{"id":31157,"date":"2018-11-23T14:54:49","date_gmt":"2018-11-23T14:54:49","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2018\/11\/23\/constitutional-questions-emerge-about-expanding-role-of-troops-on-us-soil\/"},"modified":"2026-08-08T02:57:24","modified_gmt":"2026-08-08T02:57:24","slug":"constitutional-questions-emerge-about-expanding-role-of-troops-on-us-soil","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/pentagon\/2018\/11\/23\/constitutional-questions-emerge-about-expanding-role-of-troops-on-us-soil\/","title":{"rendered":"Constitutional questions emerge about expanding role of troops on US soil"},"content":{"rendered":"<figure class=\"wp-block-smg-jwplayer-video\"><atype-video-jwplayer nostick=\"true\" playlisturl=\"https:\/\/cdn.jwplayer.com\/v2\/playlists\/fCzRqMW8?tags=a6694772-9ae6-446e-844c-17282d727e34\" poster=\"\/wp-content\/uploads\/2026\/08\/video-poster-a6694772-9ae6-446e-844c-17282d727e34.jpg\" aspectratio=\"16 \/ 9\" mute autostart=\"false\"><\/atype-video-jwplayer><figcaption class=\"wp-element-caption\">Hear Defense Secretary James Mattis tell reporters in a huddle that there has been no call for lethal force at the border.<\/figcaption><\/figure>\n\n\n<p class=\"wp-block-paragraph\">A new <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2018\/11\/21\/white-house-approves-use-of-force-some-law-enforcement-roles-for-border-troops\/\" target=_blank>White House directive <\/a>authorizing U.S. troops to engage in some law enforcement activities on American soil, potentially including <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2018\/11\/02\/i-didnt-say-shoot-trump-says-migrants-will-be-arrested-not-shot-if-they-throw-rocks\/\" target=_blank>the lethal use of force<\/a>, is being sharply questioned by security and legal experts, who are raising concerns about both its underlying legality and the way the White House issued the controversial order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new White House memo authorizes Defense Secretary Jim Mattis to order \u201cDepartment of Defense military personnel\u201d to \u201cperform those military protective activities that the Secretary of Defense determines are reasonably necessary to ensure the protection of federal personnel, including a show or use of force (including lethal force, where necessary), crowd control, temporary detention and cursory search.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The memo also said: &#8220;Department of Defense personnel shall not, without further direction from the President, conduct traditional civilian law enforcement activities.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Security and legal experts interviewed by Military Times questioned how the military could conduct what they said were clear law enforcement roles \u2014 especially detention and search \u2014 and not run afoul of the <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2018\/10\/31\/federal-law-limits-what-us-troops-deployed-at-the-border-can-do\/\" target=_blank>1878 Posse Comitatus Act<\/a>, which explicitly prohibits active-duty military forces from conducting law enforcement activities inside the United States.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s like being a \u2018little bit\u2019 pregnant. You can\u2019t be. You can\u2019t engage in law enforcement without engaging in law enforcement. Those are law enforcement functions as they have been defined for hundreds of years in the United States,&#8221; said William Banks, author of \u201cSoldiers on the Home Front: The Domestic Role of the American Military,\u201d and the former director of the Institute for National Security and Counter-terrorism at the Syracuse University College of Law.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2018\/11\/21\/border-deployment-price-tag-to-date-72-million-pentagon-says\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"212\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/4911788.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">It has cost $72 million so far to deploy active-duty troops to the border, Pentagon says<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The price tag includes the costs of bringing troops home.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In a break from how the president has authorized other military actions along the border, the new authorities were submitted to Mattis via a \u201cCabinet memo\u201d signed by White House Chief of Staff John Kelly instead of a presidential Executive Order. President Donald Trump did sign a precursor to that Cabinet memo, an internal \u201cdecision memo\u201d that was<a href=\"https:\/\/www.newsweek.com\/donald-trump-memo-migrant-caravan-border-troops-1226945\" target=_blank> obtained and published <\/a>by Newsweek.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an interview with reporters Wednesday, Mattis again emphasized that the approximately 5,800 federal <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2018\/11\/01\/heres-the-list-of-military-units-headed-to-the-border\/\" target=\"_blank\">active-duty troops deployed to the border<\/a> would not be armed, and said they would <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2018\/11\/14\/mattis-troops-to-stop-using-the-term-secure-at-border-locations\/\" target=\"_blank\">not conduct arrests or find themselves in a law enforcement role<\/a>.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"\/wp-content\/uploads\/2026\/08\/4918171.jpg.jpg\" alt=\"\" class=\"wp-image-67005\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/4918171.jpg.jpg 1200w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/4918171.jpg.jpg?resize=300,200 300w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/4918171.jpg.jpg?resize=768,512 768w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/4918171.jpg.jpg?resize=1024,683 1024w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><figcaption class=\"wp-element-caption\">Spc. So there\u2019s a hedge in there,&#8221; that would absolve the president if something went wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mattis said Wednesday that the memo has granted the authorities, but he won\u2019t necessarily change anything about how troops are operating now unless asked to do so by the Department of Homeland Security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cStill, if the authorities were used, it would be a major escalation of military function at the border that we haven\u2019t seen in decades,\u201d Cancian said.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a Secretary of Defense shall determine the duration of this deployment,\u201d Mattis \u201cshall consult with the Attorney General and Secretary of Homeland Security prior to withdrawing Department of Defense personnel.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a \u201cbig red flag that this mission is not militarily necessary but is a law enforcement mission,\u201d said Mieke Eoyang, vice president of the national security program at the Third Way think tank.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAs such, it\u2019s a violation of the long standing prohibitions on using federal active duty troops in policing missions inside the United States,\u201d Eoyang added. \u201cAnd that they are authorizing use of lethal force against unarmed families in a law enforcement mission is beyond the pale.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cohn noted that the term \u201cconsult\u201d in that memo \u201cusually does not mean [Mattis] has to get their agreement, just that he has to inform them.\u201d And while consulting with DHS isn\u2019t surprising, given the mission, she calls the inclusion of the attorney general for this particular process \u201cunusual.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m fairly sure that\u2019s because Trump doesn\u2019t trust either [DHS secretary Kirstjen] Nielsen or Mattis right now and wants to make sure that someone loyal to him is notified of any movement before it happens, so he can shape the narrative and not get caught out by a fait accompli,\u201d Cohn said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Thursday, <a
