WASHINGTON \u2014 A former CIA employee is \u201cdeeply saddened\u201d that he may face espionage charges in the government\u2019s probe of a massive leak of cyber hacking tools, his lawyer says.<\/p>\n\n\n\n
Joshua Adam Schulte, 29, already held without bail in Manhattan on child pornography charges, learned last Friday during a New York court appearance that additional charges were likely to be filed against him in about 45 days from what Assistant U.S. Attorney Matthew Laroche said was a \u201cbroader investigation\u201d unrelated to the pornography case.<\/p>\n\n\n\n
\u201cMr. Schulte has spent years working to ensure the safety of his country and is deeply saddened to hear that he could face charges of espionage,\u201d assistant federal defender Sabrina Shroff said Tuesday in response to a request for comment.<\/p>\n\n\n\n
Laroche had told U.S. District Judge Paul A. Crotty that the new charges were unlikely for several weeks.<\/p>\n\n\n\n
\u201cWe\u2019re consulting with a lot of folks that are not within our office, so we\u2019re moving as quickly as we can on that front,\u201d he said.<\/p>\n\n\n\n
The cryptic description at Friday\u2019s hearing led Shroff, who entered the case in March, to demand more.<\/p>\n\n\n\n
\u201cAre they secret charges that I\u2019m not allowed to know about? What are these charges?\u201d Shroff asked, saying she wanted to know of possible charges, whether they be sedition or something else. \u201cAre they charging him with espionage?\u201d<\/p>\n\n\n\n
Laroche said it involved an ongoing grand jury investigation and added, \u201cI don\u2019t think we have an obligation to disclose it at this time, but we certainly have had discussions with Ms. Shroff about the nature of the underlying investigation.\u201d<\/p>\n\n\n\n
At a January hearing, Laroche said Schulte was a target of an ongoing investigation into the theft of tools that were used by the CIA to spy overseas. No charges have been filed against Schulte in that investigation, and his defense lawyers have insisted he was not involved.<\/p>\n\n\n\n
Schulte\u2019s name was first reported Tuesday by The Washington Post.<\/p>\n\n\n\n
The CIA declined comment.<\/p>\n\n\n\n
WikiLeaks began releasing some of the CIA\u2019s hacking tools in March 2017. The U.S. government has all but publicly acknowledged the embarrassing leak from the CIA\u2019s Center for Cyber Intelligence. President Donald Trump told a television host then, \u201cI just want people to know the CIA was hacked, and a lot of things taken.\u201d<\/p>\n\n\n\n
At January\u2019s hearing, Laroche said the material was taken from the CIA during the more than six years that Schulte worked for the agency in various positions, including technical development officer.<\/p>\n\n\n\n
\u201cThe government immediately had enough evidence to establish that he was a target of that investigation,\u201d Laroche said. \u201cThey conducted a number of search warrants on the defendant\u2019s residence.\u201d<\/p>\n\n\n\n
Laroche said he disagreed with Schulte\u2019s lawyer at the time, who claimed the search warrants had not yielded anything consistent with the material released by WikiLeaks. \u201cIn fact, our investigation is ongoing,\u201d Laroche said. \u201cHe remains a target of that investigation.\u201d<\/p>\n\n\n\n
Schultz, of New York, is being held at the Metropolitan Correctional Center in Manhattan.<\/p>\n\n\n\n
Jacob Kaplan, Schulte\u2019s attorney at the January hearing, told the court that \u201cthe government had full access to his computers and his phone, and they found the child pornography in this case, but what they didn\u2019t find was any connection to the WikiLeaks investigation.\u201d<\/p>\n\n\n\n
