{"id":57911,"date":"2022-06-29T17:53:57","date_gmt":"2022-06-29T17:53:57","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2022\/06\/29\/supreme-court-upholds-state-government-work-protections-for-reservists\/"},"modified":"2026-08-08T09:22:34","modified_gmt":"2026-08-08T09:22:34","slug":"supreme-court-upholds-state-government-work-protections-for-reservists","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/veterans\/2022\/06\/29\/supreme-court-upholds-state-government-work-protections-for-reservists\/","title":{"rendered":"Supreme Court upholds state government work protections for reservists"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Supreme Court on Wednesday allowed <a href=\"https:\/\/apnews.com\/article\/russia-ukraine-stephen-breyer-us-supreme-court-business-europe-56db4a9c7fa09d6789904d77cff07c4b\">a former state trooper to sue Texas over his claim<\/a> that he was forced out of his job when he returned from Army service in Iraq.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The justices ruled for Army veteran Le Roy Torres under a federal law that was enacted in 1994 in the wake of the <a href=\"https:\/\/www.militarytimes.com\/veterans\/2016\/02\/24\/persian-gulf-veterans-still-fighting-for-proper-health-care-25-years-after-war\/\" target=\"_blank\">Persian Gulf War<\/a> to strengthen job protections for returning service members.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By a 5-4 vote, the high court rejected Texas\u2019 claim that it is shielded from such lawsuits. \u201cText, history, and precedent show that the States, in coming together to form a Union, agreed to sacrifice their sovereign immunity for the good of the common defense,\u201d Justice Stephen Breyer wrote for the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Clarence Thomas, joined by three other conservative justices, dissented, arguing that \u201cwhen the States ratified the Constitution, they did not implicitly consent to private damages actions filed in their own courts \u2014 whether authorized by Congress\u2019 war powers or any other Article I power.\u201d Article I refers to the part of the Constitution that spells out Congress\u2019 power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Torres says he suffered lung damage from exposure to <a href=\"https:\/\/www.militarytimes.com\/news\/burn-pits\/\">open burn pits<\/a> on his base in Iraq. He spent a year in Iraq and was discharged as a captain after nearly 19 years in the U.S. Army Reserve.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/2022\/02\/23\/supreme-court-to-decide-if-vets-missing-disability-benefits-deadlines-will-get-back-pay\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP20181465074972.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Supreme Court to decide if vets missing disability benefits deadlines will get back pay<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The court is expected to hear oral arguments on the issue later this year.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Separately, <a href=\"https:\/\/www.militarytimes.com\/news\/burn-pits\/2022\/06\/24\/another-delay-for-major-veterans-toxic-exposure-legislation-but-lawmakers-insist-its-not-a-defeat\/\">Congress is nearing final passage of a sweeping expansion of health care and disability benefits<\/a> for Iraq and Afghanistan veterans who were exposed to the open pits that were set ablaze with jet fuel to dispose of tires, batteries, medical waste and other materials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The state and Torres dispute what happened when he returned to Texas, unable to resume his job as a state trooper because of the damage to his lungs. He eventually resigned and later filed his lawsuit. A state appellate court dismissed it, and the justices stepped in.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Congress first allowed returning service members to sue states to keep their jobs in 1974, recognizing discrimination because of opposition to the Vietnam War.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In March, <a href=\"https:\/\/www.militarytimes.com\/news\/2022\/03\/25\/supreme-court-gives-biden-win-for-now-in-navy-vaccine-case\/\">the court allowed the Navy<\/a> to take account of sailors\u2019 vaccination status in deciding on deployments, narrowing a lower court order. Three justices, Samuel Alito, Neil Gorsuch and Thomas, dissented from the high court\u2019s order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Amy Coney Barrett joined her colleagues in
