{"id":87929,"date":"2023-04-18T23:19:02","date_gmt":"2023-04-18T23:19:02","guid":{"rendered":"https:\/\/one.sightlinemg.com\/armytimes\/uncategorized\/2023\/04\/18\/sikorsky-wont-sue-us-army-after-gao-rejected-protest-over-future-helo\/"},"modified":"2026-08-08T00:53:30","modified_gmt":"2026-08-08T00:53:30","slug":"sikorsky-wont-sue-us-army-after-gao-rejected-protest-over-future-helo","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/armytimes\/home\/left-column\/2023\/04\/18\/sikorsky-wont-sue-us-army-after-gao-rejected-protest-over-future-helo\/","title":{"rendered":"Sikorsky won\u2019t sue US Army after GAO rejected protest over future helo"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 Lockheed Martin\u2019s Sikorsky said Tuesday it won\u2019t sue the U.S. Army after the <a href=\"https:\/\/www.defensenews.com\/land\/2023\/04\/06\/lockheed-unit-loses-protest-of-army-tiltrotor-award-to-textrons-bell\/\" target=\"_blank\">Government Accountability Office rejected its protest <\/a>of the service\u2019s decision to <a href=\"https:\/\/www.defensenews.com\/industry\/2022\/12\/05\/us-army-makes-largest-helicopter-award-in-40-years\/\" target=\"_blank\">choose Textron\u2019s Bell to build the Future Long Range Assault Aircraft.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.defensenews.com\/land\/2021\/07\/12\/us-army-triggers-future-long-range-assault-aircraft-competition\/#:~:text=The%20RFP%2C%20obtained%20by%20Defense%20News%2C%20lays%20out,aircraft%2C%20followed%20by%20two%20limited-user%20evaluation%20prototype%20aircraft.\" target=\"_blank\">FLRAA competition<\/a> pitted <a href=\"https:\/\/www.defensenews.com\/breaking-news\/2017\/12\/18\/v-280-valor-flies\/\" target=\"_blank\">Bell\u2019s V-280 Valor tiltrotor aircraft<\/a> against Sikorsky and Boeing\u2019s <a href=\"https:\/\/www.defensenews.com\/land\/2019\/03\/21\/sikorsky-boeing-defiant-helo-takes-first-flight\/#:~:text=The%20SB-1%20Defiant%20flew%20for%20more%20than%2030,the%20aircraft%20extensively%20before%20flight%20to%20reduce%20risk.\" target=\"_blank\">Defiant X, which features coaxial rotor blades.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sikorsky \u201chas decided not to pursue additional legal action regarding the [FLRAA] program,\u201d a company statement said. \u201cWe are disappointed with the [GAO] decision and remain convinced that our [Defiant] X offering represented both the best value for the taxpayer and the transformation technology that our warfighters need to execute their complex missions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, Sikorsky will turn its focus to the Army\u2019s other future vertical lift pursuit, <a href=\"https:\/\/www.defensenews.com\/smr\/army-modernization\/2020\/03\/25\/lockheed-and-bell-will-compete-head-to-head-to-build-us-armys-future-attack-recon-aircraft\/\" target=\"_blank\">the Future Attack Reconnaissance Aircraft<\/a>. Sikorsky is pitted against Bell in the FARA competition. Each company was selected in 2020 to build prototypes in a competition that will culminate in a flight demonstration phase that has now been delayed by several years beyond <a href=\"https:\/\/www.defensenews.com\/industry\/techwatch\/2022\/04\/07\/industry-teams-aim-to-fly-prototypes-of-future-attack-recon-aircraft-by-end-of-2023\/\" target=\"_blank\">original plans to fly in 2023<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Flights of the prototypes are now scheduled to begin in the fourth quarter of fiscal 2024, wrapping up a year later, according to fiscal 2024 Army budget documents. The delays are due to<a href=\"https:\/\/www.defensenews.com\/industry\/techwatch\/2022\/05\/04\/how-much-did-engine-delays-set-back-the-future-attack-recon-aircraft-program\/\" target=\"_blank\"> issues the Army is having with its Improved Turbine Engine Program<\/a>, the engine chosen for FARA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company will also continue its modernization of the Army\u2019s UH-60 Black Hawk utility helicopters that will remain in service for decades as well as \u201cfuture technology critical to mission readiness for the United States and Allied nations,\u201d the Sikorsky statement added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sikorsky <a href=\"https:\/\/www.defensenews.com\/industry\/2022\/12\/28\/lockheed-challenges-us-armys-helicopter-award\/\" target=\"_blank\">filed a protest late last year<\/a>, but the GAO denied it on April 6.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn denying the protest, GAO concluded that the Army reasonably evaluated Sikorsky\u2019s proposal as technically unacceptable because Sikorsky failed to provide the level of architectural detail required by the [request for proposal],\u201d an April 6 statement from the office read. \u201cGAO also denied Sikorsky\u2019s various allegations about the acceptability of Bell\u2019s proposal, including the assertion that the agency\u2019s evaluation violated the terms of the solicitation or applicable procurement law or regulation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The GAO determined that Sikorsky\u2019s proposal was \u201ctechnically unacceptable\u201d for an award due to a failure to fully substantiate subsystem design in the digital architecture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The 38-page protest decision also revealed that Sikorsky\u2019s bid price of $4.445 billion came in at about half of Bell\u2019s $8.087 billion bid price.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lockheed Martin CFO Jay Malave said during an April 18 earnings call that the company believes it offered the best technology to support the requirements for FLRAA at the best value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe technology that we can provide as you would expect \u2026 we have the leverage, we have the capability, the wherewithal to provide favorable pricing and outstanding technology offerings to our customer, and we don\u2019t do it at the expense of financial returns,\u201d Malave said, adding that a significant amount of its offerings included efficiencies made possible through its model-based and digital thread enhancements that \u201csignificantly improved our cost competitiveness.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The deal for the next-generation helicopter is worth up to $1.3 billion and is set to replace about 2,000 Black Hawk utility helicopters. FLRAA won\u2019t serve as a 1-to-1 replacement for existing aircraft, but it will take over the roles of the Black Hawk \u2014 long the workhorse of the Army for getting troops to and around the battlefield \u2014 in the 2030 time frame.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The engineering and manufacturing development stage, as well as the low-rate production phase, could be worth roughly $7 billion in total.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Army purchases the full complement of aircraft across the entire life of the fleet, the program could be worth about $70 billion, including potential foreign military sales, the program executive officer for aviation, Maj. Gen. Rob Barrie, said during a Dec. 5 media roundtable following the Army\u2019s selection of Bell.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The company has announced it&#8217;s reached the end
