{"id":43647,"date":"2021-12-14T16:33:38","date_gmt":"2021-12-14T16:33:38","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2021\/12\/14\/pentagon-watchdog-us-should-insist-transdigm-refund-20-million-in-excess-profit\/"},"modified":"2026-08-07T23:27:09","modified_gmt":"2026-08-07T23:27:09","slug":"pentagon-watchdog-us-should-insist-transdigm-refund-20-million-in-excess-profit","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/industry\/2021\/12\/14\/pentagon-watchdog-us-should-insist-transdigm-refund-20-million-in-excess-profit\/","title":{"rendered":"Pentagon watchdog: US should insist TransDigm refund $20 million in \u2018excess profit\u2019"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 A <a href=\"https:\/\/www.dodig.mil\/reports.html\/Article\/2871623\/audit-of-the-business-model-for-transdigm-group-inc-and-its-impact-on-departmen\/\" target=\"_blank\">new report<\/a> from the Pentagon\u2019s Office of Inspector General recommends the department seek a refund of at least $20.8 million from TransDigm, a company long under fire for what Defense Department officials say is a pattern of collecting \u201cexcess profit.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TransDigm, which makes spare parts for both commercial and military aircraft, in 2019 <a href=\"https:\/\/www.defensenews.com\/industry\/2019\/02\/27\/pentagon-requests-voluntary-refund-of-millions-of-dollars-from-contractor-transdigm\/\" target=\"_blank\">refunded $16 million<\/a> to the Pentagon, though a top executive noted this was not an admission of wrongdoing and was simply \u201cin the best interest of the company.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company has been the <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/05\/15\/defense-firms-excess-profits-land-in-congresss-crosshairs\/\" target=\"_blank\">target of bipartisan ire<\/a>. During a 2019 hearing, Rep. Ro Khanna, D-Calif., said Congress will not tolerate \u201cwar profiteers, those who seek to use the fact that we are at war to hold us hostage and hike their prices on mission-critical defense articles to astronomical levels.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawmakers <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/06\/06\/lawmakers-order-deeper-transdigm-probe-by-dod-watchdog\/\" target=\"_blank\">requested the latest audit<\/a>, which was meant to scrutinize whether the company earned excess profit as well as how its DoD contracts are structured and the company\u2019s impact on the defense market.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The latest IG report, publicly released Monday, found TransDigm made $20.8 million in excess profit on 105 spare parts on 150 contracts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMultiple audit reports over the past 23 years have highlighted the problem of the DoD paying excess profits on sole\u2011source contracts where cost analysis was not used to determine fair and reasonable prices and this problem continues to occur,\u201d the report said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report called for the director of defense pricing and contracting to work with the head of the Defense Logistics Agency to consider \u201calternative contracting strategies\u201d for buying more efficiently from companies like TransDigm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The IG also recommended the defense pricing chief consider whether DoD policy adequately addresses when to use cost analysis to determine whether a price is reasonable for sole-source spare parts. If the current policy isn\u2019t sufficient, the director \u201cshould initiate actions to revise and update policy and guidance.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TransDigm disputed the findings, saying in a statement that the IG used \u201carbitrary standards and analysis.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe report ignores significant real costs incurred by the business and contrary to law, reports these costs as excess profit,\u201d the statement read. \u201cThe report presents profit percentages in a misleading and provocative manner. This includes computing profit as a percentage of cost rather than as a percentage of revenue \u2014 the internationally recognized method and business standard.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">TransDigm was ranked as the 50th largest defense company in the world in Defense News\u2019 <a href=\"https:\/\/people.defensenews.com\/top-100\/\" target=\"_blank\">latest Top 100 list<\/a>. The company made $2.18 billion in defense-related revenue in fiscal 2020; that\u2019s 43% of it total revenue during that time period.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Defense
