{"id":74112,"date":"2022-09-15T22:06:06","date_gmt":"2022-09-15T22:06:06","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2022\/09\/15\/republicans-threaten-lawsuits-budget-penalties-over-va-abortion-move\/"},"modified":"2026-08-08T14:08:40","modified_gmt":"2026-08-08T14:08:40","slug":"republicans-threaten-lawsuits-budget-penalties-over-va-abortion-move","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/veterans\/2022\/09\/15\/republicans-threaten-lawsuits-budget-penalties-over-va-abortion-move\/","title":{"rendered":"Republicans threaten lawsuits, budget penalties over VA abortion move"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Republican lawmakers on Thursday promised a <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/09\/07\/advocates-draw-battle-lines-ahead-of-looming-va-abortion-fight\/\" target=\"_blank\">looming battle <\/a>over Veterans Affairs\u2019 officials <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/\" target=\"_blank\">decision to provide abortions at department medical centers<\/a> even in states where the procedure is outlawed, but agency leaders responded that they are confident they can win that fight.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe feel this is needed care,\u201d <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/07\/21\/after-a-5-year-wait-va-gets-a-new-top-medical-leader\/\" target=\"_blank\">Dr. Shereef Elnahal<\/a>, VA\u2019s Under Secretary for Health, told members of the House Veterans\u2019 Affairs Committee hearing on the topic. \u201cIf these veterans are under our care, and we know we can save their lives, we have to do it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier this month, VA officials announced <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/\" target=\"_blank\">plans to offer abortion access<\/a> for the first time to veterans and eligible dependents in cases of rape, incest and pregnancies that endanger the life or health of an individual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The department will also offer abortion counseling services to all patients, another first for the department.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1242677087.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">VA to provide abortions in cases of rape, danger to veteran\u2019s health<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Abortions could be conducted at VA medical centers, even in states where the procedure is outlawed.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The move came about 10 weeks after the Supreme Court overturned the 1973 Roe vs. Wade ruling which legalized abortion nationwide. Since then, at least 25 states have started to place limits or already imposed restrictions on health care workers from providing abortions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA officials said those limits forced the department to intervene. They have not yet released a detailed timeline of when abortions may start, but Elnahal said an implementation plan is under development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cShould an abortion be needed, VA anticipates that medication abortion will be a common type of care provided and is working to ensure that providers have access to training where needed, as well as needed medications,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cVA will ensure that all necessary staffing and equipment are available at sites. Provider guidance and training, to the extent training is necessary, also are being finalized.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Republican lawmakers said they will work to stop that. They promised both legal challenges and, if they retake control of either chamber of Congress this fall, appropriations punishments for the department.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Committee ranking member Mike Bost, R-Ill., called VA\u2019s decision \u201cillegal\u201d and said he is working with fellow lawmakers on those potential sanctions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAbortion is not health care, no matter what those on the other side of this issue may feel,\u201d he said. \u201cThe right to life is a sacred, American value enshrined in the Declaration of Independence \u2026 and I am committed to defending it now for [veterans] and their unborn children.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Opponents say that VA\u2019s decision to provide abortions violates several existing laws, including the Veterans Health Care Act of 1992, which prohibits abortions at VA medical locations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Democratic supporters have argued that under the Veterans Health Care Eligibility Reform Act of 1996, the department can furnish \u201cneeded\u201d medical care to veterans, including abortions. An estimated 70,000 VA patients may be affected by the rule changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Elnahal told lawmakers he expects about 1,000 abortions to be performed by VA annually.
