{"id":17811,"date":"2018-07-25T21:21:40","date_gmt":"2018-07-25T21:21:40","guid":{"rendered":"https:\/\/one.sightlinemg.com\/c4isrnet\/uncategorized\/2018\/07\/25\/nsa-criticized-for-increased-risk-of-jeopardizing-civil-liberties\/"},"modified":"2026-08-08T18:08:13","modified_gmt":"2026-08-08T18:08:13","slug":"nsa-criticized-for-increased-risk-of-jeopardizing-civil-liberties","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/c4isrnet\/home\/2018\/07\/25\/nsa-criticized-for-increased-risk-of-jeopardizing-civil-liberties\/","title":{"rendered":"NSA criticized for &#8216;increased risk\u2019 of jeopardizing civil liberties"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The National Security Agency is at an \u201cincreased risk\u201d of jeopardizing civil liberties and the privacy of American citizens, according to an inspector general report that comes just months after a controversial program that collects emails and phone calls was extended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The NSA watchdog said that agency analysts performed \u201cnoncompliant\u201d searches using the organization\u2019s Foreign Intelligence Surveillance Act Authority, which were caused by \u201chuman error, incomplete understanding of the rules, and gaps in guidance.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.oversight.gov\/sites\/default\/files\/oig-sa-reports\/OIG%20UNCLASS%20SAR%20OCT-MAR%202018.pdf\">According to the report<\/a>, which covered the period from October 1, 2017, to March 31, 2018 the unauthorized searches were related to the FISA\u2019s counterterrorism authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis has been going on for some time,\u201d said William Banks, a law professor at Syracuse University. He said that noncompliance was a heated topic when the section 702 of the FISA act was <a href=\"https:\/\/www.nytimes.com\/2018\/01\/11\/us\/politics\/fisa-surveillance-congress-trump.html\">reauthorized earlier this year<\/a>. \u201cA fair amount of it was apparently mechanical or machine-driven mistakes &#8230; you would expect it might take the better part of a year for improvement in implementation to show results.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Previously, privacy groups have raised issue with the noncompliance searches of digital and electronic records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Search violations are the most common type of compliance breaches of the section 702 program, according to a 2017 report from New America, a think tank. Section 702 allows the government to collect communications from foreigners, including when they speak with Americans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhile these violations are not willful \u2014 they are inadvertent or unintentional \u2014 they are extremely concerning,\u201d <a href=\"https:\/\/www.newamerica.org\/oti\/blog\/history-fisa-section-702-compliance-violations\/\" target=_blank>wrote <\/a>Robyn Greene, a policy counsel at New America, in the report that analyzed section 702 program violations. \u201cThese unintentional violations are a threat to Americans&#8217; privacy, and their impact can be significant and prolonged.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The inspector general also criticized the agency for \u201cincomplete\u201d documentation of internal processes related to foreign dissemination of FISA data, which \u201cincreases the risk of noncompliance.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In another example, the NSA watchdog said that three open-source capabilities of the agency posed similar risks to citizens, as well as spreading classified material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report comes after the agency <a href=\"https:\/\/www.nsa.gov\/news-features\/press-room\/statements\/jun-28-2018-ufa-cdr-decision.shtml\">admitted <\/a>in June that it had unintentionally collected hundreds of millions of call detail records, and five years after the Snowden revelations showed some of the U.S. government\u2019s surveillance capabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>A previous version of this story incorrectly said the report covered the period from August 1 to March 31.
