{"id":16709,"date":"2019-06-03T21:19:25","date_gmt":"2019-06-03T21:19:25","guid":{"rendered":"https:\/\/one.sightlinemg.com\/c4isrnet\/uncategorized\/2019\/06\/03\/why-congress-has-concerns-about-dod-cyber\/"},"modified":"2026-08-08T17:57:45","modified_gmt":"2026-08-08T17:57:45","slug":"why-congress-has-concerns-about-dod-cyber","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/c4isrnet\/it-networks\/2019\/06\/03\/why-congress-has-concerns-about-dod-cyber\/","title":{"rendered":"Why Congress has concerns about DoD cyber"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A House Armed Services subcommittee has raised concerns regarding the Department of Defense cyber enterprise\u2019s ability to procure cyber tools.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to draft language in the annual defense policy bill released June 3, the Subcommittee on Intelligence and Emerging Threats and Capabilities believes \u201cthe nation\u2019s cyber force could be hindered with tools and accesses being developed and stored by different components of the services and Department of Defense agencies and elements,\u201d the draft states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFor all the components under its authority, U.S. Cyber Command should maintain a comprehensive and dynamic inventory of subordinate elements\u2019 accesses and tools, and emphasize the importance of sustaining these cyber-specific capabilities.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision taking aim at the department\u2019s cyber acquisition is located in the first draft of the bill, and changes could be expected during committee markup. However, it is included as an \u201citem of special interest,\u201d meaning the House committee is directing the secretary of defense to provide just the House Armed Services Committee a briefing no later than Feb. 1, 2020, on the DoD\u2019s strategy for acquisition, development and sustainment of cyber-specific accesses and tools.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While in the past the individual services procured their own cyber tools on their own separate infrastructure, Cyber Command is changing this paradigm. The command created the Joint Cyber Warfighting Architecture (JCWA), established by Cyber Command within the last year to guide capability development priorities.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/c4isrnet\/cyber\/2019\/05\/10\/a-better-way-for-cyber-command-to-get-the-tools-it-needs\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/tns-cyber-force-mix-1jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">A better way for Cyber Command to get the tools it needs?<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">U.S. Cyber Command is reconsidering how it buys and develops the tools cyber warriors need.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The architecture consists of five elements, which include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Common firing platforms to be used at the four cyber operating locations of the service cyber components. These platforms will be worked into a comprehensive suite of cyber tools;<\/li><li>Unified Platform, which will integrate and analyze data from offensive and defensive operations with partners;<\/li><li>Joint command and control mechanisms for situational awareness and battle management at the strategic, operational and tactical levels;<\/li><li>Sensors that support defense of the network and drive operational decisions; and<\/li><li>The Persistent Cyber Training Environment, which will provide individual and collective training as well as a way to rehearse for a mission. The Army is managing PCTE on behalf of Cyber Command and the joint force.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Concerning acquisition more broadly, the subcommittee has raised skepticism regarding Cyber Command\u2019s use of acquisition authority Congress has given it.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/c4isrnet\/cyber\/2019\/03\/14\/should-cybercom-be-granted-more-acquisition-funds\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"198\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/NSA.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Should CYBERCOM be granted more acquisition funds?<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Some congressional leaders are questioning Cyber Command&#039;s needs given it has yet to exhaust what has already been provided.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Congress gave Cyber Command limited acquisition authority in 2016 following the model of Special Operations Command. It capped acquisition funds at $75 million per year, sunsetting in 2021. The command <a href=\"https:\/\/www.fifthdomain.com\/dod\/cybercom\/2018\/09\/07\/cyber-commands-acquisition-authority-still-in-its-infancy\/\" target=_blank>had previously asked for<\/a> an increased ceiling of $250 million and a sunset of 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, this year, the command has only used a fraction of that \u2014 roughly $44 million, its commander told the committee in March \u2014 leading some to question if the options as currently established are appropriate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCertainly, since over the years we have worked to give the services more flexible acquisition authorities, can you provide this committee with an update on why you think you need this unique acquisition authority and what the current state of implementation is?\u201d said Rep. Elise Stefanik, R-N.Y., the committee\u2019s ranking member, during the hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maj. Gen. Karl Gingrich, director of capability and resource integration, J-8 at Cyber Command, told reporters in May that part of the problem is getting the right workforce in place within the acquisition shop to be able to manage contracts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Additionally, he said he\u2019s hopeful the command will use its acquisition funds by year\u2019s end.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe just don\u2019t want to run into a situation where we\u2019re in a June-July timeframe and we\u2019ve already exhausted our $75 million acquisition authority for that year. Now what do we do?\u201d he said. \u201cWhen I said negotiating, it\u2019s really discussion with Department of Defense, Congress and us to make sure that we have the appropriate level where we don\u2019t over ask but that is balanced based on our maturity and our ability to execute because we see the value of it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The briefing the subcommittee is asking DoD for should include details of the processes, procedures, roles and responsibilities and sustainment plans for the DoD\u2019s cyber capabilities. It should also include details on how DoD acquires tools, capabilities and accesses from non-governmental sources and conducts due diligence of these
