{"id":24924,"date":"2019-07-10T04:55:19","date_gmt":"2019-07-10T04:55:19","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2019\/07\/10\/war-powers-debate-teed-up-for-defense-policy-bill\/"},"modified":"2026-08-07T22:04:04","modified_gmt":"2026-08-07T22:04:04","slug":"war-powers-debate-teed-up-for-defense-policy-bill","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2019\/07\/10\/war-powers-debate-teed-up-for-defense-policy-bill\/","title":{"rendered":"War powers debate teed up for defense policy bill"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2015 The Democratic-controlled House is expected to vote this week on several measures to limit the president\u2019s power to wage war on Iran and aid the Saudi war in Yemen, after clearing a key procedural hurdle late Tuesday night.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The House Rules Committee, which screens amendments to the chamber\u2019s legislation, met Tuesday night and approved 437 of more than 650 amendments submitted for consideration by Republicans and Democrats, covering a broad array of topics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If voted into the House version of the annual National Defense Authorization Act, the proposed limits on President Donald Trump would likely attract support for the massive defense policy bill from progressive Democrats otherwise repelled by plans to spend $733 billion on national defense. House Armed Services Committee Chairman Adam Smith, D-Wash., will need progressive votes as <a href=\"https:\/\/www.defensenews.com\/opinion\/commentary\/2019\/07\/08\/what-it-will-take-for-the-ndaa-to-pass-along-bipartisan-lines\/\" target=\"_blank\">Republicans<\/a> are not expected to favor the bill in large numbers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But any provisions limiting the president would also likely be sticking points in future negotiations to finalize the bill, mainly between House Armed Services Committee Chairman Adam Smith, D-Wash., and Senate Armed Services Committee Chairman Jim Inhofe, R-Okla. The Senate <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/06\/27\/us-senate-passes-its-defense-policy-bill-86-8-setting-up-fight-with-house\/\" target=\"_blank\">passed<\/a> its bill 86-8 last month.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2019\/05\/21\/democrats-pentagon-budget-bill-would-curb-trumps-war-powers\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"207\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP_18233501318343.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Democrats\u2019 Pentagon budget bill would curb Trump\u2019s war powers<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">A bill to fund the Pentagon at $8 billion less than what the White House requested passed the House Appropriations Committee.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">A major amendment, prohibiting \u201cunauthorized\u201d military force in or against Iran, comes from Rep. Ro Khanna, first vice-chair of the House Progressive Caucus, and Rep. Matt Gaetz, known for his staunch support of the president on Fox News and on Twitter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRep. Khanna believes progressives should, and is hopeful [they] will, ultimately support the NDAA,\u201d Khanna\u2019s communications director Heather Purcell said on Tuesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPassing the Khanna-Gaetz bipartisan amendment, cosponsored by more than 70 members, to prevent funds for war with Iran is the only way to stop Trump from starting another bloody, endless war. If this House bill does not pass, we are stuck with the Inhofe NDAA which is much worse.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The sponsors include Smith; House Foreign Affairs Committee chairman Eliot Engel, D-N.Y.; Congressional Progressive Caucus co-chairs Mark Pocan and Pramila Jayapal; freshman standout Rep. Alexandria Ocasio-Cortez, and Democrats with national security experience like Reps. Elissa Slotkin and Max Rose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Including its Republican co-sponsors Reps. David Schweikert, Ken Buck and Andy Biggs, Khanna\u2019s camp expects around 15 Republicans to vote for the Iran amendment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The bill comes as the Senate\u2019s Republican majority <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/06\/28\/senate-shoots-down-attempt-to-curb-trumps-iran-war-powers\/\" target=_blank>defeated<\/a> a <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/06\/26\/deal-to-move-defense-bill-lets-2020-candidates-vote-on-iran\/\">war authorization measure<\/a> last month, 50-40, meant to bar President Donald Trump from launching a military strike against Iran without Congress\u2019s permission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Overall, the massive policy bill is expected to face a spirited debate on the House floor and narrow vote to passage before the end of the week, following last month\u2019s 21-hour markup in committee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reportedly, divisions within the Democratic party threaten the bill.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m sure we\u2019re going to hate the price tag. The question is what other wins might we be able to achieve,\u201d Rep. Jared Huffman, D-Calif., a member of the Progressive Caucus, told <a href=\"https:\/\/thehill.com\/homenews\/house\/452298-dem-tensions-snag-defense-bill\" target=_blank>The Hill<\/a>. \u201cI\u2019ve not voted for an NDAA in any year I\u2019ve been in Congress. \u2026 I\u2019m going to take a look and am considering it.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2019\/06\/12\/lawmakers-push-and-pull-over-750b-ndaa-top-line-at-hasc-markup\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Smith_Thornberry.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Lawmakers push and pull over $750B defense policy bill NDAA top line at HASC markup<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Partisan sparring over the defense budget&#039;s size shows headwinds for the bill that could fund the military.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The House NDAA reflects a $733 billion authorization for national defense, which is $17 billion less than what the administration wanted, what HASC Republicans wanted, and the top-line of the bill the GOP-controlled Senate passed last month. (The $725 billion House bill excludes $8.2 billion in Department of Energy programs outside HASC jurisdiction.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The White House issued a <a href=\"https:\/\/twitter.com\/OMBPress\/status\/1148715958443413506\" target=_blank>veto threat<\/a> Tuesday evening over the top-line and other issues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HASC Republicans objected to the bill\u2019s prohibition on the military deploying a new class of of low-yield submarine-launched nuclear warhead, restrictions on the president\u2019s authority to transfer prisoners from Guantanamo Bay, as well as several provisions designed to check Trump\u2019s ability to shift resources from the Defense Department to America\u2019s border with Mexico.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">House Republicans are expected to withhold support after all but two of HASC Republicans voted against passing the bill out of committee. That suggests Smith will rely upon progressives to advance the bill.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The HASC\u2019s top Republican, Rep. Mac Thornberry, R-Tex., said in a statement that the bill missed the chance to \u201crebuild our military, reform its broken acquisition system, and meet our commitment to our men and women in uniform\u201d and that it, \u201csadly takes our military backwards in several key areas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere were too many problematic provisions in the bill for most Republicans on the committee to overlook. I am hopeful that as the bill proceeds, it will improve and earn my support,\u201d Thornberry said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Monday, Smith defended the bill against charges it was partisan, telling the House Rules Committee he had worked with Republicans to draft it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn the end we adopted 150 Republican amendments and 190 Democratic amendments,\u201d Smith said. \u201cI hate the implication that I\u2019m not working in cooperation with everyone on the committee when I most certainly am.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Checking Trump on Yemen is another hot topic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After more than 50 Senators passed <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/05\/29\/us-lawmakers-hope-to-block-trumps-saudi-arms-sale-push\/\">measures<\/a> last month aimed at blocking White House plans for $8.1 billion in <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/05\/24\/trump-pushes-through-bomb-sales-over-congress-objections-dems-warn-of-repercussions-for-industry\/\">military sales<\/a> to Saudi Arabia and the United Arab Emirates, the House may use the NDAA to provide its own rebuke. Lawmakers have been displeased by Trump\u2019s use of an emergency declaration to bypass Congress and make the sales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The opposition is fueled by civilian casualties in the Saudi-led air campaign against the Houthis in Yemen as well as the death of Washington Post columnist Jamal Khashoggi. Western intelligence agencies accuse the Saudi crown prince of ordering the killing of the journalist at a Saudi consulate in Turkey.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The House Rules Committee advanced California Democratic Rep. Ted Lieu\u2019s amendment to bar funds to transfer any defense articles or services to Saudi Arabia or the United Arab Emirates under the emergency authority of the Arms Export Control Act that circumvents congressional review. Amash is a co-sponsor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The panel also accepted an amendment limiting the president\u2019s emergency export authority under the Arms Export Control Act, offered by House Foreign Affairs Committee Chairman Eliot Engel, D-N.Y.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2019\/06\/26\/senate-advances-bill-to-push-back-on-trumps-saudi-arms-sales\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1150817582.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Senate advances bill to push back on Trump\u2019s Saudi arms sales<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The Senate Foreign Relations Committee has advanced new restrictions on the president\u2019s ability to use emergency authorities to sell arms without congressional approval.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Likewise, New Jersey Democratic Rep. Tom Malinowski proposed one-year prohibition on the sale of air-to-ground munitions used in the conflict in Yemen to Saudi Arabia and the United Arab Emirates. He also sponsored an amendment that requires the U.S. intelligence community to make a determination of the parties responsible for Khashoggi\u2019s death.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An amendment to bar support to and participation in coalition operations against the Houthis, by Khanna and House Intelligence Committee chairman Adam Schiff, D-Calif., is also set for a vote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The panel accepted Democratic presidential candidate Rep. Tulsi Gabbard\u2019s amendment to bar funds from the Special Defense Acquisition Fund to aid Saudi Arabia or the United Arab Emirates if such assistance could be used to conduct or continue hostilities in Yemen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Beyond Yemen, Progressive Caucus\u2019s co-chair emeritus, Rep. Barbara Lee, D-Calif., will see a vote on her amendment to repeal the 2002 military force authorization for Iraq, which is co-sponsored by
