{"id":16925,"date":"2018-10-31T17:15:21","date_gmt":"2018-10-31T17:15:21","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2018\/10\/31\/l3-agrees-to-settle-lawsuit-alleging-bias-against-guard-and-reserve-pilots\/"},"modified":"2026-08-07T20:24:49","modified_gmt":"2026-08-07T20:24:49","slug":"l3-agrees-to-settle-lawsuit-alleging-bias-against-guard-and-reserve-pilots","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/industry\/2018\/10\/31\/l3-agrees-to-settle-lawsuit-alleging-bias-against-guard-and-reserve-pilots\/","title":{"rendered":"L3 agrees to settle lawsuit alleging bias against Guard and reserve pilots"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A major defense contractor has agreed to pay $2 million to <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2017\/12\/14\/4-star-air-guard-pilot-shortages-most-acute-among-full-time-airmen\/\" target=\"_blank\">National Guard and reserve pilots<\/a> who were passed over for jobs at the company going back to 2011, under a proposed settlement filed Tuesday in federal court in Washington state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nathan Kay, a former pilot in the Washington Air National Guard, sought preliminary approval of the settlement in his class-action lawsuit in U.S. District Court for the Eastern District of Washington.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the lawsuit, Kay alleged that employees working in <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2017\/10\/17\/skyraider-2-the-air-force-may-bring-back-vietnam-style-combat-plane\/\" target=\"_blank\">L3 Technologies<\/a>&#8216; intelligence, reconnaissance and surveillance operations regularly discriminated against National Guard and reserve pilots because of their ongoing service commitments, according to court documents provided to Military Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit alleged that statistical evidence supported its claim that L-3 had a practice of preferring veterans without ongoing military obligations in order to not interfere with the company\u2019s 60-day work rotations, which involved deployments to the Middle East and South Asia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kay, the lead plaintiff, originally filed the lawsuit in 2015, claiming L3 violated the <a href=\"https:\/\/ec.militarytimes.com\/guard-reserve-handbook\/rights-responsibilities\/employment-rights\/\" target=_blank>Uniformed Services Employment &amp; Reemployment Rights Act<\/a> \u2014 a federal law that prohibits workplace discrimination based on a person\u2019s military service or status.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2018\/06\/18\/study-to-fix-air-force-pilot-shortage-look-to-contractors-and-forget-about-warrant-officers\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/A-10-pilot-small.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Study: To fix Air Force pilot shortage, look to contractors \u2014 and forget about warrant officers<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The Air Force should make greater use of contractors to bolster its pilot training capabilities as it works to fix its festering pilot shortfall once and for all, according to a new report.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In early 2017, after his attorneys gathered 65,000 pages of documents through discovery, the court allowed Kay to pursue claims on behalf of others who were denied pilot jobs by L3.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L-3 denied liability, claiming that it never discriminated against anyone in its hiring practices. Robert Shepherd)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Under the proposed class action settlement, which has to be reviewed by the court, L3 would also pay $2 million to settle hiring discrimination claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L3 reported $9.6 billion in sales in 2017 and has roughly 31,000 employees worldwide. According to the company, it is entering into the settlement for the purposes of preventing any protracted and costly litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kay and other reservists will receive monetary payments under the settlement if they file claim forms demonstrating that they were reservists or Guardsmen who were qualified applicants for the \u201cSenior Pilot I\u201d position in L3\u2019s ISR operations between 2011 and 2018.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiffs alleged that reserve and veteran pilot applicants to L-3\u2019s ISR programs had similar professional experiences and were ideal candidates for the pilot position, due to high flight hours, combat flying experience, comfort working with the military and active security clearances.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2018\/10\/10\/air-force-hopes-to-train-1500-new-pilots-each-year-by-2022-to-help-solve-shortage\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"159\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Air-PTN_plane-web.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Air Force hopes to train 1,500 new pilots each year by 2022 to help solve shortage<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Air Force Secretary Heather Wilson told lawmakers Wednesday that the Air Force trained 1,160 new pilots in fiscal 2017, and expects to train 1,311 in fiscal 2019, before expanding further to 1,500 by 2022.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">But, after \u201canalyzing tens of thousands of pages of application files to determine which applicants were reservists, veterans and civilians when they applied for the Senior Pilot I position, plaintiff\u2019s counsel and expert determined that veterans were hired at a substantially greater rate than Reservists,\u201d the court documents read.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiffs allegedly determined that if reservists and veterans had been hired at the same rate, between 20 and 35 additional reservists would have been hired from 2011 to 2018 for the Senior Pilot I position, according to the documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBefore I became a lawyer, I served in the Army National Guard,&#8221; said Matthew Crotty of the Crotty &amp; Son law firm in Spokane, Washington, who also represented Kay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMany of my troops would report to me about how hard it was to find work because of their military reserve duty,\u201d he said. &#8220;That\u2019s what got me into representing service members. It\u2019s nice to play a small part in ensuring that members of the military reserves are treated properly when they apply for civilian
