\/branches\/army\/2023-07-06\/texas-border-national-guard-migrant-shooting-10658784.html\" target=\"_blank\">investigation report obtained by Stars &amp; Stripes<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Military Times and The Texas Tribune <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2023\/01\/19\/texas-national-guard-soldier-shoots-migrant-at-border\/\" target=\"_blank\">first reported the shooting<\/a> as part of a broader investigative partnership examining <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/02\/01\/haste-and-planning-failures-doomed-operation-lone-stars-troops-to-suffer\/\" target=\"_blank\">the mission and its struggles<\/a>.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2022\/02\/01\/haste-and-planning-failures-doomed-operation-lone-stars-troops-to-suffer\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Del-Rio-DPS-Surge-MG-TT-32.jpeg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Haste and planning failures doomed Operation Lone Star\u2019s troops to suffer<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Never before has Texas \u2014 or any other state \u2014 involuntarily activated so many troops under state active duty authority for such a long-term mission. Nor has it been done so quickly.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The Texas Rangers, an investigative arm of the state\u2019s Department of Public Safety, led the investigation, which agency spokesperson Ericka Miller confirmed was complete. The agency also plays a major role in the border mission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Miller referred further queries to the Hidalgo County District Attorney\u2019s Office, which Stars &amp; Stripes reported declined to bring charges against Gallegos. The county prosecutors, reached by Military Times, did not provide information on the case before this story\u2019s publication deadline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallegos told investigators he accidentally fired his M17 handgun during a physical struggle with migrant Ricardo Rodriguez Nieto, according to witness statements obtained by Stars &amp; Stripes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the internal document, which was based on initial statements from the soldiers, Rodriguez Nieto tried to flee through a window and fought Gallegos with his fists and elbows when the soldier tried to detain him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Rodriguez Nieto, who was unarmed, told a different story. Rodriguez Nieto claimed he was across the room from Gallegos when the soldier fired, according to Stars &amp; Stripes, and other migrants detained at the scene did not describe an altercation in their statements. Neither the other soldier nor the Border Patrol agent witnessed the shooting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Texas Military Department, which oversees Guard members on the mission, did not respond to questions about military discipline for Gallegos. Although courts-martial are permitted under the Texas Code of Military Justice for troops activated in a state-controlled status, they are rare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an unsigned emailed statement, the agency told Military Times that soldiers \u201cassigned to Operation Lone Star are authorized to use the minimum level of force necessary to control the situation and defend themselves or others.\u201d But the statement did not address whether Gallegos was within those guidelines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallegos is not the only soldier to accidentally fire his weapon while activated for Operation Lone Star, a multibillion-dollar mission intended to curb the number of migrants entering Texas. Spc. <a href=\"https:\/\/tmd.texas.gov\/texas-national-guard-announces-the-death-of-soldier-07FEB\" target=\"_blank\">DaJuan Townes<\/a> was <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/02\/07\/another-texas-soldier-on-border-dies-in-accidental-shooting\/\" target=\"_blank\">killed by a colleague in an accidental shooting<\/a> before a training event on Feb. 7, 2022, at Fort Clark Springs near Brackettville.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>Editor\u2019s note: This story was updated on July 7 at 2:59 p.m. EST with a statement from the Texas Military Department.<\/i><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Spc.
