Tim Kaine<\/a>, D-Va., says Trump must win approval from Congress before engaging in further military action against Iran. Eight Republicans joined with Democrats to pass the resolution by a 55-45 vote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kaine and other supporters said the resolution was not about Trump or even the presidency, but instead was an important reassertion of congressional power to declare war.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While Trump and other presidents &#8220;must always have the ability to defend the United States from imminent attack, the executive power to initiate war stops there,&#8221; Kaine said. \u201cAn offensive war requires a congressional debate and vote.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Democratic-controlled House passed <a href=\"https:\/\/www.defensenews.com\/congress\/2020\/01\/30\/house-votes-to-curb-trumps-military-action-on-iran\/\" target=_blank>a separate, nonbinding war powers resolution<\/a> last month. The House could take up the Senate resolution later this month, said House Majority Leader Steny Hoyer, D-Md.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two-thirds votes in the House and GOP-run Senate would be needed to override an expected Trump veto.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/pentagon-congress\/2020\/01\/09\/in-a-rebuke-to-trump-house-dems-advance-measure-barring-war-with-iran\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/6010158.jpg_2479a4.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">In a rebuke to Trump, House Dems advance measure barring war with Iran<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The non-binding resolution demands more involvement from Congress in decisions that could lead to war, but faces an uncertain future in the Senate.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Answering a claim by some of Trump\u2019s supporters and Trump himself that the measure would send a signal of weakness to Iran and other potential adversaries, Kaine said the opposite was true.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhen we stand up for the rule of law \u2014 in a world that hungers for more rule of law \u2014 and say \u2018this decision is fundamental, and we have rules that we are going to follow so we can make a good decision,\u2019 that\u2019s a message of strength,\u201d Kaine said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sen. Mike Lee, R-Utah, agreed. Lee supports Trump\u2019s foreign policy, including toward Iran, but said Congress cannot escape its constitutional responsibility to act on matters of war and peace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;What the American people and the entire world will see from the debate we\u2019re about to have in the Senate is that there is abundant support for the United States taking tough positions with regard to Iran,&#8221; Lee said Wednesday. \u201cAnd as part of that we want to make sure that any military action that needs to be authorized is in fact properly authorized by Congress. That doesn\u2019t show weakness. That shows strength.&#8217;\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principle of congressional approval is established for an important reason, Kaine said. \u201cIf we\u2019re to order our young men and women &#8230; to risk their lives in war, it should be on the basis of careful deliberation by the people\u2019s elected legislature and not on the say-so of any one person.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump disputed that, arguing in two tweets Wednesday that a vote against Kaine\u2019s proposal was important to national security and pointed to the Jan. 3 drone strike that killed Iran\u2019s top general, <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2020\/01\/03\/iraq-rockets-fired-at-baghdad-airport-7-people-killed\/\" target=_blank>Qassem Soleimani<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are doing very well with Iran and this is not the time to show weakness. Americans overwhelmingly support our attack on terrorist Soleimani,\u201d Trump said. \u201cIf my hands were tied, Iran would have a field day. Sends a very bad signal. The Democrats are only doing this as an attempt to embarrass the Republican Party. Don\u2019t let it happen!\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tehran responded to the U.S. attack on Soleimani by launching missiles at two military bases in Iraq that house American troops. At Republicans\u2019 request, he removed initial language that targeted Trump in favor of a generalized statement declaring that Congress has the sole power to declare war. The resolution also directs Trump to terminate use of military force against Iran or any part of its government without approval from Congress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sen. Susan Collins, R-Maine, a co-sponsor, called the resolution &#8220;much needed and long overdue.&#8221; She said that over the past decade, \u201cCongress has too often abdicated its constitutional responsibility on authorizing the sustained use of military force.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Senate Majority Leader Mitch McConnell, R-Ky., and many other Republicans opposed
