Greg Abbott issued a full pardon Thursday for a former U.S. Army sergeant convicted of murder for fatally shooting an armed demonstrator in 2020 during <a href=\"https:\/\/apnews.com\/article\/shootings-tx-state-wire-us-news-violence-texas-a00748a564346acd7a483ab0b3855efa\" target=\"_blank\">nationwide protests<\/a> against police violence and racial injustice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Abbott announced the pardon just a few minutes after the Texas Board of Pardons and Paroles announced that it unanimously recommended that Daniel Perry be pardoned and have his firerams rights restored. Perry has been held in state prison on a 25-year sentence since his conviction in 2023 in the killing of Garrett Foster.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2023\/04\/26\/army-to-discharge-sergeant-convicted-of-murdering-air-force-veteran\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"231\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP23097836093346.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Army to discharge sergeant convicted of murdering  Air Force veteran<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Perry said he shot Air Force vet Garrett Foster with his handgun when the veteran raised his rifle toward Perry\u2019s car.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Abbott, a Republican, had previously ordered the board to review Perry\u2019s case and said he would sign a pardon if recommended. Under Texas law, the governor cannot issue a pardon without a recommendation from the board, which the governor appoints.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTexas has one of the strongest \u2018Stand Your Ground\u2019 laws of self-defense that cannot be nullified by a jury or a progressive district attorney,\u201d Abbott said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Travis County District Attorney Jos\u00e9 Garza blasted the pardon as a \u201cmockery of our legal system.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe board and the governor have put their politics over justice,\u201d Garza said. \u201cThey should be ashamed of themselves. Their actions are contrary to the law and demonstrate that there are two classes of people in this state where some lives matter and some lives do not. They have sent a message to Garrett Foster\u2019s family, to his partner, and to our community that his life does not matter. &#8220;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Abbott\u2019s demand for a review of Perry\u2019s case followed pressure from former Fox News star Tucker Carlson, who on national television had urged the governor to intervene after the sergeant was <a href=\"https:\/\/apnews.com\/article\/texas-army-sergeant-shooting-protest-george-floyd-304fe24ca6fd5f0399e5157a9294744d\" target=\"_blank\">convicted<\/a> at trial in April 2023. Perry <a href=\"https:\/\/apnews.com\/article\/black-lives-matter-protest-shooting-texas-sentence-3fff311aa2ebcca5c2dd31a4c9b02c29\" target=\"_blank\">was sentenced<\/a> after prosecutors used his social media history and text messages to portray him as a racist who may commit violence again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors argued Perry could have driven away without opening fire and witnesses testified that they never saw Foster raise his gun. The sergeant\u2019s defense attorneys argued Foster, who is white, did raise the rifle and that Perry had no choice but to shoot. Perry, who is also white, did not take the witness stand and jurors deliberated for two days before finding him guilty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry\u2019s attorneys did not immediately respond to requests for comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The shooting set off fierce debate in 2020, amid the demonstrations sparked by a white Minneapolis police officer\u2019s killing of <a href=\"https:\/\/apnews.com\/article\/death-of-george-floyd-minneapolis-police-reform-d109eb0d3094119ddbcb560676467f19\" target=\"_blank\">George Floyd,<\/a> an unarmed Black man. Perry\u2019s conviction three years later prompted outrage from prominent conservatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before sentencing in the case, Carlson aired a broadcast calling the shooting an act of self-defense and criticizing Abbott for not coming on his show. The next day, Abbott said he believed Perry should not be punished and told Texas\u2019 parole board to <a href=\"https:\/\/apnews.com\/article\/texas-abbott-shooting-protest-army-murder-719c3ecf0d3247324dc077903eaf4a5d\" target=\"_blank\">expedite a review<\/a> of the conviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Abbott appoints the Board of Pardons and Paroles and state law requires that it recommend a pardon before he can act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the verdict but before Perry was sentenced, the court <a href=\"https:\/\/apnews.com\/article\/black-lives-matter-protest-shooting-texas-sentence-04abb51c52d41fa259b2f2ed8ee72f37\" target=\"_blank\">unsealed dozens of pages<\/a> of text messages and social media posts that showed he had hostile views toward Black Lives Matter protests. In a comment on Facebook a month before the shooting, Perry wrote, \u201cIt is official I am a racist because I do not agree with people acting like animals at the zoo.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perry served in the Army for more than a decade. At trial, a forensic psychologist testified that he believed Perry has post-traumatic stress disorder from his deployment to Afghanistan and from being bullied as a child.
