{"id":59873,"date":"2022-05-18T18:58:20","date_gmt":"2022-05-18T18:58:20","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2022\/05\/18\/feds-national-guard-members-on-state-duty-can-join-unions\/"},"modified":"2026-08-08T10:00:25","modified_gmt":"2026-08-08T10:00:25","slug":"feds-national-guard-members-on-state-duty-can-join-unions","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2022\/05\/18\/feds-national-guard-members-on-state-duty-can-join-unions\/","title":{"rendered":"Feds: National Guard members on state duty can join unions"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">HARTFORD, Conn. \u2014 The Department of Justice has given the green light to National Guard members on active duty for their states to join labor unions, despite a U.S. law that makes it a felony for military personnel on active federal duty to unionize.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agreement, finalized Tuesday, <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2021\/11\/15\/unions-seek-bargaining-rights-for-national-guard-members\/\" target=\"_blank\">settles a lawsuit filed in federal court in Connecticut<\/a> by labor unions against Attorney General Merrick Garland and the Justice Department, seeking collective bargaining rights for Connecticut National Guard members on state duty ordered by the governor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Already, the case has prompted some National Guard members in Texas <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/01\/25\/guard-troops-can-unionize-on-state-active-duty-doj-says\/\" target=\"_blank\">to unionize<\/a>.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2022\/02\/16\/texas-guardsmen-on-border-start-unionizing-to-combat-difficult-conditions\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Del-Rio-DPS-Surge-MG-TT-32.jpeg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Texas Guardsmen on border start unionizing to combat difficult conditions<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The troops are organizing in response to a slew of problems with the state&#039;s border mission.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">A 1978 federal law makes it a criminal felony for members of the armed forces, including the National Guard, to join or attempt to form a labor organization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the statute only applies to service members when they are on active federal duty ordered by U.S. military officials, according to the Veterans Legal Services Clinic at Yale Law School, which represented the unions in the lawsuit, filed in November.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBefore this case, unions were understandably deterred from organizing state active duty National Guard members due to the potential for criminal penalties,\u201d Rekha Kennedy, a Yale law student working for the clinic, said in statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWith this reassurance from the DOJ, unions nationwide can begin the process of building relationships with Guard members without fear of prosecution,\u201d Kennedy said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/04\/13\/connecticut-army-national-guardsman-arrested-in-texas-in-fraud-case\/\" target=\"_blank\">Connecticut Guard<\/a> members were waiting for the agreement to be finalized before beginning unionizing efforts, but some Texas National Guard members already have moved ahead with their plans, joining the Texas State Employees Union starting in February.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Texas members said they were encouraged <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/01\/25\/guard-troops-can-unionize-on-state-active-duty-doj-says\/\" target=\"_blank\">by a January court filing in the Connecticut case<\/a> where the Justice Department acknowledged the federal ban did not apply to National Guard members on state duty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some Texas National Guard members have <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/02\/24\/troops-slam-operation-lone-star-in-leaked-survey\/\" target=\"_blank\">criticized their working and living conditions<\/a> at the U.S.-Mexico border, where Gov. Nor has it been done so quickly.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019ve been rapidly activated with no notice, often working long shifts on irregular schedules, and living in poor conditions far from our families and homes,\u201d Texas National Guard member Hunter Schuler said in a statement Wednesday in response to the Connecticut lawsuit settlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMeanwhile, our education benefits have been cut, we\u2019re subjected to inconsistent and unclear leave policies, and we lack benefits comparable to those received on federal service such as health insurance,\u201d he said. \u201cDOJ\u2019s position confirms that we are free to organize and fight for changes that every service member deserves.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Justice Department, Connecticut National Guard and Connecticut Gov. Ned Lamont\u2019s office did not immediately respond to messages seeking comment Wednesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMembers of the Connecticut National Guard now have additional reassurances that our rights will be upheld through union advocacy,\u201d Walter Morton, a Connecticut National Guard member, said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Connecticut National Guard has been called to state duty several times in recent years. Members have helped with cleanup efforts after major storms, aided police in response to protests and served during the state\u2019s response to the&nbsp;<a href=\"https:\/\/apnews.com\/hub\/coronavirus-pandemic\">coronavirus<\/a>, including setting up field hospitals and distributing supplies during the early days of the
