{"id":23058,"date":"2017-10-19T16:35:39","date_gmt":"2017-10-19T16:35:39","guid":{"rendered":"https:\/\/one.sightlinemg.com\/c4isrnet\/uncategorized\/2017\/10\/19\/dod-says-it-shouldnt-protect-homeland-from-cyberthreats-mccain-disagrees\/"},"modified":"2026-08-08T18:20:41","modified_gmt":"2026-08-08T18:20:41","slug":"dod-says-it-shouldnt-protect-homeland-from-cyberthreats-mccain-disagrees","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/c4isrnet\/cyber\/2017\/10\/19\/dod-says-it-shouldnt-protect-homeland-from-cyberthreats-mccain-disagrees\/","title":{"rendered":"DoD says it shouldn\u2019t protect homeland from cyberthreats; McCain disagrees"},"content":{"rendered":"<figure class=\"wp-block-smg-jwplayer-video\"><atype-video-jwplayer nostick=\"true\" playlisturl=\"https:\/\/cdn.jwplayer.com\/v2\/playlists\/fCzRqMW8?tags=e37a9ece-f143-4b98-910e-83d7f66eb268\" poster=\"\/wp-content\/uploads\/2026\/08\/video-poster-e37a9ece-f143-4b98-910e-83d7f66eb268.jpg\" aspectratio=\"16 \/ 9\" mute autostart=\"false\"><\/atype-video-jwplayer><\/figure>\n\n\n<p class=\"wp-block-paragraph\">In a heated exchange before the Senate Armed Services Committee on Oct. 19, the committee\u2019s chairman sparred with the Department of Defense\u2019s principle cyber adviser over the Pentagon\u2019s roles in protecting the nation in cyberspace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAlthough DoD has built capacity and unique capabilities, for a number of reasons, I would caution against ending the current framework and against reassigning more responsibility for incident response to the Department of Defense,\u201d Kenneth Rapuano, assistant secretary of defense for homeland defense and global security and a principle cyber adviser, wrote in his prepared testimony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c[T]he United States has a long normative and legal tradition limiting the role of the military in domestic affairs. This strict separation of the civilian and the military is one of the hallmarks of our democracy and was established to protect its institutions. Designating DoD as the lead for the domestic cyber mission risks upsetting this traditional civil-military balance,\u201d Rapuano\u2018s testimony read.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYou said that it\u2019s not Department of Defense responsibility \u2014 suppose if the Russians had been able to affect the outcome of the last election,\u201d SASC Chairman John McCain, R-Ariz., charged. \u201cWould that fall under the responsible and authority to some degree of the Department of Defense if they\u2019re able to destroy the fundamental of democracy by changing the outcomes of elections?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rapuano told McCain that the DoD has a responsibility to support responses and mitigation of threats in the electoral process through defense to civil authorities, if asked. However, the main point for coordination is the Department of Homeland Security, while general election matters are governed by the states and local governments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">McCain was not pleased with Rapuano\u2019s responses. \u201cFor you to sit there and say, \u2018Well, but it\u2019s not Department of Defense\u2019s responsibility\u2019 \u2014 it is; to defend the nation \u2026 if you can change the outcome of an election, that has consequences far more serious than a physical attack,\u201d McCain said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI am in fundamental disagreement with you about requirements of the Department of Defense to defend the fundamental of this nation, which is a free and fair election, which we all know the Russians tried to affect the outcome. \u2026 It\u2019s the Department of Defense\u2019s job to defend this nation; that\u2019s why it\u2019s called the Department of Defense.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rapuano noted the role of the National Guard, stating that in a number of states, on the authority of the governors, these forces are being trained in cyber to assist states in identifying vulnerabilities and mitigating those vulnerabilities. Elements of the Guard are part of the cyber mission force, Rapuano said, adding: \u201cWe certainly view quite appropriate the governor taking them under state authority versus the Department of Defense attempting to assert itself into a process without directly being requested.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>[<\/i><a href=\"https:\/\/www.c4isrnet.com\/home\/2017\/06\/21\/air-force-leveraging-guard-reserve-to-build-cyber-mission-forces\/\"><i>Air Force leveraging Guard, Reserve to build cyber mission forces<\/i><\/a><i>]<\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">McCain retorted that, while appreciative of what the Guard and other local authorities are doing, \u201cwe see no coordination and no policy and no strategy, and when you\u2019re ready to give that to us, we would be eager to hear about it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">McCain also raised a similar refrain that for eight years his committee has been waiting for a cyber policy and strategy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Government Accountability Office <a href=\"http:\/\/www.gao.gov\/assets\/680\/676322.pdf\">report<\/a> from 2016 charged that the DoD lacked a clear chain of command for domestic cyberattacks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This notion was disputed by top DoD cyber officials at the time. \u201cSo there\u2019s been a lot of discussion: \u2018We don\u2019t know how to do this\u2019 or \u2018There [are] disconnects there,\u2019 but I don\u2019t think that\u2019s the case at all,\u201d Lt. Gen. James \u201cKevin\u201d McLaughlin, then deputy commander of U.S. Cyber Command, <a href=\"https:\/\/defensesystems.com\/articles\/2016\/04\/25\/dod-support-response-to-domestic-cyber-attack.aspx\">said<\/a> in 2016. \u201cI think we know how to do it; we\u2019re making sure that in the event that it happens we\u2019re ready to execute.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Exercises such as Cyber Guard seek not only to help validate Cyber Command\u2019s cyber teams, but also help to work coordination with civil agencies such as DHS, the FBI and the National Guards of various states in the event of a national cyber disaster. Cyber Command\u2019s cyber protection teams can be activated to support these civil organizations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>[<\/i><a href=\"https:\/\/www.c4isrnet.com\/show-reporter\/ausa\/2017\/10\/12\/a-peek-inside-army-cyber-protection-teams\/\"><i>A peek inside Army cyber protection teams<\/i><\/a><i>]<\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe focus of the domestic response capabilities, the defense support to civil authorities when it comes to cyber are those protection teams out of the cyber mission force,\u201d Rapuano told the senators in attendance. \u201cThose are skilled practitioners who understand the forensics issues, the identification of the challenges of types of malware and different approaches to removing the malware from the systems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis defense support to civil authority is a direct request for assistance from DHS to the department, and we have authorities all the way down to [combatant command] commanders, specifically Cyber Command. [Cyber Command commander] Adm. [Michael] Rogers has the authorities in a number of areas to directly task those assets. It then comes up to me, and in certain areas the secretary requires his approval.
