{"id":20248,"date":"2021-11-02T20:15:29","date_gmt":"2021-11-02T20:15:29","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2021\/11\/02\/us-defense-allies-push-to-block-new-buy-american-boost\/"},"modified":"2026-08-07T21:49:37","modified_gmt":"2026-08-07T21:49:37","slug":"us-defense-allies-push-to-block-new-buy-american-boost","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2021\/11\/02\/us-defense-allies-push-to-block-new-buy-american-boost\/","title":{"rendered":"US defense allies push to block new \u2018Buy American\u2019 boost"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><i>Note: This story was updated on Nov. 3, 2021.<\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">WASHINGTON \u2015 A group of close U.S. military allies worried <a href=\"https:\/\/www.defensenews.com\/global\/the-americas\/2021\/11\/01\/buy-american-biden-sees-industry-pushback-as-allies-warn-of-trade-consequences\/\" target=\"_blank\">a legislative proposal to boost to \u201cBuy American\u201d requirements<\/a> will upend longstanding defense trade pacts is asking Senate lawmakers to scuttle the measure \u2014 or at least make it friendlier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A group of 25 foreign military attach\u00e9s whose countries have special reciprocal trade agreements with the Pentagon wrote Oct. 28 to Senate Armed Services Committee Chairman <a href=\"https:\/\/www.defensenews.com\/congress\/2020\/10\/29\/sen-jack-reed-is-thought-of-as-a-quiet-professional-if-democrats-win-the-senate-hell-be-front-and-center\/\" target=\"_blank\">Jack Reed<\/a>, D-R.I., and ranking member <a href=\"https:\/\/www.defensenews.com\/opinion\/commentary\/2021\/01\/26\/president-biden-shouldnt-replace-military-strength-with-diplomacy\/\" target=\"_blank\">Jim Inhofe<\/a>, R-Okla., to ask that they oppose the language during eventual talks to reach a compromise 2022 defense policy bill. The group includes Canada, France, Germany and the U.K.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s the latest flashpoint in the fight over Democratic efforts to boost domestic manufacturing by strengthening \u201cBuy American\u201d requirements, which apply to about a third of the $600 billion in goods and services the federal government buys each year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/01\/25\/executive-order-on-ensuring-the-future-is-made-in-all-of-america-by-all-of-americas-workers\/\" target=\"_blank\">U.S. President Joe Biden<\/a> took executive action during his first week in office, the House-passed<a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2021\/09\/23\/plans-for-bigger-defense-budget-get-boost-after-house-authorization-bill-vote\/\" target=\"_blank\"> 2022 National Defense Authorization Act<\/a> contained language from <a href=\"https:\/\/www.defensenews.com\/congress\/2021\/03\/31\/air-land-chairman-talks-f-35-costs-and-buy-america-in-the-next-defense-bill\/\" target=\"_blank\">Rep. Donald Norcross<\/a>, D-N.J., to codify that boost into law, and <a href=\"https:\/\/www.defensenews.com\/congress\/2021\/02\/16\/mark-kelly-tammy-duckworth-and-angus-king-claim-armed-services-gavels\/\" target=\"_blank\">Sen. Tammy Duckworth<\/a>, D-Ill., proposed similar language as an amendment to the Senate\u2019s NDAA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Existing federal laws make \u201cBuy American\u201d exemptions available for countries that have reciprocal defense trade agreements (plus Latvia and Estonia) \u2015 and for the Pentagon to standardize equipment with NATO members and buy equipment overseas that is unavailable or too expensive from domestic suppliers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, some allies are opposed to the changes. In an interview with Defense News on Tuesday, Pieter-Henk Schroor \u2015 a Dutch defense cooperation attach\u00e9 who chairs the <a href=\"https:\/\/www.dmagdc.info\/#:~:text=In%20a%20nutshell%2C%20the%20Defense,champions%20international%20defense%20materiel%20cooperation.&#038;text=Interoperability%2C%20efficient%20procurement%20strategies%2C%20and,to%20transform%20their%20armed%20forces.\" target=\"_blank\">Defense Memorandum of Understanding Attach\u00e9s Group<\/a> and sent the letter \u2015 argued that unraveling defense production agreements will hurt some weapons programs or erode America\u2019s multibillion-dollar defense trade surplus. Some allies who spend heavily on U.S. weapons do so because their countries are allowed to help build those weapons, he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf that incentive would no longer exist, simply because our defense industries would no longer be welcome in U.S. markets, of course that would also have an effect on our incentive to buy here,\u201d Schroor said. \u201cEspecially European countries will start looking at alternatives and would be far more interested than they are currently to buy European.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf there would not be a defense trade with DMAG countries to the level that exists today, that would really damage economic growth in the U.S. or at least cost jobs in the U.S.,\u201d he added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Asked about the matter Tuesday, Reed said in a brief hallway interview he supports Duckworth\u2019s proposed amendment but also said that the intent behind the Democrats\u2019 \u201cBuy American\u201d push is to work with allies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat we want to do with the supply chain is make sure it\u2019s in secure hands, which means some of our closest allies also \u2015 not just exclusively the United States,\u201d Reed said. \u201cIt would technically be very difficult [to untangle U.S. and allied defense supply chains] anyway.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Inhofe said the U.S. would be unable to access all the equipment it needs under what he called a \u201csevere \u2018Buy America\u2019 provision.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defense attach\u00e9 group made a similar request over Norcross\u2019s \u201cBuy American\u201d proposal last year, and it was later dropped from that year\u2019s NDAA. This year, Duckworth\u2019s amendment, if it is taken up and passed, would strengthen the hand of \u201cBuy American\u201d proponents going into NDAA negotiations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Though current law exempts reciprocal trade agreements and more, the group of defense attach\u00e9s would like to see the new proposal from Norcross be amended to include an explicit protection, if the proposal cannot be excised entirely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Schroor said he\u2019d been told the Norcross provision is meant to target China, not allies, but he said that it would go a long way toward soothing allies\u2019 concerns if the legislation made that clear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">America\u2019s largest defense trade union, the <a href=\"https:\/\/www.goiam.org\/\" target=\"_blank\">International Association of Machinists and Aerospace Workers<\/a>, backs both legislative proposals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis amendment will not only grow our industrial base and help give thousands of working Americans the opportunity to improve their lives and communities, but it will increase the number of domestic manufacturers throughout the country,\u201d Robert Martinez Jr., the union\u2019s president, said in a statement Oct. 29.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some critics of the \u201cBuy American\u201d push are especially concerned because the Biden administration is undertaking broader efforts to strengthen domestic supply chains for certain goods and add U.S. manufacturing jobs. Biden and other high-level officials in his administration have said they will look to work with international partners, but some allies hear a mixed message.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe hear about reshoring of economic activities &#8230; and in that same vein that close relationships with allies and partners will be supported. But all in all, it\u2019s not clear enough to us if we will be included or not in the complete overhaul of supply chains,\u201d Schroor said. \u201cAre they looking at the domestic defense industrial
