{"id":48239,"date":"2025-09-25T01:25:07","date_gmt":"2025-09-25T01:25:07","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2025\/09\/25\/more-troops-suspended-pending-investigations-into-kirk-related-posts\/"},"modified":"2026-08-08T16:36:40","modified_gmt":"2026-08-08T16:36:40","slug":"more-troops-suspended-pending-investigations-into-kirk-related-posts","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/pentagon\/2025\/09\/25\/more-troops-suspended-pending-investigations-into-kirk-related-posts\/","title":{"rendered":"More troops suspended pending investigations into Kirk-related posts"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">More than a dozen service members have been suspended or relieved of duties for social media activity related to conservative activist Charlie Kirk\u2019s death.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier this month, after Kirk was shot and killed during a Sept. 10 event at Utah Valley University in Orem, Utah, Defense Secretary <a href=\"https:\/\/x.com\/PeteHegseth\/status\/1966274615975739604\" target=\"_blank\" rel=\"\" title=\"https:\/\/x.com\/PeteHegseth\/status\/1966274615975739604\">Pete Hegseth<\/a> said that any social media post celebrating or mocking the assassination of Kirk was \u201ccompletely unacceptable\u201d and would be addressed \u201cimmediately.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some social media accounts appearing to belong to service members have been identified online by other accounts for comments, including \u201cracists should get shot\u201d and reposts saying, \u201cMAKE NAZIS DEAD AGAIN,\u201d according to a review of X posts by Military Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other service members have been targeted online for calling Kirk or his comments \u201cracist\u201d and \u201csexist\u201d while also explicitly stating that they do not condone his killing. It is not clear whether any of these service members are under investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An Army spokeswoman told Military Times on Wednesday that \u201capproximately a dozen Soldiers have been suspended pending review of their social media account activity.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese numbers are subject to change as commands review social media activity and take appropriate action,\u201d she added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Marine Corps confirmed to Military Times this week that the service branch has relieved a Marine from recruiting duties after \u201ca social media post that does not align with our core values.\u201d The matter is currently under investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Air Force said it was in the process of taking \u201cnecessary administrative and disciplinary actions to hold service members accountable\u201d for inappropriate actions, but declined to say how many airmen<b> <\/b>were currently under investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, the Navy said it was actively reviewing reports of <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2025\/09\/22\/navy-issues-instructions-for-reporting-improper-social-media-use\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.navytimes.com\/news\/your-navy\/2025\/09\/22\/navy-issues-instructions-for-reporting-improper-social-media-use\/\">social media activity<\/a> that is \u201cmisaligned with the Department\u2019s current social media guidance.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cService members are subject to the Uniform Code of Military Justice at all times, including behavior conducted in the digital space. Sailors are expected to uphold Navy core values on duty, off duty, and online,\u201d a Navy spokesperson told Military Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Coast Guard has also identified a Guard member who carried out \u201cinappropriate personal social media activity\u201d that a spokesperson said was contrary to Coast Guard values.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWith the support of DHS, we are actively investigating this activity and will take appropriate action to hold the individual accountable. We recognize the harm such behavior can cause and remain steadfast in ensuring that the conduct of our personnel reflects the trust and responsibility placed in us by the American people,\u201d the spokesperson added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Uniform Code of Military Justice is a federal law that addresses consequences for violating several principles of the military, ranging from mutiny and disobeying lawful orders to drunk and disorderly conduct and adultery. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors have previously tried to discipline service members for social media posts under <a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title10-section934&amp;num=0&amp;edition=prelim\" target=\"_blank\" rel=\"\" title=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title10-section934&amp;num=0&amp;edition=prelim\">Article 134<\/a> of the UCMJ, known as the \u201cGeneral Article,\u201d which criminalizes conduct that is \u201cprejudice[ial] to good order\u201d and serves as a catch-all for a variety of offenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, UCMJ violations for social media posts under Article 134 could prove challenging in a court-martial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2008, an Army soldier was court-martialed for posting white supremacist views online. The U.S. Court of Appeals for the Armed Forces concluded that the soldier was not violating Article 134 of the UCMJ because speech cannot be in violation \u201csolely because the speech would be offensive to many or most.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe conclude that a direct and palpable connection between speech and the military mission or military environment is also required for an Article 134, UCMJ, offense,\u201d the court ruled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf such a \u2026 connection were not required, the entire universe of service member opinions, ideas, and speech would be held to the subjective standard of what some member of the public, or even many members of the public, would find offensive,\u201d <a href=\"https:\/\/www.armfor.uscourts.gov\/opinions\/2008Term\/05-0159.pdf\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.armfor.uscourts.gov\/opinions\/2008Term\/05-0159.pdf\">the court added<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pentagon could also discipline troops for social media posts by using nonjudicial means, such as letters of reprimand that could impact
