Ruben Gallego, D-Ariz.; HASC Chairman Adam Smith, D-Wash., and HASC Readiness Subcommittee Chairman John Garamendi, D-Calif., offered a bill Wednesday to cap national emergency military construction authority at $250 million per emergency. The legislation would tighten the ability to waive other provisions of law in carrying out the projects and mandate congressional notification and waiting periods for construction projects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This marks the second time House Democrats have offered legislation restricting the executive branch since the Pentagon unilaterally <a href=\"https:\/\/www.defensenews.com\/smr\/federal-budget\/2019\/05\/13\/us-air-force-nuclear-space-programs-take-hit-in-border-wall-reprogramming\/\" target=\"_blank\">reprogrammed<\/a> $1.5 billion in fiscal 2019 funds last week to support the wall \u2015 that\u2019s more than $2 billion this year in total. On Wednesday, the House Appropriations Committee\u2019s Subcommittee on Defense passed a <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/05\/14\/house-democrats-slash-dod-money-moving-authority-over-trumps-border-wall-gimmicks\/\" target=\"_blank\">2020 Pentagon funding bill<\/a> that slashes the amount of money the military can shift between accounts, from $9.5 billion to $1.5 billion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe legislation introduced today will ensure the use of this emergency military construction authority is transparent, within a reasonable cost range, and most importantly, will only draw from sources of funding that do not hamper existing construction projects or military readiness,\u201d Smith said in a statement.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2019\/05\/10\/storm-ravaged-bases-wait-on-washington-for-repair-money\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1142305056.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Storm-ravaged bases wait on Washington for repair money<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Hundreds of millions of repair dollars are at stake for several stateside military bases.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The appropriations bill that Congress passed in February to reopen the government allocated $1.375 billion for 55 miles of border barriers, but Trump \u2015 by declaring an emergency at the border \u2015 has since sought to shift pools of money to pay for further barrier construction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Democrats have argued that the president\u2019s actions usurp their constitutional power of the purse. Congress attempted to override the emergency declaration, but Trump vetoed the legislation and the veto was <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/03\/26\/house-fails-to-override-trump-veto-in-border-emergency-battle\/\" target=_blank>sustained<\/a> in the House.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last week, acting Defense Secretary Patrick Shanahan told the Senate Appropriations Subcommittee on Defense that the Pentagon had accumulated enough funding for 256 miles of border barriers and that there would be 63 new miles built over the next six months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCongress debated the issue of border security for a year-and-a-half and decided to spend $1.2 billion on more effective border security technologies than the President\u2019s vanity wall,\u201d Garamendi, whose panel oversees military construction, said in a statement. \u201cThis crucial legislation will provide a vital check on the executive branch and prohibit the President from using the MILCON budget and other critical projects as a personal slush fund to fulfill a campaign promise.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The bill\u2019s original cosponsors also include Reps. Salud Carbajal, D-Calif.; Gil Cisneros, D-Calif.; Veronica Escobar, D-Texas; Xochitl Torres Small, D-N.M.; Lori Trahan, D-Mass.; and Filemon Vela, D-Texas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The White House\u2019s acting budget director, Russ Vought, in a May 1 letter to Vice President Mike Pence stressed that the southern border is in a genuine crisis. U.S. Customs and Border Protection in March encountered a record high of more than 100,000 illegal border crossers and \u201cinadmissible aliens,\u201d Vought had said, adding that more than half of the apprehensions on the southern border were migrant families.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI urge the Congress to take swift action to provide the additional funding requested to address the humanitarian and border security crisis at the United States southern border,\u201d Vought wrote. \u201cI also urge the Congress to complete its work to provide supplemental funding for
