Thom Tillis, R-N.C., told the service secretaries and service chiefs during a hearing Thursday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese organizations wave a non-disclosure agreement in front of them and say, if you sign this agreement, there may be a bonus or payment you\u2019ll be entitled to if you don\u2019t bring up what may be <a href=\"https:\/\/www.militarytimes.com\/pay-benefits\/2019\/02\/13\/more-than-half-who-took-survey-are-dissatisfied-with-military-privatized-housing\/\" target=_blank>inadequate housing<\/a>,\u201d Tillis said, during a hearing of the Senate Armed Services Committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI can\u2019t imagine on any level why it would make sense to have a new tenant, these young kids, sign an agreement, not understanding the implications of it,\u201d Tillis said, noting it could well be the first lease that service member has ever signed.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/management\/pay-benefits\/2019\/02\/14\/black-mold-rodents-lead-paint-in-privatized-housing-no-rent-until-its-fixed-military-spouses-say\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Trumbo-Point-Navy-PPV.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Black mold, rodents, lead paint in privatized housing: No rent until it\u2019s fixed, military spouses say<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Termites falling out of light fixtures, families getting sick and other problems are &quot;disgusting,&quot; senator says.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Non-disclosure agreements, or confidentiality agreements, are legal contracts that outline information that will be kept secret.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019ve been a landlord before and it never would have occurred to me to say I want you to sign away your right to say you\u2019re living in inadequate conditions,\u201d Tillis said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.militarytimes.com\/pay-benefits\/2019\/02\/14\/black-mold-rodents-lead-paint-in-privatized-housing-no-rent-until-its-fixed-military-spouses-say\/\" target=\"_blank\">Senators have been exploring issues<\/a> with housing that some military families have faced with black mold, pest infestations, water leaks, and other problems, and their inability to get satisfactory responses from their privatized housing managers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf any of these are enforced, I expect them to be rescinded over the next 30 days,\u201d Tillis said. \u201cAnd over the next 30 days, if they\u2019re not rescinded, I want to know what housing company wants to come before me and tell me why it makes sense. Tell me the business reason why it makes sense. Tell me the reason why it\u2019s for the good of the tenant. Richard Blumenthal, D-Conn.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Tillis said he learned about the agreements from families at Fort Bragg, North Carolina, when he and Army Secretary Mark Esper visited there recently. Esper said that was the first time he\u2019d heard about the agreements, too. \u201cI don\u2019t understand it, I\u2019ve never heard of it before in my life. &#8230; We\u2019ve definitely got to dig into this,\u201d Esper said. \u201cThere\u2019s no reason why people should be signing [nondisclosure agreements].\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officials at Corvias Military Living, which is the property manager at Fort Bragg, couldn\u2019t immediately be reached for comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy Secretary Richard Spencer said he planned to call all of the chief executive officers at the privatized housing companies the afternoon following the hearing. \u201cIf they have any of these documents in their files, they are to be accounted for, and we\u2019re going to talk about them this afternoon.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Air Force Secretary Heather Wilson, who announced her resignation Thursday, said in her visits to bases, \u201cI did not come across anyone who told me about one of those, but we\u2019re going to go back and check.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wilson visited MacDill, Tinker and Shaw Air Force bases in recent weeks to explore residents\u2019 issues with privatized housing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One military spouse said the privatized housing company at MacDill Air Force Base asked her and her husband, an Air Force master sergeant, to sign a different sort of non-disclosure agreement in January \u2013 when they moved out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Traci Lenz and her husband had complained to the company about mold problems in their house, and moved off base after living there for just six months, because of concerns for their children\u2019s health.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Traci Lenz said the company, Harbor Bay, wanted them to sign an agreement that would also release the company from claims \u2013 meaning the Lenzes, their children and heirs \u2013 wouldn\u2019t file lawsuits or initiate any other legal actions. In return, the company would waive the two-month early termination fee of $4,524 because the Lenzes were breaking their lease early.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to a copy of the unsigned agreement provided by Traci Lenz, the agreement would have required the Lenzes to keep the agreement secret, and to \u201crefrain from making or encouraging any negative, adverse, or disparaging statements, comments, or remarks, whether oral or written and including all media, internet, and social media\u201d about the company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agreement specified the payment was not to be considered an admission of liability, and the company denies any liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the Lenzes\u2019 efforts to get their concerns addressed, Harbor Bay management denied there was mold, and stated that it was safe for occupancy. Harbor Bay maintenance had hired a third-party company to inspect the house; the Lenzes also hired a third-party company. The results differed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Lenzes refused to sign the agreement. Traci Lenz said ultimately the company did agree to waive the two-month early termination fee. \u201cThey stated it was \u2018an accommodation\u2019 after we involved media and filed a congressional,\u201d she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ron Hansen, president of Michaels Management Services, the property manager for Harbor Bay, said these non-disclosure agreements are not common, and are triggered only when the tenant involves an attorney or discusses attorney involvement. \u201cIn the past 20 years, I think I\u2019ve been involved in four\u201d related to military privatized housing, he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s a condition of a settlement when legal is involved, he said. \u201cWhere legal is involved, 100 percent there will be a non-disclosure agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn our case, we referred it to Harbor Bay\u2019s attorney, who said if we do have a settlement, we have to have a non-disclosure agreement.\u201d Just as in the Lenzes\u2019 case, he said, no one is required to sign the agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hansen said his company doesn\u2019t use non-disclosure agreements in other situations, and has responded with that information to some CEOs of other housing projects on Navy installations. Those CEOs contacted him in the wake of Navy Secretary Spencer\u2019s comment that he would be calling those CEOs about the agreements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although his company doesn\u2019t operate any Navy projects, he said, those CEOs wanted to ensure Hansen\u2019s projects at other installations don\u2019t use them with their tenants, because some sailors and Marines live in some Michaels Management properties at other services\u2019 installations.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Senator asks why military tenants should sign away their right to say
