{"id":14053,"date":"2017-10-20T18:24:48","date_gmt":"2017-10-20T18:24:48","guid":{"rendered":"https:\/\/one.sightlinemg.com\/c4isrnet\/uncategorized\/2017\/10\/20\/two-year-dhs-domino-contract-protest-saga-concludes\/"},"modified":"2026-08-08T17:43:21","modified_gmt":"2026-08-08T17:43:21","slug":"two-year-dhs-domino-contract-protest-saga-concludes","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/c4isrnet\/cyber\/2017\/10\/20\/two-year-dhs-domino-contract-protest-saga-concludes\/","title":{"rendered":"Two-year DHS DOMino contract protest saga concludes"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">More than two years after the Department of Homeland Security originally decided to award their Development, Operations, and Maintenance (DOMino) contract to Raytheon, GAO has denied Northrup Grumman\u2019s third protest of the contract award, allowing Raytheon and DHS to begin work under the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The $1 billion, five-year contract, originally announced in July 2014, sought support for DHS\u2019s mission of protecting the .gov web domain from cyberattacks. The contracted company would support cybersecurity system design, development, deployment and operations and maintenance for the National Cybersecurity Protection System (NCPS), also known as EINSTEIN.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The EINSTEIN system protects more than 100 federal networks from known threat vectors, and serves as one of DHS\u2019s major cybersecurity initiatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DHS received proposals from five offerors and <a href=\"https:\/\/www.federaltimes.com\/management\/2015\/09\/28\/dhs-awards-1b-contract-to-support-develop-einstein-firewall\/\">awarded the contract<\/a> to Raytheon in September 2015.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cToday\u2019s cyber threats are increasingly pervasive and serious, and our government and private sector institutions require the best protection possible,\u201d said Dave Wajsgras, president of Raytheon Intelligence, Information and Services when the original contract was awarded. \u201cRaytheon has invested over $3.5 billion in recent years to build our cybersecurity capabilities, and we\u2019re looking forward to bringing the very best and most innovative solutions to the Department of Homeland Security.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From October 2015 to June 2017, Northrop Grumman filed two protests of the award. For each, DHS took corrective action, withdrawing the award before reaffirmed it with Raytheon. GAO then <a href=\"https:\/\/www.fifthdomain.com\/home\/2017\/06\/19\/raytheon-ceo-1b-dhs-cyber-contract-could-lure-global-government-customers\/\">dismissed the protests<\/a> as \u201cacademic.\u201d Following GAO\u2019s June 22, 2017 debriefing with Northrum Grumman on DHS\u2019s decision to reaffirm their award to Raytheon, Northrup Grumman issued a third protest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This time, DHS stood their ground on the contract, leading GAO to conduct a 100-day review of the case. The decision to deny the bid protest was made on Oct. 4, and, under the Competition and Contracting Act of 1984, Raytheon was under an automatic stay of work until that date.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe protester argues that the award to Raytheon was improper because the awardee had an unfair competitive advantage arising from the hiring of former DHS employees, the agency failed to revise the RFP to reflect its changed requirements, the agency unreasonably evaluated offerors\u2019 past performance, and the agency conducted unequal discussions with the awardee,\u201d the GAO decision said. \u201cWe deny the protest.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The GAO decision found that the \u201cagency reasonably concluded that any information to which the former employees may have had access was not competitively useful,\u201d and that Northrup Grumman could not prove that DHS either unfairly evaluated their past performance or used later meetings with Raytheon to fulfill the contract\u2019s requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Though Northrup Grumman has no further protest options through GAO, the company could conceivably file within the Federal Claims court. However, only a small number of GAO\u2019s denied protests make it to that court every year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Raytheon confirmed to Fifth Domain that they had begun work on
