{"id":77183,"date":"2023-07-11T19:06:42","date_gmt":"2023-07-11T19:06:42","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2023\/07\/11\/army-vet-paralyzed-from-run-in-with-police-gets-20-million-settlement\/"},"modified":"2026-08-18T20:56:28","modified_gmt":"2026-08-18T20:56:28","slug":"army-vet-paralyzed-from-run-in-with-police-gets-20-million-settlement","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/veterans\/2023\/07\/11\/army-vet-paralyzed-from-run-in-with-police-gets-20-million-settlement\/","title":{"rendered":"Army vet paralyzed from run-in with police gets $20 million settlement"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">SACRAMENTO, Calif. \u2014 A Northern California man who was left paralyzed after he was slammed to the ground during a traffic stop won a $20 million settlement, one of the largest in the state\u2019s history, officials announced Tuesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gregory Gross, an Army veteran who lives in Yuba City, <a href=\"https:\/\/apnews.com\/article\/police-lawsuits-california-sacramento-c321ca6ee74d901dd01cec313637c7df\" target=\"_blank\">sued the police department<\/a> in 2022 after police officers used \u201cpain compliance\u201d techniques and expressed disbelief when he repeatedly cried out, \u201cI can\u2019t feel my legs.\u201d Police officers also dismissed Gross when he said, \u201cI can\u2019t breathe,\u201d while being held facedown on the lawn outside a hospital, video released by Gross\u2019s lawyers shows.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gross was accused of driving drunk and causing a slow-speed collision in April 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gross was left with a broken neck, and he underwent two surgeries to fuse his spine. He said the officers\u2019 use of force left him unable to walk or care for himself, and he now needs round-the-clock nursing care for the rest of his life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are not against the police,\u201d said Attorney Moseley Collins, who represents Gross. \u201cWe are for the police, but we are against police brutality when it occurs.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement is among one of the largest police misconduct settlements in California history. In May, the state agreed to <a href=\"https:\/\/apnews.com\/article\/california-highway-patrol-police-custody-death-edward-bronstein-c07d84921cd09c8f576b877b5f133d79\" target=\"_blank\">pay $24 million<\/a> to the family of a man who died in police custody after screaming, \u201cI can\u2019t breathe,\u201d as multiple officers restrained him while trying to take a blood sample.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As part of the settlement, Yuba City will also start randomly auditing officers\u2019 bodycam footage and reviewing use of force incidents, police Chief Brian Baker said. He apologized to Gross at a news conference Tuesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYou\u2019ve been in my thoughts since this tragedy was brought to my attention,\u201d Baker said to Gross. \u201cOn April 12th, 2020, we missed the mark. And for that, Mr. Gross, I\u2019m sorry.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gross said the police reforms are important to make sure what happened to him isn\u2019t repeated. He\u2019s donating $20,000 to California Peace Officers\u2019 Memorial Foundation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m glad that they did something and took it serious,\u201d Gross said Tuesday. \u201cI couldn\u2019t understand how someone could be in a position of authority and was acting like that and treating another human being like that.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Deronda Harris, Gross\u2019 partner of 13 years, said she\u2019s grateful to see the settlement finalized.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s nice to finally have closure,\u201d Harris told The Associated Press.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gross also filed separate lawsuits in 2021 against Rideout Memorial Hospital in Marysville, along with the University of California, Davis Medical Center, alleging their actions contributed to his condition. Collins declined to comment on the status of the lawsuits, citing confidentiality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the police body camera video supplied by Gross\u2019 lawyers, an officer is seen twisting Gross\u2019 already handcuffed arms and forcibly seating him on a lawn. At one point, officers slammed him on the ground and held him facedown as Gross repeatedly cried out that he couldn\u2019t feel his legs and he couldn\u2019t breathe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMr. Gross, we are done with your silly little games,\u201d an officer tells him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In September 2021, Democratic Gov. Gavin Newsom <a href=\"https:\/\/apnews.com\/article\/health-george-floyd-california-gavin-newsom-ed761270d22e888172a1328a7be94f1a\" target=\"_blank\">signed a law<\/a> barring police from using certain facedown holds that have led to multiple unintended deaths.
