{"id":22110,"date":"2018-11-30T20:53:43","date_gmt":"2018-11-30T20:53:43","guid":{"rendered":"https:\/\/one.sightlinemg.com\/c4isrnet\/uncategorized\/2018\/11\/30\/the-government-must-define-emerging-technology-to-protect-it\/"},"modified":"2026-08-08T04:56:00","modified_gmt":"2026-08-08T04:56:00","slug":"the-government-must-define-emerging-technology-to-protect-it","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/c4isrnet\/it-networks\/2018\/11\/30\/the-government-must-define-emerging-technology-to-protect-it\/","title":{"rendered":"The government must define \u2018emerging technology\u2019 to protect it"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Department of Commerce is fast-tracking efforts to identify and establish export controls on \u201cemerging technologies\u201d deemed essential to the national security of the United States.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Commerce Department\u2019s Bureau of Industry and Security (BIS) <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2018-11-19\/pdf\/2018-25221.pdf\">published<\/a> an advance notice of proposed rulemaking Nov. 19, kicking off a 30-day public comment process on a rule that would impose export restrictions on a host of broadly defined new technologies, including artificial intelligence, machine learning algorithms, biotechnology, microprocessor technology and robotics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose of the notice is to solicit public feedback on how to properly define and identify these <a href=\"https:\/\/www.c4isrnet.com\/newsletters\/daily-brief\/2018\/07\/24\/how-congress-wants-dod-to-tackle-ai-and-machine-learning-in-2019\/\">emerging technologies<\/a> and to determine the degree to which they are essential to U.S. national security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fast-tracked effort will allow less than a month for the government to complete a significant challenge: identify and define an extremely diverse set of technologies, which impact huge swaths of the U.S. economy and are constantly evolving.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once the bureau formally identifies an item as \u201cemerging,\u201d the Commerce Department must impose license requirements for export to countries subject to a U.S. embargo, including an arms embargo, such as China.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Congress directed the Commerce Department in the Export Control Reform Act of 2018, part of the National Defense Authorization Act, to establish controls \u201con the export, re-export, or in-country transfer\u201d of emerging technologies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The 14 technologies included in the notice generally reflect sentiments expressed by the Trump administration concerning the Made in China 2025 plan, China\u2019s state-run industrial policy that seeks to make China dominant in global high-tech manufacturing. Many of the technologies included in the Commerce Department proposal are also found in the Made in China initiative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cChina, in my view, brazenly has released this China 2025 plan that basically told the rest of the world, \u2018We\u2019re going to dominate every single emerging industry of the future, and therefore your economies aren\u2019t going to have a future,'&#8221; Peter Navarro, the White House\u2019s<b> <\/b>trade policy adviser, <a href=\"https:\/\/www.bloomberg.com\/news\/videos\/2018-03-28\/u-s-tariffs-on-china-to-target-tech-navarro-says-video\">told Bloomberg Television <\/a>March 28.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey have been the factory floor of the world, now their vision is to be the technology center for the world,\u201d Commerce Secretary Wilbur Ross <a href=\"https:\/\/www.business-standard.com\/article\/international\/china-s-2025-plan-to-be-global-tech-nexus-frightening-us-commerce-secy-118042500096_1.html\">said<\/a> of Beijing\u2019s development plan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In June 2018, <a href=\"https:\/\/www.wsj.com\/articles\/trump-plans-new-curbs-on-chinese-investment-tech-exports-to-china-1529883988?mod=article_inline\">reports indicated<\/a> the Trump administration was looking into using executive powers to block tech-related acquisitions by firms with at least 25 percent Chinese ownership and imposing new export controls on critical technologies. After weeks of anticipation, the administration <a href=\"https:\/\/www.politico.com\/story\/2018\/06\/26\/donald-trump-china-investment-restrictions-653022\">decided to back down<\/a>, opting to work with Congress on more modest measures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Nov. 19 notice states that the Commerce Department will issue a separate notice seeking public comment regarding \u201cfoundational technologies,&#8221; another category that may be critical to U.S. national security interests, which Congress instructed BIS to study and control.
